Chapter I General Principles
Article 1 In order to promote the scientific, institutionalized and standardized education and training of cadres and cultivate high-quality cadres, these Regulations are formulated in accordance with the Civil Service Law of People's Republic of China (PRC) and relevant laws and regulations.
Article 2 The education and training of cadres must adhere to the guidance of Marxism–Leninism, Mao Zedong Thought, Deng Xiaoping Theory and Theory of Three Represents, comprehensively implement Scientific Outlook on Development, focus on the overall situation of the work of the party and the state, follow the requirements of seeking truth from facts, advancing with the times, working hard and governing for the people, and strive to enhance the ruling consciousness and improve the ruling ability. Promote the construction of learning-oriented political parties and learning-oriented society, and provide ideological and political guarantee, talent guarantee and intellectual support for building a well-off society in an all-round way and accelerating socialist modernization.
Article 3 The education and training of cadres shall follow the following principles:
(A) people-oriented, according to the needs of teaching. In accordance with the requirements of the party and the state, we should grasp the law of cadre growth and the needs of education and training, carry out cadre education and training at different levels, stimulate the internal motivation and potential of cadre learning, and enhance the pertinence and effectiveness of cadre education and training.
(2) Training all employees to ensure quality. Cadre education and training is geared to all cadres, creating conditions for everyone to receive education and become a talent, training cadres on a large scale, greatly improving the quality of cadres, and realizing the unity of scale, quality and benefit of cadre education and training.
(3) All-round development, focusing on ability. Adhere to the principles of revolutionization, youthfulness, knowledge, specialization and having both ability and political integrity of cadres, comprehensively improve the ideological and political quality, scientific and cultural quality, professional quality and health quality of cadres, and carry out capacity training throughout the whole process of cadre education and training.
(4) Combine with practice and apply what you have learned. Closely related to the new changes in the international situation, the new progress in China's reform, opening up and socialist modernization, and the cadres' thoughts and work practices, we should guide cadres to use the theories and knowledge they have learned to guide practice, and improve their ability to solve practical problems while transforming the subjective world.
(5) keep pace with the times, reform and innovation. Adapt to the needs of economic and social development, innovate training contents, improve training methods, integrate training resources, optimize training teams, and promote theoretical innovation, system innovation and management innovation in cadre education and training.
Article 4 These Regulations shall apply to the education and training of cadres of Party committees, people's congresses, governments, CPPCC committees, disciplinary committees, people's courts, people's procuratorates, organs of democratic parties and people's organizations at all levels. The education and training of state-owned enterprises and institutions shall be implemented with reference to these regulations.
Chapter II Management System
Article 5 Under the leadership of the CPC Central Committee, the national cadre education and training work is under the responsibility of the Organization Department of the Central Committee, the relevant departments of the central and state organs are responsible for the division of labor, and the central and local governments manage it at different levels.
Article 6 The Organization Department of the Central Committee shall perform the functions of overall planning, macro-guidance, coordination of services, supervision, inspection and regulation of cadre education and training throughout the country.
The relevant departments of the central and state organs shall be responsible for the education and training of relevant cadres and guide the professional training of this system in accordance with the division of responsibilities.
Article 7 Local Party committees at all levels shall lead the education and training of local cadres, implement the principles and policies of the Party and the state on cadre education and training, incorporate cadre education and training into the economic and social development plan of the region, and study and deploy the education and training of local cadres.
The organizational departments of local party committees at all levels are in charge of the education and training of local cadres. Local party committees at all levels and relevant government departments are responsible for the education and training of cadres.
Article 8 The unit to which cadres belong shall be responsible for organizing and implementing the cadre education and training of the unit according to the cadre management authority.
Ninth departments and local dual management of cadre education and training by the competent party is responsible for organizing; After consultation, it can also be organized by the coordinator.
Chapter III Education and Training Objects
Tenth cadres have the right and obligation to receive education and training.
Article 11 The object of cadre education and training is all cadres, with emphasis on leading party and government cadres at or above the county level and their reserve cadres.
Twelfth cadres should participate in the corresponding education and training according to different situations:
(a) all kinds of job training during the on-the-job period;
(2) On-the-job training for promotion to leadership positions;
(3) Specialized business training for special jobs;
(four) the new record of initial training (employment);
(5) Other training.
Article 13 Party and government leading cadres at the provincial or ministerial level, bureau level and county level have participated in the training of Party schools, administrative colleges, cadre colleges or other training institutions recognized by the organization (personnel) departments of units at or above the bureau level for more than three months every five years. If the personnel who are promoted to leadership positions fail to meet the requirements of education and training before promotion due to special circumstances, they shall complete the training within 1 year after promotion.
The time for other cadres to participate in full-time education and training shall be determined according to the relevant regulations and work needs, and generally not less than 0.2 days per year.
Conditional places and departments can implement the credit system for cadre education and training hours.
Fourteenth cadres must abide by the rules and regulations of education and training, and complete the prescribed education and training tasks.
Fifteenth cadres in the organization to participate in full-time education and training, generally should enjoy the same treatment on the job.
Chapter IV Contents and Methods
Article 16 The education and training of cadres should be based on the needs of economic and social development, the requirements of strengthening the construction of the Party's ruling ability and advanced nature, the requirements of post responsibilities and the characteristics of cadres of different levels and categories, with political theory, policies and regulations, professional knowledge, cultural accomplishment and skills training as the basic content, focusing on political theory training, and comprehensively using organizational training and autonomous learning, off-the-job training and on-the-job self-study, domestic training and overseas training to promote the overall quality and ability of cadres.
Article 17 The focus of political theory training is Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory and Theory of Three Represents education, establishing and implementing Scientific Outlook on Development's correct outlook on political achievements, the Party's history, fine traditional style and discipline, and the national conditions education, guiding cadres to strengthen their communist ideals and Socialism with Chinese characteristics beliefs, adhere to Marxist world outlook, outlook on life, values and correct views on power, status and interests, consolidate their theoretical foundation, and broaden their world horizons and interests.
Non-party cadres should be trained in political theory according to their own characteristics.
Article 18 The training of policies and regulations focuses on strengthening the education of the party's line, principles and policies and national laws and regulations, and conducts training around the major arrangements and requirements of the party and the state in economy, politics, culture, society, diplomacy, national defense, etc., so as to improve the ability of cadres at all levels to govern scientifically, democratically and according to law.
Nineteenth business knowledge training focuses on strengthening the knowledge training necessary to perform job responsibilities and improving the practical work ability of cadres.
Twentieth cultural literacy training and skills training should be carried out in accordance with the requirements of improving the knowledge structure of cadres and improving their comprehensive quality.
Twenty-first adhere to and improve the organization training system. The cadre education and training management department is responsible for formulating the full-time training plan for cadres and transferring cadres to participate in full-time training. The unit where the cadres work has completed the training task as planned. The transferred cadres must obey the training of the organization.
Implement the declaration system of cadre training plan. Party committees and government departments must report to the competent department of cadre education and training at the same level for examination and approval when transferring leading members of lower-level party committees and governments to participate in training, so as to avoid multiple trainings and repeated trainings.
Twenty-second establish and improve the on-the-job self-study system for cadres. Encourage cadres to participate in study and training in their spare time.
The unit where the cadres work shall put forward requirements for on-the-job self-study of cadres and provide necessary conditions.
Twenty-third cadres choose their own schools. Under the guidance of the cadre education and training management department, cadres can choose their own institutions, contents and time to participate in education and training.
The management department of cadre education and training or the cadre education and training institution shall regularly publish the education and training plan for independent course selection of cadres, specify the requirements and strengthen management.
Twenty-fourth to strengthen and improve overseas training. The management department of cadre education and training shall, according to the needs of the work, scientifically set up overseas training programs, select the best training targets, reasonably determine training institutions, strictly manage the training process, and pay attention to the quality and efficiency of training.
Twenty-fifth to carry out cadre education and training should be based on the characteristics of cadres, comprehensive use of lectures, research, cases, simulation, experience and other teaching methods to improve the quality of training.
Twenty-sixth to promote network training, distance education, audio-visual education, improve the information level of cadre education and training teaching and management.
Chapter V Education and Training Institutions
Twenty-seventh strengthen the construction of cadre education and training institutions, and build a cadre education and training institution system with clear division of labor, complementary advantages, reasonable layout and orderly competition. Give full play to the main channel role of party schools, administrative colleges and cadre colleges in cadre education and training.
Twenty-eighth party schools, administrative colleges and cadre colleges should highlight the characteristics of running schools and carry out cadre education and training in accordance with the division of functions.
Department and industry cadre education and training institutions shall, in accordance with their respective responsibilities, do a good job in the education and training of cadres in their own departments and industries.
Institutions of higher learning and research institutes can give full play to their own advantages and undertake the task of education and training of relevant cadres.
The management department of cadre education and training may entrust qualified social training institutions and overseas training institutions to undertake cadre training projects.
All kinds of cadre education and training institutions should strengthen exchanges and cooperation at home and abroad, and promote the optimal allocation of cadre education and training resources through joint running of schools.
Twenty-ninth cadre education and training institutions must implement the principles and policies of the party and the state on cadre education and training, and adhere to the socialist direction of running schools.
Cadre education and training institutions should deepen teaching reform, innovate training content, improve training methods, scientifically set up training courses and academic system, improve discipline structure and curriculum design, and improve teaching level according to training needs.
Cadre education and training institutions should deepen the reform of personnel system, management system and distribution system, establish dynamic and efficient management mechanism and improve management level.
Thirtieth party committees and governments at all levels should strengthen the construction of leading bodies in cadre education and training institutions, and improve the infrastructure and school conditions of cadre education and training institutions.
Party committees and governments at all levels should focus on supporting cadre education and training institutions with good conditions and obvious advantages, and adjust and rectify cadre education and training institutions that do not have the ability and conditions to run schools.
Thirty-first the establishment of cadre education and training institutions access system. Training institutions undertake the task of cadre education and training, and must obtain the qualification approval of the cadre education and training management department. The management department of cadre education and training should formulate and publish the corresponding access standards.
Cultivate and standardize the cadre education and training market, guide the cadre education and training institutions to optimize their services and improve their quality, and gradually form an open, equal and orderly cadre education and training market mechanism oriented by the competent department of cadre education and training.
Thirty-second cadre education and training to implement the project management system. Cadre education and training management departments can determine the education and training institutions that undertake training projects by means of direct entrustment and bidding, strengthen project implementation management and improve training performance.
Thirty-third strengthen the construction of cadre education and training managers, pay attention to training, promote exchanges, optimize the structure and improve the quality.
Chapter VI Teachers, Teaching Materials and Funds
Thirty-fourth in accordance with the principle of excellent quality, moderate scale, reasonable structure, and the combination of full-time and part-time jobs, we will build a team of high-quality cadres' education and training teachers.
Thirty-fifth teachers engaged in cadre education and training should have good ideological and political quality and professional ethics, a high level of theoretical and policy, a solid professional knowledge base, some practical work experience, master modern education and training theories and methods, and be competent for teaching and scientific research.
Thirty-sixth full-time teachers shall implement the system of post appointment and competition for posts, and strengthen the construction of full-time teachers through assessment, reward and punishment and education and training.
Establish a knowledge updating mechanism for full-time teachers to ensure that the total time for full-time teachers to participate in education and training every year is not less than 1 month. Gradually establish a teacher evaluation system that meets the characteristics of cadre education and training.
Hire party and government leading cadres with rich practical experience and high theoretical level, enterprise managers, experts and scholars at home and abroad as part-time teachers, and give full play to the role of part-time teachers.
Establish a database of cadres' education and training teachers in the whole country and all provinces, autonomous regions and municipalities directly under the central government to realize resource sharing.
Article 37 The construction of teaching materials for cadre training should meet the needs of different types of cadres' education and training, focus on improving the comprehensive quality and ability of cadres, and gradually establish an open, diverse and distinctive teaching material system.
Thirty-eighth adhere to the combination of development and utilization of cadre training materials, so as to separate editing and review. The Steering Committee for the Compilation and Review of National Cadre Training Textbooks is responsible for organizing the formulation of the construction plan and syllabus of cadre training textbooks and examining and approving the national cadre training textbooks; Relevant localities, departments and institutions may, according to the requirements of the syllabus, compile training materials for cadres with their own characteristics, and may choose excellent publications at home and abroad.
Thirty-ninth strengthen the management and supervision of the compilation, publication, distribution and use of cadre training materials.
Fortieth cadre education and training funds should be included in the annual budget of governments at all levels, and gradually increase with the growth of fiscal revenue to ensure the needs of cadre education and training.
Strengthen the management of cadre education and training funds.
Chapter VII Evaluation and Evaluation
Forty-first the establishment of cadre education and training assessment and incentive mechanism. Take the education and training of cadres as the content of cadre assessment and one of the important basis for appointment and promotion.
Forty-second cadre education and training assessment includes the learning attitude and performance of cadres, the mastery of political theory, policies and regulations, professional knowledge, cultural knowledge and skills, and the ability to solve practical problems.
Forty-third cadre education and training assessment should be implemented according to different education and training methods. The assessment of organizational training and independent selection of cadres shall be implemented by cadre education and training institutions; The assessment of on-the-job self-study of cadres shall be conducted by the unit where the cadres work; The assessment of overseas training shall be conducted by the organizer or the unit where the cadres work.
Cadre education and training shall be managed by registration. The competent departments of cadre education and training at all levels and the units where cadres belong shall, in accordance with the cadre management authority, establish and improve the cadre education and training files, and truthfully record the cadres' participation in education and training and the assessment results.
Forty-fourth organizations (personnel) departments in the annual assessment and appointment of cadres, cadres should receive education and training as an important content.
Forty-fifth the establishment of cadre education and training institutions evaluation system. Formulate scientific and reasonable evaluation index system and standardized and simple evaluation methods, and strengthen the evaluation of cadre education and training institutions.
Forty-sixth cadre education and training institutions to assess the contents of the school policy, training quality, teaching staff, organization and management, infrastructure, funding and so on.
Forty-seventh departments in charge of cadre education and training are responsible for the evaluation of cadre education and training institutions, and may also entrust intermediary institutions to evaluate them.
Forty-eighth cadre education and training management departments should make full use of the evaluation results and put forward guiding opinions on the construction and development of cadre education and training institutions. Cadre education and training institutions shall, according to the evaluation results, improve the education and training of cadres.
Chapter VIII Supervision and Discipline
Forty-ninth party committees and governments at all levels and their relevant departments, cadre education and training institutions, units where cadres work and cadres themselves must strictly implement these regulations and consciously accept organizational supervision, mass supervision and social supervision.
Article 50 The competent department of cadre education and training shall, in accordance with the authority of cadre management, supervise and inspect the cadre education and training work and the implementation of these Regulations in conjunction with relevant departments, stop and correct the violations of these Regulations, and put forward opinions and suggestions on the relevant responsible personnel.
Fifty-first cadres who fail to participate in education and training for some reason or do not meet the requirements of education and training shall make up training in time. Those who do not participate in education and training without justifiable reasons should be criticized and educated until they are dealt with.
Cadres who violate relevant regulations and disciplines during their participation in education and training shall be given criticism and education until disciplinary action, depending on the seriousness of the case.
Cadres who resort to deceit to obtain academic qualifications or degrees should be dealt with severely in accordance with relevant regulations.
Fifty-second cadres where the unit fails to perform the duties of cadre education and training in accordance with the regulations, the cadre education and training management department shall order rectification within a time limit, and give informed criticism within a certain range.
Fifty-third cadre education and training institutions and cadres where the unit is under any of the following circumstances, the competent department of cadre education and training shall order rectification within a time limit; Overdue reform, given to informed criticism; If the circumstances are serious, the relevant departments shall give disciplinary action to the * * * member who bears the main responsibility and the person directly responsible:
(1) Recruiting students by improper means;
(two) to organize domestic and foreign or other high-consumption activities in the name of cadre education and training;
(three) in violation of the relevant provisions of the state to collect training fees for cadres;
(4) Issuing academic qualifications or degree certificates, qualification certificates or training certificates without authorization in violation of relevant state regulations;
(five) other acts in violation of the provisions of this Ordinance.
Chapter IX Supplementary Provisions
Article 54 Party committees of all provinces, autonomous regions and municipalities directly under the Central Government shall formulate specific implementation measures in accordance with these Regulations.
Article 55 Measures for the education and training of cadres of the China People's Liberation Army and the Chinese People's Armed Police Force shall be formulated by the Central Military Commission (CMC) in accordance with the principles of these Regulations.
Article 56 The Organization Department of the Central Committee is responsible for the interpretation of these Regulations.
Article 57 These Regulations shall come into force as of the date of promulgation.
