Article 1 In order to implement the strategy of rejuvenating the country through science and education, develop vocational education, improve the quality of workers and promote socialist modernization, this Law is formulated in accordance with the Education Law and the Labor Law.
Article 2 This Law is applicable to all levels and types of vocational school education and various forms of vocational training. The special training for the staff of state organs carried out by state organs shall be stipulated separately by laws and administrative regulations.
Article 3 Vocational education is an important part of national education and an important way to promote economic and social development and employment.
The state develops vocational education, promotes vocational education reform, improves the quality of vocational education, and establishes and perfects a vocational education system that meets the needs of socialist market economy and social progress.
Article 4 To implement vocational education, we must implement the national education policy, educate the educated in ideological and political education and professional ethics, impart vocational knowledge, cultivate vocational skills, provide vocational guidance, and comprehensively improve the quality of the educated.
Article 5 Citizens have the right to receive vocational education according to law.
Article 6 People's governments at all levels shall incorporate the development of vocational education into their national economic and social development plans.
Industry organizations, enterprises and institutions shall fulfill their obligations to implement vocational education according to law.
Article 7 The State shall take measures to develop vocational education in rural areas and support the development of vocational education in ethnic minority areas and remote and poor areas.
The state takes measures to help women receive vocational education, organizes unemployed people to receive various forms of vocational education, and supports the development of vocational education for the disabled.
Article 8 Vocational education shall be carried out according to the actual needs, in accordance with the occupational classification and occupational grade standards formulated by the state, and the system of academic qualifications, training certificates and vocational qualification certificates shall be implemented.
The state practices a system in which laborers receive necessary vocational education before taking up employment or taking up their posts.
Article 9 The State encourages and organizes scientific research in vocational education.
Article 10 The State shall reward units and individuals that have made remarkable achievements in vocational education.
Eleventh the State Council education administrative department is responsible for the overall planning, comprehensive coordination and macro management of vocational education.
The education administrative department, labor administrative department and other relevant departments of the State Council shall be responsible for the relevant vocational education within the scope of duties stipulated by the State Council.
The local people's governments at or above the county level shall strengthen the leadership, overall coordination, supervision and evaluation of vocational education within their respective administrative areas.
Chapter II Vocational Education System
Article 12 The state shall, according to the level of economic development and the degree of education popularization in different regions, implement education diversion at different stages, focusing on junior high schools, and establish and improve a vocational education system that combines vocational school education with vocational training, links with other education and develops in a coordinated way.
Thirteenth vocational school education is divided into primary, secondary and higher vocational school education.
Primary and secondary vocational school education is implemented by primary and secondary vocational schools respectively; Higher vocational school education is implemented by higher vocational schools or ordinary colleges and universities according to needs and conditions. Other schools can implement vocational school education at the same level according to the overall planning of the education administrative department.
Article 14 Vocational training includes pre-job training, post-transfer training, apprenticeship training, on-the-job training, post-transfer training and other vocational training, which can be divided into primary, intermediate and advanced vocational training according to the actual situation.
Vocational training is implemented by corresponding vocational training institutions and vocational schools respectively.
Other schools or educational institutions can carry out various forms of vocational training for the society according to their school-running ability.
Fifteenth vocational education for the disabled shall be implemented by educational institutions for the disabled, and vocational schools, vocational training institutions and other educational institutions at all levels shall accept disabled students in accordance with the relevant provisions of the state.
Sixteenth ordinary middle schools can set up vocational education courses according to local conditions, or appropriately increase the teaching content of vocational education according to actual needs.
Chapter III Implementation of Vocational Education
Article 17 Local people's governments at or above the county level shall establish vocational schools and vocational training institutions with backbone and demonstration functions, and give guidance and support to vocational schools and vocational training institutions organized by rural areas, enterprises, institutions, social organizations, other social organizations and individual citizens according to law.
Eighteenth people's governments at the county level should adapt to the needs of the overall development of rural economy, science and technology and education, organize various forms of vocational education, carry out practical technical training, and promote the development of rural vocational education.
Nineteenth government departments and industry organizations should establish or jointly establish vocational schools and vocational training institutions, and organize, coordinate and guide enterprises and institutions in the industry to establish vocational schools and vocational training institutions.
The state encourages the use of modern teaching methods to develop vocational education.
Article 20 An enterprise shall, according to the actual situation of its own unit, carry out vocational education for its employees and persons to be hired in a planned way.
Enterprises can independently or jointly set up vocational schools and vocational training institutions, or they can entrust schools and vocational training institutions to provide vocational education for their employees and persons to be hired.
Employees engaged in technical jobs must be trained before taking up their posts; Employees engaged in special operations must be trained and qualified for special operations.
Article 21 The State encourages institutions, social organizations, other social organizations and individual citizens to establish vocational schools and vocational training institutions in accordance with the relevant provisions of the State.
Measures for overseas organizations and individuals to establish vocational schools and vocational training institutions in China shall be formulated by the State Council.
Twenty-second joint vocational schools and vocational training institutions, the organizers shall sign a joint school contract.
Where government departments, industry organizations, enterprises and institutions entrust schools and vocational training institutions to implement vocational education, they shall sign entrustment contracts.
Article 23 Vocational schools and vocational training institutions should combine production with education, serve local economic construction, keep close contact with enterprises and cultivate practical talents and skilled workers.
Vocational schools and vocational training institutions may hold enterprises or practice places related to vocational education.
Article 24 The establishment of a vocational school must meet the following basic conditions:
(1) Having an organizational structure and articles of association;
(2) Having qualified teachers;
(three) there are teaching places that meet the prescribed standards, and there are facilities and equipment that are suitable for vocational education;
(four) there are necessary funds for running schools and stable sources of funds.
The establishment of vocational training institutions must meet the following basic conditions:
(1) Having an organizational structure and management system;
(2) Having teachers and managers suitable for the training tasks;
(3) Having places, facilities and equipment suitable for the training;
(4) Having corresponding funds.
The establishment, alteration and termination of vocational schools and vocational training institutions shall be carried out in accordance with relevant state regulations.
Twenty-fifth students who receive vocational school education shall be awarded academic certificates in accordance with the relevant provisions of the state after passing the school examination. Students who have received vocational training and passed the examination in vocational schools or vocational training institutions shall be issued with training certificates in accordance with relevant state regulations.
Academic certificates and training certificates shall be used as certificates for graduation and completion of vocational schools and vocational training institutions in accordance with relevant state regulations.
Chapter IV Guarantee Conditions for Vocational Education
Article 26 The State encourages raising funds for the development of vocational education according to law through various channels.
Article 27 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall set the average funding standards for the number of students in vocational schools in their respective regions; The relevant departments of the State Council shall, jointly with the finance department of the State Council, formulate the per capita funding standard for vocational schools in this department. The sponsors of vocational schools shall fully allocate the funds for vocational education according to the average funding standard of the number of students.
The financial funds used by the people's governments at all levels and the relevant departments of the State Council for holding vocational schools and vocational training institutions should be gradually increased.
No organization or individual may misappropriate or embezzle funds for vocational education.
Article 28 An enterprise shall bear the vocational education expenses of its employees and persons to be hired. Specific measures shall be formulated by the relevant departments of the State Council in conjunction with the financial department of the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the Central Government according to law.
Article 29 Where an enterprise fails to implement vocational education in accordance with the provisions of Article 20 of this Law, the local people's government at or above the county level shall order it to make corrections; Those who refuse to make corrections may collect the vocational education funds that enterprises should bear and use them for local vocational education.
Article 30 Local education surcharges decided by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in accordance with the relevant provisions of the Education Law may be used exclusively or in a certain proportion for vocational education.
Thirty-first people's governments at all levels can properly use the funds for rural science and technology development and technology popularization for rural vocational training.
Article 32 Vocational schools and vocational training institutions may appropriately charge tuition fees for students who receive education and vocational training in secondary and higher vocational schools, and reduce or exempt tuition fees for students with financial difficulties and disabled students as appropriate. Measures for charging fees shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
The state supports enterprises, institutions, social organizations, other social organizations and individual citizens to set up vocational education scholarships and loan scholarships in accordance with the relevant provisions of the state to reward students with excellent academic performance or to subsidize students with financial difficulties.
Article 33 Vocational schools and vocational training institutions should set up enterprises and engage in social services mainly for the development of vocational education.
Article 34 The State encourages financial institutions to use credit to support the development of vocational education.
Article 35 The State encourages enterprises, institutions, social organizations, other social organizations and individual citizens to donate to vocational education, and encourages overseas organizations and individuals to provide financial assistance and donations to vocational education. The grants and donations provided must be used for vocational education.
Thirty-sixth people's governments at or above the county level and relevant departments shall incorporate the training and training of vocational education teachers into the construction plan of teachers' team, so as to ensure that the vocational education teachers' team can meet the needs of vocational education development.
Vocational schools and vocational training institutions may employ professional and technical personnel, personnel with special skills and teachers from other educational institutions as part-time teachers. The relevant departments and units shall provide convenience.
Thirty-seventh relevant departments of the State Council, local people's governments at or above the county level, organizations that hold vocational schools and vocational training institutions, and individual citizens should strengthen the construction of vocational education production practice bases.
Enterprises and institutions shall accept internships and teacher internships in vocational schools and vocational training institutions; Those who practice in the post shall be given appropriate labor remuneration.
Thirty-eighth people's governments at or above the county level and relevant departments shall establish and improve the service system of vocational education, and strengthen the editing, publishing and distribution of vocational education teaching materials.
Chapter V Supplementary Provisions
Article 39 Whoever violates the provisions of the Education Law in vocational education activities shall be punished in accordance with the relevant provisions of the Education Law.
