The Influence of the New Civil Code on Education
As an encyclopedia of social life, the Civil Code is closely related to people's lives. It is not only a declaration of people's rights, but also a dense protective net to safeguard people's rights and interests.

The special protection of education and schools in the Civil Code has continuity with the Law on the Protection of Minors, the Law on Tort Liability and the General Principles of Civil Law. The new provisions in the Civil Code are mainly reflected in the application for revocation of guardianship by the school as a statutory organization, the measures taken by the school to prevent sexual harassment, and the risks and exceptions of cultural and sports activities. The provisions on education in the Civil Code include the following aspects:

The first category belongs to the family's legal education and liability for compensation.

Such provisions in the Civil Code include the obligation of parents and stepparents to raise, educate and protect their minor children. After divorce, husband and wife still have the rights and obligations to support, educate and protect their children, and so on.

The second category stipulates the types of educational facilities and stipulates that educational facilities shall not be mortgaged.

Article 260th of the Civil Code stipulates that the educational facilities involved in collective ownership are collectively owned real estate and movable property. Article 399 stipulates that educational facilities of non-profit legal persons established for public welfare such as schools and kindergartens shall not be mortgaged.

Education authorities and schools at all levels shall abide by the provisions of the Education Law and the Civil Code, enhance the concept that educational facilities shall not be mortgaged, and safeguard the public welfare nature of school educational facilities. Private schools still have the nature of public welfare, and the education authorities should strengthen the communication and contact between the mortgage of facilities, including private schools, and the local real estate center, so as to prevent the school management behavior from improperly affecting normal teaching.
