Interim Measures for the Implementation of Charge Management of Compulsory Education Schools in Yunnan Province
Article 1 In order to strengthen the charge management of compulsory education schools, standardize the charge behavior of schools, and protect the legitimate rights and interests of educated people, according to the provisions of Article 29 of the Education Law of the People's Republic of China and the relevant provisions of the state on the administration of administrative fees, the Interim Measures for the Administration of Compulsory Education Schools issued by the State Education Commission, and the Regulations on the Administration of Administrative Fees issued by the State Planning Commission, the Ministry of Finance and the Provincial People's Congress, combined with the actual situation of our province. Article 2 These Interim Measures are applicable to primary schools, junior middle schools (including complete junior middle schools), junior vocational middle schools and special education schools in compulsory education in Yunnan Province.

Junior high schools and primary schools organized by social organizations and individual citizens or other forms of private junior high schools and primary schools are not applicable. Article 3 Students receiving compulsory education are free of tuition fees and only pay miscellaneous fees. Article 4 Miscellaneous expenses shall be determined according to a certain proportion of public funds that students must spend during their study in school. Schools in different regions can charge different fees, with less fees and an upper limit. Article 5 The proportion and standard of miscellaneous fees in the annual average cost of education and training shall, in principle, be jointly stipulated by the Provincial Department of Education, the price department and the financial department according to the economic development and the affordability of the masses. The examination and approval authority of sixth miscellaneous fees standards is in the provincial education, price and finance departments. Opinions put forward by the Provincial Department of Education, the price department in conjunction with the financial department according to the economic development level of the province, school conditions and residents' economic affordability audit, determine the charging standards, implemented by the education department. Article 7 The adjustment of the standard of miscellaneous fees in the compulsory education stage shall be made by the provincial education, price and finance departments in accordance with the procedures stipulated in Article 6, and according to the price increase level and the average income growth level of residents in the province. In view of the current unbalanced economic development in various parts of the province, the formulation and adjustment of charging standards in our province only stipulate the highest charging standard and range, and the education departments of various places (prefectures and cities) put forward their opinions on the premise of not exceeding the prescribed range. The price department shall, jointly with the financial department, formulate specific charging standards according to the local economic development level, price increase level, school conditions and residents' economic affordability, and report them to the provincial education, price and financial departments for the record.

In principle, primary schools and junior high schools are enrolled in the nearest household registration. Scholars who don't follow the rules of enrollment scribing shall be treated as loan students. However, due to the separation of people and households caused by the transformation and relocation of the old city, after the parents apply and the admissions department verifies, the students who enter the school nearby are not regarded as borrowing students. All kinds of schools at all levels must strictly implement the enrollment plan, strictly control the class size (the total number of students in each class shall not exceed 55), stabilize the school scale, and ensure the completion of the mandatory enrollment plan. Schools that do not have the necessary conditions for running schools may not enroll students. The examination and approval and adjustment authority of the borrowing cost standard is in the provincial education, price and finance departments. Eighth students with financial difficulties should be exempted from collecting miscellaneous fees as appropriate, and the measures for reduction and exemption shall be formulated separately. Schools should adopt various ways, such as grants and subsidies for difficulties, to help students from poor families solve their difficulties in study and life and ensure that they will not interrupt their studies for economic reasons. Ninth miscellaneous fees, borrowing fees according to the school year (period), not across the school year (period) in advance. Tenth miscellaneous fees and tuition fees shall be uniformly collected and managed by the financial department of the school and accounted for separately as special funds. Apply to the designated price department for a license to charge, and use the special bill for administrative fees printed by the financial department. Eleventh miscellaneous fees and borrowing fees are one of the necessary sources of school funds. In accordance with the "Regulations on the Management of Extrabudgetary Funds in Yunnan Province" and other relevant provisions, it is managed and incorporated into the unified financial accounting of the unit. All of them are used to improve school conditions and supplement the shortage of public funds in schools, and shall not be used for teachers' salaries, welfare, infrastructure and other expenses. No department, unit or individual may intercept, occupy or misappropriate it.

The income and expenditure of miscellaneous fees and borrowing fees should be reported to the education, finance and price departments step by step, and accepted by the society and the masses. Twelfth compulsory education stage in addition to fees and tuition fees, without the approval of the Ministry of Finance, the State Planning Commission, the State Education Commission or the provincial people's government, shall not charge any fees to students. Students have the right to refuse to pay more than the prescribed amount. Article 13 The people's governments of all localities (prefectures and cities) must attach great importance to and strengthen the unified leadership and centralized management of school fees in the compulsory education stage, and the education, price and financial departments at all levels should conscientiously organize the implementation of these Interim Measures, publicize the charging items and standards, accept supervision by the masses, and resolutely stop arbitrary charges. Fourteenth education fees management by the education, price and finance departments at all levels jointly responsible. Education, price and finance departments at all levels should strengthen the management and supervision of fees charged by compulsory education schools, urge schools to strictly implement national policies and regulations on the management of education fees, establish and improve rules and regulations on the management of fees, and severely investigate and deal with acts of adding fees without authorization, expanding the scope of fees, raising fees standards and misappropriating tuition fees in accordance with relevant state regulations; In case of repeated prohibitions, repeated investigations and repeated offenses, if the circumstances are serious, the person in charge of the school shall be given administrative sanctions in accordance with the relevant provisions of the state, and those who violate the criminal law shall be severely punished according to law.
