Provisions on employing foreign cultural and educational experts and foreign teachers in institutions of higher learning

In order to ensure that colleges and universities employ foreign teachers (hereinafter referred to as experts and foreign teachers) to better serve socialist higher education, these Provisions are formulated in accordance with the Trial Regulations of the State Council on the Work of Foreign Cultural and Educational Experts (Guo Fa [1980] No.270):
Chapter I General Provisions
Article 1 The employment of experts and foreign teachers in institutions of higher learning is an integral part of China's opening-up policy and an important way to learn advanced foreign science and technology and progressive culture. This is a long-term work, and we must do it well.
Article 2 Hiring experts and foreign teachers should serve to strengthen the teaching staff and discipline construction, which is conducive to improving the scientific research level of the school and cultivating talents for socialist modernization.
Article 3 When hiring experts and foreign teachers, the principles of focusing on me, hiring according to needs, selecting the best, ensuring quality, acting according to one's abilities and stressing practical results shall be implemented. Planning should be strengthened at work to prevent blind employment. Domestic teachers can undertake teaching and scientific research tasks, and generally do not hire experts and foreign teachers.
Article 4 Colleges and universities should give full play to the role of experts and foreign teachers according to their professional expertise and considering that their political backgrounds and attitudes are very different from mine. They should also take the initiative to do more work to help them have a correct understanding of China and enhance their understanding and friendship.
Chapter II Employment of Professional Experts and Foreign Teachers
Article 5 Hiring experts from different disciplines and foreign teachers should follow different principles.
Article 6 Experts in science, engineering, agriculture and medicine and foreign teachers come to China for short-term lectures and scientific research cooperation. The employment ratio of such experts should be gradually expanded.
Article 7 Experts and foreign teachers of language majors (including short-term foreign language courses) should be mainly used for teacher training and textbook compilation, in addition to language practice courses (including listening, speaking, reading and writing) that can be taught to students. In principle, experts and foreign teachers will not be hired to undertake the task of language training for relevant personnel abroad except for the training department for overseas personnel established by the state.
Article 8 Experts and foreign teachers in foreign literature, international news, international culture, international trade, international law, international politics, economy and international relations should take young and middle-aged teachers and graduate students as the main teaching targets or hold seminars. Colleges and universities should arrange teachers to make scientific analysis of the contents taught by experts and foreign teachers under the guidance of Marxism, and strengthen the guidance of teaching teachers. Such professional experts generally don't give lectures to undergraduates.
Article 9 Experts in philosophy, sociology, law, politics, journalism, history, education and other disciplines should arrange teachers in our college to discuss relevant academic issues together under the guidance of Marxism, and generally give lectures to graduate students and undergraduates in an unsystematic manner.
Tenth departments and units that have signed agreements with foreign governments, relevant organizations, non-governmental organizations and institutions of higher learning shall implement their teaching tasks in accordance with the above principles.
Chapter III Requirements for Experts and Foreign Teachers in China
Article 11 The personnel to be hired should be friendly to China, willing to cooperate with me, with high professional level and good health.
Twelfth experts should have more than 3 to 5 years of teaching and research experience; Among them, long-term cultural and educational experts should have master's degree or above or lecturer's title and equivalent education, and short-term invited experts should have doctoral or associate professor's title and have certain attainments in this academic field.
Thirteenth foreign teachers of lingua franca should have a bachelor's degree or above, have received special language teaching training and have certain language teaching experience.
Chapter IV Conditions for Hiring Experts and Foreign Teachers' Colleges
Article 14 The leaders of the college have special personnel to be responsible for experts and foreign teachers.
Fifteenth there are functional institutions responsible for the work of experts and foreign teachers, and full-time staff who have been trained in politics and foreign affairs.
Article 16 A relatively complete management system and measures for experts and foreign teachers have been formulated.
Seventeenth to provide experts and foreign teachers with necessary living and working facilities (including accommodation, health, work, safety and other conditions). The location of colleges and universities should be open to foreigners, and non-open areas should be approved by relevant departments before employment.
Chapter V Examination and Approval Principles for Hiring Experts and Foreign Teachers
Eighteenth experts and foreign teachers, according to the institutional affiliation, approved by the relevant departments (commissions) of the State Council or the education administrative departments of provinces, autonomous regions and municipalities directly under the central government.
Nineteenth schools that employ experts and foreign teachers for the first time should apply to the higher authorities according to their affiliation. The Ministry (Committee) is a university, and the Ministry (Committee) shall, in conjunction with the education administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and the Foreign Affairs Office, conduct on-the-spot evaluation in accordance with the provisions of Chapter IV; The education administrative departments of local institutions of higher learning, local institutions of higher learning, provinces, autonomous regions and municipalities directly under the Central Government shall, jointly with the foreign affairs offices of provinces, autonomous regions and municipalities directly under the Central Government, conduct on-the-spot evaluation in accordance with the provisions of Chapter IV, confirm their employment qualifications through evaluation, and report to the State Administration of Foreign Experts Affairs for approval by the higher authorities of institutions of higher learning, before institutions of higher learning can prepare plans for hiring experts and handle employment procedures.
Article 20 Colleges and universities that employ experts and foreign teachers shall report to the higher authorities at the beginning of September each year their plans for hiring experts and foreign teachers for the next academic year, explaining the purpose of hiring experts and foreign teachers from various professions, the nature of their work in China, the number of people coming to China, and the duration of their work in China. The competent department should carefully examine the academic year employment plan of colleges and universities, put forward examination opinions and report them to the State Administration of Foreign Experts Affairs.
Twenty-first institutions of higher learning should carefully examine the conditions of experts and foreign teachers to be hired, and report the employment report and relevant materials to the higher authorities for examination and approval according to the affiliation of institutions of higher learning.
Chapter VI Management of Experts and Foreign Teachers
Article 22 The relevant ministries and commissions of the State Council and the education administrative departments of provinces, autonomous regions and municipalities directly under the Central Government should strengthen their leadership over the work of foreign teachers in their own colleges, carefully study the characteristics of the work of experts and foreign teachers, strengthen planning, and conduct professional guidance and benefit evaluation.
The daily management of college experts and foreign teachers in Beijing is the responsibility of the State Council ministries and commissions and Beijing Higher Education Bureau respectively. The daily management of college experts and foreign teachers in other regions shall be the responsibility of the education administrative departments of the provinces, autonomous regions and municipalities directly under the Central Government where the colleges and universities are located, and closely cooperate with the local foreign affairs office; Major issues should be reported to the superior in time, and copied to the State Education Commission and the State Administration of Foreign Experts Affairs.
Twenty-third education administrative departments and institutions of higher learning should strengthen close cooperation with local foreign affairs offices, public security and other relevant departments in the management of experts and foreign teachers.
Article 24 Institutions of higher learning shall implement the centralized management system of the foreign affairs department of the school under the leadership of the head of the school (college) in charge of the management of experts and foreign teachers.
Twenty-fifth experts and foreign teachers who come to our college to teach for more than one semester (including one semester) must sign a contract with the college. The basic contents of the contract should include: the start and end date of the employee's employment, the number of teaching hours per week, and the various benefits he should enjoy; It should be clearly stipulated in the contract that experts and foreign teachers should abide by the laws and regulations of China and the rules and regulations of the school, and should not interfere in China's internal affairs and carry out missionary activities, and should be responsible for the employee's demands and breach of contract during his stay in China. Schools should be managed in strict accordance with the contract.
Article 26 The leaders and functional departments in charge of the work of experts and foreign teachers in institutions of higher learning should introduce the situation in China and China's educational principles, policies, laws, decrees and relevant regulations to help them understand China, and ask them to abide by the laws, regulations and school rules of China and respect the customs and habits of China people.
The propaganda work for experts and foreign teachers aims at strengthening mutual understanding and friendship, and the working methods should be flexible.
Twenty-seventh experts or foreign teachers who intend to make political attacks on me or raise provocative political issues should actively explain my views and refute them, report them to their superiors in time and deal with them according to the situation.
Article 28 The educational administration departments of institutions of higher learning are responsible for the teaching of experts and foreign teachers.
Twenty-ninth experts and foreign teachers belong to the department, department, responsible for the daily management of their teaching business:
(1) Provide a Chinese teacher with strong political and professional skills as an expert foreign teacher, assist the expert foreign teacher to carry out teaching, and assist the school to do a good job of expert foreign teacher;
(two) to review the teaching plans and teaching materials of experts and foreign teachers (including reference materials, movies and other materials); When using the original textbooks, the ideological and political content should be strictly examined and approved to avoid textbooks that beautify the capitalist system, promote democratic socialism and uglify socialism;
(3) Establish a system for experts and foreign teachers to attend classes, regularly check their teaching attitudes and effects, and conduct teaching evaluation according to the relevant provisions of the State Administration of Foreign Experts Affairs to improve the employment efficiency.
Article 30 Leaders at all levels in institutions of higher learning should take the initiative to do well the work of experts and foreign teachers, encourage relevant teachers and students to have more contact with them, make friends, take the initiative to care for and solve the problems encountered by experts and foreign teachers in teaching and life, and require teachers and students in China to get along well with experts and foreign teachers, respect each other, learn from each other's strong points, strengthen cooperation and jointly do a good job in teaching and scientific research. Opinions on the teaching of experts and foreign teachers should be discussed and solved by departments, teaching and research sections or cooperative teachers.
Thirty-first experts and foreign teachers can use our library to consult books and materials within the designated scope. Colleges and universities can unconditionally accept books donated by experts and foreign teachers, refuse to accept books that attack our government or maliciously slander our socialist system, and report to their superiors in time. Colleges and universities should seriously strengthen the management of books donated by experts and foreign teachers.
Thirty-second experts and foreign teachers should cooperate with me in scientific research around my key scientific research projects. In cooperative scientific research, it is necessary to strengthen confidentiality, strengthen the use and management of relevant scientific research materials and computers, and prevent leaks.
Thirty-third experts and foreign teachers who have made outstanding achievements in China should be rewarded; For foreign teachers who fail to perform the contract, have poor teaching effect and bad attitude, the school should criticize and educate them in time; Those who insist on not changing can be dismissed according to the contract. The dismissal of experts and foreign teachers shall be reported by the school to the higher authorities for approval, and copied to the State Administration of Foreign Experts Affairs, which shall notify all relevant units regularly and shall not be employed again.
Article 34 Institutions of higher learning should respect the customs and religious beliefs of experts and foreign teachers. Experts and foreign teachers are not allowed to spread statements attacking our government, policies and decrees anywhere and in any way, and interfere in our internal affairs; Do not carry out any form of missionary activities or religious propaganda, and do not distribute religious books or materials among my students in the name of teaching; Those who violate the above provisions shall be dealt with according to the contract and relevant laws and regulations of our country.
Article 35 Experts and foreign teachers shall not engage in social work unrelated to teaching. Such as interviews, business, consulting services and other activities that are inconsistent with their identity.
Article 36 During their employment, experts and foreign teachers are not allowed to make any investigation involving their own political thoughts, social conditions, economic or technical secrets, special biological resources or violations of regulations to the society and students in any form. With special needs, it can be carried out only after approval. Within the scope of provinces, autonomous regions and municipalities directly under the central government, the education administrative departments of provinces, autonomous regions and municipalities directly under the central government shall, jointly with the foreign affairs offices of provinces, autonomous regions and municipalities directly under the central government and relevant departments, examine and approve; Beyond the provinces, autonomous regions and municipalities directly under the central government, it shall be reported to the State Education Commission and the State Administration of Foreign Experts Affairs for examination and approval, and copied to the relevant departments.
Thirty-seventh except institutions of higher learning, other schools at all levels generally do not employ foreign teachers to teach in this school, and special needs shall be handled in accordance with the above provisions.
