General rule
Article 1 In order to strengthen the management of kindergartens and promote the healthy development of preschool education in our province, these measures are formulated in accordance with the relevant provisions and combined with the actual situation in our province.
Article 2 These Measures shall apply to all kinds of kindergartens (including rural preschool classes) held in our province with children aged 0-6 as the educational object.
Article 3 Preschool education is an important part of national education. It is necessary to implement the national education policy, follow the laws of preschool children's physical and mental development and education, adhere to the combination of conservation and education, and lay the foundation for children's lifelong development.
Fourth education departments at all levels are the competent departments of preschool education, responsible for the management of preschool education in this area, and provide professional guidance to kindergartens at all levels.
Fifth governments at all levels and other relevant departments should do a good job in kindergarten management according to their respective responsibilities.
Sixth establish and improve the kindergarten evaluation system and classification management system, strengthen the supervision, evaluation, supervision, inspection and guidance of kindergartens at all levels.
Chapter I Establishment of Kindergartens
Seventh adhere to the government-led, social participation, public and private simultaneously, fully mobilize the enthusiasm of all parties, expand preschool education resources in various forms to meet the basic needs of the people.
Eighth encourage social forces to set up kindergartens in various forms, and actively explore and innovate the management mode and operation mechanism of preschool education. The management and operation of public kindergartens are separated, and the management is entrusted with reference to the management mode of public kindergartens.
Article 9 The kindergarten admission system shall be implemented. The establishment of kindergartens shall be declared by the local township (street) education office or central school in accordance with the principle of territorial management, and the county-level education department shall be responsible for examination and approval, and issue the "Henan Province Kindergarten Park Permit" (hereinafter referred to as the "Park Permit").
After obtaining a school license, a private kindergarten shall apply for a school license for private education according to law, and then register with the civil affairs department to obtain a legal person license for a private non-enterprise unit.
No unit or individual may hold a kindergarten without obtaining the Permit for Running a Park and going through the registration formalities.
Article 10 Social organizations that hold kindergartens have the status of legal persons; Citizens who run kindergartens should have political rights and full capacity for civil conduct. The kindergartens held should meet the basic standards of kindergartens in Henan Province.
Eleventh to apply for the establishment of a kindergarten, the following materials shall be submitted to the examination and approval authority:

To apply for holding a private kindergarten, the following materials shall be provided:
1. Qualification certificate of sponsors and list of members of decision-making bodies.
2. Qualification certificates of directors, teachers, nurses and other staff members and health certificates issued by qualified health inspection units.
3. Legal and valid asset certification documents for the planned kindergarten.
4. Draft articles of association of the kindergarten to be established (including school purpose, management system, enrollment object and scope, composition of teaching staff, education protection plan, etc.). ) and development planning.
5. House title certificate. If you rent a garden, you should provide a legally binding lease contract or agreement.
6 valid documents approved by the public security fire department.
7. On-site health supervision and audit opinions issued by health supervision institutions at or above the county level.

Twelfth kindergartens should use standardized names, which should generally be used together with place names.
The name cannot be preceded by the name or place name of the province or municipality under its jurisdiction alone, nor can it be preceded by the words "China", "China" and "International"; The words "Henan" and "Henan Province" in the name must be approved by the Provincial Department of Education and relevant departments.
Words with religious and superstitious meanings shall not be used in the name.
Thirteenth private kindergartens shall be held in accordance with the relevant provisions of the People's Republic of China (PRC) Private Education Promotion Law. To undertake the construction of public private kindergartens, it shall sign a contract or agreement with the education department to entrust kindergartens, and clarify the rights and obligations.
Fourteenth kindergartens holding branch parks or cooperative parks must be approved by the competent authorities and reported to the original examination and approval authority for approval. All kinds of kindergartens must have independent legal persons, carry out independent economic accounting, have independent kindergartens and independently carry out conservation and education work.
Chinese-foreign cooperation in running schools shall be examined and approved by the Provincial Department of Education in accordance with the requirements of the Regulations of People's Republic of China (PRC) on Chinese-foreign Cooperation in Running Schools (Order No.372nd of the State Council).
Cities (including urban areas and county towns) may not hold any form of preschool classes.
Fifteenth for kindergartens that have obtained the "School License" and gone through the registration formalities, the relevant departments of price, finance, health and taxation. Relevant procedures shall be handled in a timely manner in accordance with regulations.
Kindergarten can enroll students only after completing the above procedures.

Seventeenth kindergartens, once registered, shall not arbitrarily change the organizer or organizer, shall not be moved without authorization. If it is really necessary to change, the organizer or organizer shall submit a written application, and the change can only be made with the consent of the original examination and approval authority.
Kindergarten change registration matters, with the consent of the original examination and approval authority, to the relevant departments for registration within 30 days.
Article 18 If the kindergarten is closed for some reason, the sponsor or the sponsor shall submit a written application to the original examination and approval authority 30 days in advance, and submit a resettlement plan for the liquidation plan and the children of the staff and workers, and the kindergarten can be closed only after approval.
Chapter II Protection and Education
Nineteenth kindergartens should implement the principle of combining conservation with education, create a harmonious environment suitable for children's education and development, and guide the healthy development of children's personality.
Kindergartens should protect children's health and cultivate children's good living and hygiene habits; Promote children's intellectual development; Cultivate children's feelings of loving the motherland and good moral behavior.
Twentieth kindergarten enrollment should comply with the provisions of the education department. Kindergarten classes are generally small class of 25 people, middle class of 30 people and large class of 35 people. Conditional can set up a small class, the class size is generally 20 people. Rural preschool classes shall not exceed 40 people. The number of children in each class in boarding kindergartens should be appropriately reduced.
Article 21 When children enter the park, kindergartens need to check their vaccination certificates and report to the local disease control institutions, and urge children who have not completed the vaccination procedures to check and replant the relevant vaccines in time. Children who have not completed vaccination procedures as required are not allowed to enter the park. Children should go to qualified medical and health institutions such as maternal and child health care institutions for physical examination before entering the park, and those who fail the physical examination are not allowed to enter the park.
In addition to physical examination, it is forbidden to hold any form of inspection or investigation when children enter the park.
Twenty-second kindergartens should use Mandarin.
Twenty-third kindergartens should take games as the basic form of activities, integrate education into life and activities, prevent the tendency of primary school and adult, and guide the healthy development of children's physical and mental science.
Twenty-fourth teaching staff should have good professional ethics, respect and care for children, and become guides, supporters and collaborators of children's learning activities.
Corporal punishment and corporal punishment of children in disguised form are strictly prohibited.
Twenty-fifth kindergartens should establish a scientific one-day living system and arrange children's meals, naps, games, outdoor activities and educational activities reasonably. The interval between meals is generally 3.5 hours; Outdoor activities shall be no less than 2 hours a day, including sports activities of no less than 1 hour.
Twenty-sixth kindergartens should establish a scientific evaluation system of conservation education.
Kindergarten should establish a growth file for each child. Teachers and caregivers should make observation records and case analysis of children, observe children's behavior and performance in a targeted manner, analyze children's development status and development requirements in time, and adjust teaching design in time.
Twenty-seventh kindergartens should actively carry out teaching and research activities. Early childhood education experiments must be approved by the local education departments at or above the county level. Without approval, kindergartens shall not carry out various forms of educational experiments, and shall not hang plaques of various educational experimental research bases at will.
Twenty-eighth kindergartens shall not require children to buy any textbooks and children's books.
Chapter III Administrative Affairs
Twenty-ninth kindergartens implement the director responsibility system, and the director is fully responsible for the work of kindergartens.
The kindergarten director shall be appointed by the unit, organization or individual holding the kindergarten, and shall be filed with the kindergarten examination and approval authority.
Teachers, doctors, health workers, nurses and other staff of private kindergartens are employed by kindergarten directors or by units, organizations or individuals that organize kindergartens.
The allocation and use of teaching staff in public kindergartens shall be implemented in accordance with the policies of the state and institutions in our province on personnel management.
Thirtieth kindergartens shall be equipped with teaching staff in accordance with the relevant provisions of the state and our province. Private kindergartens shall go through the employment procedures in accordance with the requirements of relevant laws and regulations on labor security, and protect the legitimate rights and interests of teaching staff according to law.
Thirty-first kindergarten directors, teachers and other staff should have qualified academic qualifications stipulated by the state, obtain corresponding qualifications, and meet other conditions stipulated in the Regulations on Kindergarten Work.
Thirty-second all kinds of kindergarten staff should obtain health certificates. Mental patients and patients with chronic infectious diseases are not allowed to work in kindergartens.
Thirty-third kindergarten staff should participate in on-the-job training and continuing education in accordance with the provisions of the education department and relevant departments.
Kindergartens should provide conditions for teachers' scientific research and teaching research through various forms to promote teachers' professional growth.
Thirty-fourth kindergartens should have a stable source of funds to ensure the normal operation of conservation and education. Kindergarten organizers or contractors should arrange a certain amount of special funds for the maintenance and equipment renewal of kindergartens every year.
Thirty-fifth kindergartens must strictly implement the provisions of the competent price department, finance, education and other departments on the management of kindergarten fees.
Thirty-sixth kindergartens shall not charge extra fees on the grounds of setting up experimental classes, characteristic classes and interest classes, and shall not seek economic benefits by organizing children's activities.
Thirty-seventh kindergartens should abide by the financial management system, implement independent accounting of funds, earmarking, and consciously accept audit supervision.
A special account must be set up for children's meal expenses, and the accounts should be disclosed to children's parents regularly.
Thirty-eighth kindergartens should have a certain proportion of funds for the purchase of teaching AIDS and books every year.
Thirty-ninth encourage and support social organizations and individual citizens to donate property to kindergartens.
Kindergarten donations must be implemented in accordance with relevant state laws and regulations.
Article 40 Kindergartens shall establish a contact system with parents, set up a parents' committee, and guide parents to raise children scientifically by setting up parents' schools, holding parents' meetings and holding parents' open days.
Provincial and municipal demonstration kindergartens should actively explore and create conditions, and gradually carry out community-based early education guidance and services for 0-3-year-old infants and young children.
Chapter IV Safety and Health
Forty-first governments at all levels and their education, public security, justice, housing and urban construction, transportation, culture, health, industry and commerce, quality supervision, press and publication departments. Forty-fourth kindergartens should be equipped with full-time security personnel and necessary equipment in accordance with the relevant provisions, set up video surveillance and alarm facilities in key parts and connect with the public security department.
Article 45 Kindergartens shall regularly inspect and maintain the gardens and facilities, organize special personnel to conduct daily inspections and records, strengthen the management of fire sources and power sources, eliminate potential safety hazards in time, and ensure the safety of young children.
Forty-sixth no unit or individual may occupy or destroy buildings and facilities that are dangerous, polluting or affect the lighting of kindergartens, and may not interfere with the normal working order of kindergartens.
Forty-seventh kindergartens should establish and improve various health care systems and vaccination certificate inspection systems.
Forty-eighth kindergartens should establish a plan to prevent food poisoning and epidemic of infectious diseases and strictly implement it, and assist local disease control institutions to carry out vaccination work for school-age children.
When food poisoning and infectious diseases occur in kindergartens, the units, organizations or individuals that organize kindergartens shall immediately take emergency rescue measures, report to relevant departments in a timely manner within the prescribed time limit, and do a good job in the aftermath in accordance with relevant regulations.
Forty-ninth kindergarten canteens should strictly implement the food hygiene and safety system, and all kinds of licenses must be complete.
Children's tableware and drinking utensils should be used by special personnel and disinfected regularly to prevent cross-infection.
Fiftieth kindergartens should establish a system of child handover between guardians and teachers. Kindergartens equipped with school buses shall abide by the Regulations on School Bus Safety Management (the State Council Decree No.617), use special school buses for children designed and manufactured according to the national standards for special school buses, and strictly abide by the regulations on school bus safety management.
Chapter V Reward and Punishment
Fifty-first to seriously implement these measures and meet one of the following conditions, the government or the education department shall commend and reward:

(B) Improving the conditions for running kindergartens has achieved remarkable results.

In violation of other provisions of these measures, units and individuals under any of the following circumstances, depending on the seriousness of the case, shall be ordered by the government and its education department or relevant departments to make rectification, stop running the park and revoke the license for running the park according to the management authority, or the education department shall suggest the relevant departments to give administrative sanctions to the directly responsible personnel.
