Most countries in the world give local governments (provinces, prefectures and counties) certain legislative power, and a considerable part of them are normative documents on education, which are only valid within their administrative areas. These educational normative documents formulated by local legislatures are what we call local educational laws and regulations. In China, according to Article 100 of the Constitution and Article 7 of the Organic Law of Local People's Congresses and Local People's Governments at Various Levels in People's Republic of China (PRC), the people's congresses and their standing committees of provinces, autonomous regions and municipalities directly under the Central Government may, according to the specific conditions and actual needs of their respective administrative regions, formulate and promulgate local regulations and report them to the NPC Standing Committee for the record. Local regulations are generally called "regulations", and sometimes they are called "regulations", "implementation measures" and "supplementary provisions" to distinguish different situations. According to the statistics of 1999, there are 138 local education laws and regulations promulgated in various places, which is an important source of China's education law. Judging from its legislative purpose and legislative basis, it can be divided into two types. (1) Implement and supplement local education laws and regulations. To directly implement the Constitution, educational laws and administrative regulations, or to supplement educational laws and administrative regulations. For example, in order to implement the Compulsory Education Law of People's Republic of China (PRC), most provinces, autonomous regions and municipalities directly under the Central Government have formulated local regulations on compulsory education, which are executive and supplementary local education regulations. (2) To formulate educational laws and regulations in autonomous areas and perform the functions and powers entrusted by the Constitution or laws. For example, in order to standardize and develop vocational education, nearly half of the provinces and municipalities directly under the Central Government, such as Hebei, Guizhou, Jiangsu, Beijing, etc., have formulated the Vocational Education Regulations before the country has formulated a vocational education law; Another example is the Regulations on the Management and Protection of Campus and School Buildings formulated by the Standing Committee of Jilin Provincial People's Congress in accordance with the principles of relevant laws and administrative regulations; The employee education regulations formulated by the Standing Committee of Tianjin Municipal People's Congress are all autonomous local education regulations. Compared with educational laws and administrative regulations, local educational regulations have three characteristics: first, local educational regulations must not contradict the Constitution, laws and administrative regulations and have subordinate status; Second, local education laws and regulations are only effective in their own administrative areas and are regional; Third, local education laws and regulations are formulated according to local specific conditions and actual needs, and are more specific and operational in adjusting objects, rights and obligations, and penalties. Finally, it is necessary to mention that according to the provisions of the Organic Law, the people's congresses of the cities where the people's governments of provinces and autonomous regions are located or the larger cities approved by the State Council can also formulate local regulations with the approval of the standing committees of the people's congresses of provinces and autonomous regions, according to the specific conditions and actual needs of this city and in the case that different constitutions, laws, administrative regulations and local regulations of this province and autonomous region are in conflict. It is usually regarded as the next-level local education regulations formulated by the people's congresses of this province or autonomous region or their standing committees.
