Regulations of Shaanxi Province on Education Supervision (20 19)
Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Education Law of the People's Republic of China, the Regulations on Education Supervision and other laws and regulations, combined with the actual situation of this province, in order to ensure the implementation of education laws, regulations and national education policies and promote the development of education science. Article 2 These Provisions shall apply to the implementation of educational supervision for all kinds of education at all levels within the administrative region of this province.

Education supervision includes the following contents:

(a) the people's governments at or above the county level shall supervise the relevant departments of the people's governments at the corresponding levels and the people's governments at lower levels to implement the education laws, regulations, rules and national education policies;

(two) the people's governments at or above the county level shall supervise the education and teaching of schools and other educational institutions (hereinafter referred to as schools) within their respective administrative areas;

(3) The people's governments at or above the county level shall evaluate and monitor the development and quality of education within their respective administrative areas. Article 3 The people's governments at or above the county level shall strengthen their leadership over education supervision, coordinate and solve major problems in education supervision, establish and improve the system and mechanism of education supervision, rationally allocate education supervision personnel, and incorporate education supervision funds into the fiscal budget. Article 4 The educational supervision institutions of the people's governments at or above the county level shall undertake the educational supervision work within their respective administrative areas, and independently exercise their educational supervision duties under the leadership of the people's governments at the corresponding levels. Fifth people's governments at or above the county level shall strengthen the informatization construction of education supervision and improve the efficiency of education supervision. Article 6 Encourage educational supervision of scientific research and support educational supervision institutions to strengthen international and domestic exchanges and cooperation.

Encourage and support citizens, legal persons and other organizations to participate in educational supervision activities in an orderly manner according to law. Chapter II Supervision Institutions and Inspectors Article 7 Educational supervision institutions shall perform the following duties:

(a) overall planning, organization and implementation of education supervision work, formulate the implementation plan and rules and regulations of education supervision and evaluation work;

(two) to supervise, inspect and evaluate the performance of educational duties by the relevant departments of the people's government at the same level and the people's governments at lower levels;

(three) to supervise, inspect and guide the school;

(4) Assessing and monitoring the development and quality of regional education;

(five) to carry out educational supervision and training, assessment and management;

(six) other educational supervision duties as prescribed by laws and regulations. Article 8 Educational supervision institutions may exercise the following functions and powers when implementing educational supervision:

(a) to consult and copy financial accounts, personnel files, student status and other documents and materials related to educational supervision;

(two) to require the supervised unit to explain the relevant issues of supervision matters;

(three) to carry out investigations on issues related to supervision matters;

(four) to draw the people's government at the same level or the competent department to give rewards and punishments to the supervised unit or its relevant person in charge.

The supervised unit and its staff shall actively cooperate with the work of educational supervision institutions according to law and shall not refuse or obstruct them. Ninth people's governments at or above the county level shall establish an inspector system in accordance with state regulations.

The people's governments at or above the county level shall, according to the needs of educational supervision, provide full-time inspectors for educational supervision institutions, and appoint and remove them in accordance with the qualifications, authority and procedures prescribed by the state.

According to the needs of educational supervision, educational supervision institutions may appoint part-time inspectors in accordance with the qualifications prescribed by the state, and the appointment results shall be announced to the public. The term of office of part-time inspectors is 3 years, with no more than 3 consecutive terms. Tenth inspectors shall perform the following duties:

(a) assigned by the education supervision institutions to supervise the school;

(two) to participate in special supervision and comprehensive supervision organized by educational supervision institutions;

(three) to participate in the evaluation and monitoring organized by educational supervision institutions;

(four) to complete other tasks assigned by the educational supervision institutions. Eleventh inspectors appointed by educational supervision institutions, the implementation of educational supervision can exercise the following functions and powers:

(a) to enter the relevant departments and schools to carry out investigations on issues related to supervision matters;

(two) to consult and copy the documents and materials related to the supervision matters;

(three) to require the supervised unit to explain the relevant issues of supervision matters;

(four) by interviewing the relevant person in charge, urge the problem to be rectified and implemented;

(five) to supervise and inspect the rectification of the supervised units. Twelfth educational supervision institutions should strengthen the management of educational supervision activities of inspectors, assess the performance of their duties as inspectors, and establish a dynamic management system.

Inspectors shall objectively and fairly reflect the actual situation when implementing educational supervision, and shall not conceal or fabricate facts. Thirteenth inspectors who implement supervision are close relatives of the main person in charge of the supervised unit or have other circumstances that may affect the objective and fair implementation of educational supervision, and should be avoided. Chapter III Supervision and Implementation Article 14 Educational supervision institutions shall supervise the relevant departments of the people's governments at the corresponding levels and the people's governments at lower levels, including the following matters:

(a) the implementation of education laws, regulations, rules and national education policies;

(2) Formulating and implementing educational development plans;

(3) Promoting education equity, balanced development of regional compulsory education, educational modernization and coordinated development of all kinds of education at all levels as a whole;

(four) the investment, management and use of education funds, and the guarantee and improvement of school conditions;

(five) the construction of principals and teachers and the guarantee of treatment;

(6) Coordinating and promoting school education, social education and family education;

(seven) the solutions to the hot and difficult problems of education concerned by the society;

(eight) other matters stipulated by laws, regulations, rules and national education policies.
