Regulations of Gansu Province on Compulsory Education
Chapter I General Provisions Article 1 In order to guarantee the equal right of school-age children and adolescents to receive compulsory education, promote the balanced development of compulsory education, and ensure the implementation of compulsory education, these Regulations are formulated in accordance with the Compulsory Education Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the implementation and management of compulsory education within the administrative area of this province. Article 3 This province implements a national unified nine-year compulsory education system, and school-age children and adolescents shall receive compulsory education.

Compulsory education is a public welfare undertaking guaranteed by people's governments at all levels. Students who receive compulsory education do not charge tuition and miscellaneous fees, and provide textbooks free of charge. Article 4 Compulsory education must implement the national education policy, implement quality education, improve the quality of education, enable school-age children and adolescents to develop morally, intellectually, physically, aesthetically and psychologically in an all-round way, and lay a foundation for cultivating socialist builders and successors with ideals, morality, culture and discipline. Article 5 The compulsory education in this province shall be under the system of overall planning by the provincial people's government, coordination and guidance by the city (state) people's government, management by the county (city, district) people's government, and assistance by the township (town) people's government and sub-district offices.

The education administrative departments of the people's governments at or above the county level shall be specifically responsible for the implementation of compulsory education within their respective administrative areas.

The relevant departments and institutions of the people's governments at or above the county level, such as development and reform, finance, human resources and social security, construction, land and resources, public security and establishment, shall do a good job in compulsory education according to their respective responsibilities. Article 6 The people's governments at or above the county level shall incorporate compulsory education into the national economic and social development plan at the corresponding level, rationally allocate educational resources, narrow the gap between urban and rural areas, regions and schools in terms of school conditions and levels, ensure the implementation of compulsory education in rural areas, ethnic minority areas and poverty-stricken areas, and promote the balanced development of compulsory education.

The people's governments at or above the county level shall ensure that disabled school-age children, adolescents, soldiers and migrant workers with financial difficulties receive compulsory education. Seventh people's governments at or above the county level and their relevant departments shall establish a target responsibility system for compulsory education, and take the implementation of compulsory education as an important part of assessing the main leaders and relevant responsible persons.

If a major event occurs in violation of these regulations, which hinders the implementation of compulsory education and causes significant social impact, the people's government or the person in charge of the education administrative department of the people's government who bears the leadership responsibility shall take the blame and resign. Article 8 The educational supervision institutions of the people's governments at or above the county level shall supervise the implementation of compulsory education laws and regulations, the balanced development of compulsory education, the school-running behavior and the quality of education and teaching. Supervise the relevant departments of the people's government at the same level, the people's governments at lower levels and their relevant departments, education and teaching institutions, and regularly publish supervision reports to the public. The results of supervision and evaluation shall serve as an important basis for the relevant departments to evaluate the performance and reward and punishment of the supervised units and their main responsible persons. Ninth people's governments at or above the county level and the relevant departments shall commend and reward the units and individuals that have made outstanding contributions in the implementation of compulsory education. Chapter II Students Article 10 Parents or other legal guardians of all children who have reached the age of six shall send them to school to receive and complete compulsory education; Children in rural mountainous areas or remote areas who do not have the conditions can be postponed to seven years old; Children with disabilities can postpone their enrollment according to the situation. Article 11 School-age children and adolescents are exempted from entrance examination. Schools shall not take or take examinations, assessments, tests and other forms to select students, and shall not take all kinds of competition results and certificates of various grades as the basis for admission conditions and class arrangement. Twelfth people's governments at or above the county level shall take measures to ensure that school-age children and adolescents are enrolled in the nearest place where they are registered. School-age children and adolescents whose parents or other legal guardians work or live in non-registered places shall receive compulsory education where their parents or other legal guardians work or live.

The nearest enrollment scope shall be determined by the education administrative department of the people's government at or above the county level according to the school layout, the number and distribution of school-age children and adolescents within their respective administrative areas, and the relevant national and provincial school-running standards, and shall be announced to the public.

School-age children, street children and orphans among teenagers shall be sent to the nearest school for compulsory education by social assistance institutions before their guardians are found or determined. Article 13 Education administrative departments of counties (cities, districts), people's governments of townships (towns) and subdistrict offices shall organize and urge school-age children and adolescents to enter school, help solve the difficulties of school-age children and adolescents in receiving compulsory education, regularly check the situation of school-age children and adolescents receiving compulsory education, and take measures to prevent school-age children and adolescents from dropping out of school.

Schools should promptly report the dropout of school-age children and adolescents to the township (town) people's government or street offices, and cooperate with the township (town) people's government and street offices to do a good job in the resumption of school for dropouts. Fourteenth students need to transfer due to changes in household registration or other reasons, and they should go through the relevant procedures in time when transferring out or into the school, and may not refuse to transfer, refuse to accept or attach other conditions.

Measures for the administration of student status such as transfer, suspension and resumption of schooling shall be formulated by the provincial education administrative department.
