The term "continuing education" as mentioned in these Provisions refers to the education that professional and technical posts need to carry out, so that professional and technical personnel can often acquire knowledge and skills to supplement, update, improve and perfect. Article 3 These Provisions shall apply to the continuing education of professional and technical personnel within the administrative area of this province. Where laws and regulations provide otherwise, such provisions shall prevail. Article 4 Continuing education should persist in serving scientific and technological progress and social and economic development, and pay attention to pertinence, practicality and advancement. Article 5 The people's governments at or above the county level shall strengthen their leadership over continuing education, incorporate continuing education into local social and economic development plans, and support the continuing education of key industries, important fields, poverty-stricken areas and laid-off professional and technical personnel. Article 6 The personnel administrative department of the people's government at or above the county level shall be in charge of continuing education within its administrative area, and shall be responsible for the planning, guidance, coordination and supervision of continuing education.
The education administrative department of the people's government at or above the county level shall, in accordance with its overall management and education responsibilities, cooperate with the personnel administrative department at the same level to do a good job in continuing education.
Under the guidance of continuing education planning, industry management departments or industry associations are responsible for the formulation, implementation and related management of continuing education planning in their respective industries. Seventh professional and technical personnel have the right to receive continuing education.
Professional and technical personnel are required to take part in continuing education full-time, and the tuition fees are borne by the unit where they work, and they enjoy the same salary, welfare and insurance benefits as when they are on the job.
Professional and technical personnel have the right to complain to their superior competent department or the personnel administrative department of their unit when their right to continuing education is violated. The relevant unit or department shall, within 30 days from the date of receiving the complaint, make a decision on handling it and give a written reply to the complainant. Eighth professional and technical personnel have the obligation to receive continuing education.
Professional and technical personnel shall abide by the provisions of laws, regulations and rules on continuing education and complete the task of continuing education and learning according to the plan of the unit where they work. Article 9 Enterprises and institutions, private non-enterprise units, intermediaries and social organizations shall perform the following duties:
(a) to implement the provisions of continuing education laws and regulations, formulate continuing education plans and management measures, and organize their implementation;
(two) to ensure that professional and technical personnel to participate in continuing education and learning time;
(three) to ensure that professional and technical personnel enjoy the same wages, benefits and insurance benefits as when they are on the job during their full-time participation in continuing education and study, and pay tuition fees;
(four) according to the provisions of the registration and assessment of professional and technical personnel to receive continuing education, statistics and report relevant information.
Enterprises, institutions, private non-enterprise units, intermediaries and social organizations shall accept the guidance and supervision of the superior competent department and the personnel administrative department when performing the duties specified in the preceding paragraph. Article 10 Enterprises, institutions, private non-enterprise units, intermediaries and social organizations may, according to the actual needs of their own units, increase the time for arranging professional and technical personnel to receive continuing education, independently determine the content and form of continuing education, and conclude contracts on matters such as the conditions for units to provide continuing education for individuals and the services provided by individuals for units.
Encourage professional and technical personnel to participate in continuing education in their spare time after completing the learning tasks arranged by the continuing education plan of their own units. Eleventh continuing education subject guide by the provincial industry management department or industry association according to the province's continuing education planning and industry actual preparation or revision, and accept the guidance of the personnel administrative department of the provincial people's government.
The subject guide of continuing education should adapt to the development trend of different disciplines, majors and industries, pay attention to learning new knowledge, theories, technologies and methods of modern science and technology, and meet the requirements of comprehensively improving the quality of professional and technical personnel. Twelfth continuing education can be carried out through training courses, advanced courses, academic lectures, academic conferences, correspondence, audio-visual education, distance education and study abroad. Thirteenth professional and technical personnel to receive continuing education every year for a total of not less than 12 days.
The full-time study time of continuing education is a cycle every three to five years, and the study time in a cycle can be used centrally or dispersed.
Professional and technical personnel may be exempted from continuing education arranged by the unit during the period of receiving academic education related to their majors. Fourteenth enterprises, institutions, private non-enterprise units, intermediaries and social organizations should make use of the existing conditions and facilities for running colleges, vocational colleges and research institutes to implement continuing education. Institutions of higher learning, vocational schools and scientific research institutes should actively carry out continuing education for the society. Fifteenth encourage organizations and individuals to set up continuing education and training institutions according to law.
The establishment of continuing education and training institutions shall meet the following conditions:
(1) Having an organizational structure and management system;
(two) there are full-time (part-time) teachers and managers who are suitable for the continuing education tasks undertaken;
(3) Having places, facilities and equipment suitable for the training;
(four) other conditions stipulated by the state and the province.
The specific procedures for the establishment, alteration and termination of continuing education and training institutions shall be implemented in accordance with relevant laws, regulations and rules.
