In order to implement the Opinions of the State Council on Encouraging and Guiding the Healthy Development of Private Investment (Guo Fa [20/KLOC-0]13) and the Outline of the National Medium-and Long-Term Education Reform and Development Plan (20 10-2020), encourage and guide private funds to develop education and social training, and promote the healthy development of private education.

First, give full play to the role of private funds in promoting the development of education.

(1) Private education is an important part of socialist education, an important growth point of educational development and an important force to promote educational reform. We should give full play to the role of private funds, and take encouraging and guiding private funds to enter the field of education and promoting the development of private education as an important responsibility of governments at all levels.

(2) Improve the education investment system which is mainly invested by the government and raises funds through multiple channels. While increasing government investment in education, we should take active and effective measures to encourage and guide private funds to enter the field of education, and form a pattern in which public schools are the main body, the whole society actively participates, and public education and private education develop together.

(3) Improve the policies and systems related to private education, mobilize the enthusiasm of the whole society to participate in education, further stimulate the advantages and vitality of the institutional mechanism of private education, meet the multi-level and diversified educational needs of the people, and explore and improve the institutional mechanism of classified management of private schools.

Second, broaden the channels for private funds to participate in educational development.

(4) Encourage and guide private funds to enter the field of education in various ways. In accordance with the relevant provisions of the state, social forces set up private schools (including other educational institutions, the same below) in various forms, such as independent organizations and cooperative organizations, to broaden the channels for private funds to enter the field of education and participate in educational reform and development.

(five) to encourage and guide private funds to enter the field of preschool education and academic education. Actively support private kindergartens, especially low-cost inclusive kindergartens facing the public, guide private primary and secondary schools to run their own characteristics, encourage the development of private vocational education, and actively support the development of private colleges with characteristics, high level and high quality.

(six) to encourage and guide private funds to participate in training and continuing education. Guided by social needs, we will actively encourage private funds to participate in all kinds of non-academic education and education and training, such as on-the-job vocational training, rural labor transfer training, and job transfer training, so as to promote the construction of a lifelong learning system and a learning society. Improve the overall coordination and supervision mechanism of the government, cultivate and standardize the development environment of non-academic education and education and training, and establish and improve the quality assurance system of training services.

(seven) allow domestic and foreign funds to carry out Chinese-foreign cooperation in running schools according to law. Foreign-invested enterprises carrying out educational activities in China must comply with the provisions of the Catalogue for the Guidance of Foreign-invested Industries (20 1 1 Revision). Foreign parties that allow foreign capital to run schools in cooperation with foreign countries shall participate in cooperative education in accordance with the Regulations on Chinese-foreign Cooperation in Running Schools and its implementation measures. Encourage private capital to cooperate in running schools in China, participate in the introduction of overseas high-quality educational resources, and establish high-level Chinese-foreign cooperatively-run schools according to law. The proportion of overseas funds of Chinese-foreign cooperatively-run schools shall not exceed 50%. Encourage private capital to cooperate with schools in China to run schools abroad, so as to enhance the international competitiveness of education in China.

Third, formulate and improve policies to promote the development of private education.

(8) Improve the licensing system for private schools. Further clean up the educational administrative examination and approval items, improve the examination and approval methods, simplify the examination and approval process, and standardize the examination and approval work of private schools. The establishment of private schools and the implementation of public schools of the same type and level may appropriately relax the examination and approval conditions for kindergartens. Private colleges and universities applying for the right to confer bachelor's, master's and doctoral degrees shall be examined and approved in accordance with the same procedures and requirements as public colleges and universities.

(nine) to clean up and correct all kinds of discriminatory policies against private schools. Clean up the rules, policies and practices that conflict with laws and regulations and are not conducive to the reform and development of private education, and implement the equal legal status of private schools and public schools. On the basis of self-examination and self-correction, education administrative departments at all levels actively coordinate with relevant departments, focusing on cleaning up and correcting policies that are not conducive to the development of private education in education, taxation, finance, land, construction and social security, protecting the legitimate rights and interests of private schools and their related parties, and improving policies to promote the development of private education.

(ten) the implementation of the autonomy of private schools. Private schools independently formulate development plans according to law, set up internal organizations, employ staff, and manage school assets and finances. Private schools that implement higher education and secondary vocational education independently set up and adjust majors, offer courses, choose teaching materials, formulate teaching plans and personnel training programs in accordance with national curriculum standards and relevant regulations. Private schools in the basic education stage can independently carry out education and teaching activities on the premise of completing the courses prescribed by the state; The introduction of overseas courses by private schools needs to be reported to the provincial education administrative department for examination and approval, and overseas textbooks should be examined and approved according to law.

(eleven) the implementation of private school enrollment autonomy. Support private colleges and universities to participate in the pilot reform of college enrollment. To further expand the enrollment autonomy of private undergraduate schools, the provincial education administrative department may allow private undergraduate schools to adjust enrollment batches according to the situation of students. Improve the independent enrollment system of private colleges and higher vocational schools. Conditional regional education administrative departments may allow schools with standardized running and strict management to independently determine the enrollment scope and annual enrollment plan within the approved school scale. Private schools below the intermediate level shall, in accordance with the approved scale of running schools, enroll students independently for the society at the same time as local public schools.

(twelve) the implementation of private school teachers' treatment. Teachers in private schools enjoy the same treatment as teachers in public schools in terms of qualification, professional title evaluation, further training, project declaration, evaluation and international exchange, and enjoy the same talent introduction policy as teachers in similar local public schools in terms of household registration transfer, housing and children's schooling. Private schools shall guarantee teachers' salaries and welfare benefits according to law, handle social insurance and housing accumulation fund for teachers in accordance with relevant regulations, and encourage supplementary insurance for teachers. Support local people's governments to set up special subsidies for teachers' pension insurance in private schools, explore the establishment of an annuity system for teachers in private schools, and improve the retirement benefits of teachers in private schools. Establish and improve the personnel agency service system for teachers in private schools, ensure the reasonable flow of teachers between public schools and private schools, and encourage college graduates and professional and technical personnel to teach in private schools.

(thirteen) to protect the rights and interests of students in private schools. Students in private schools and public schools are equally included in the national student financial aid system, and enjoy the same rights as students in similar public schools at the same level in terms of government funding, awards and evaluations, further studies and employment, and social preferential treatment. Children in private inclusive kindergartens and public kindergartens enjoy the same funding policy.

(fourteen) improve the tax policy of private schools. The prices of electricity, water, gas and heat used by private schools are the same as those of public schools. Private schools that donate money and investors do not require reasonable returns and implement the same tax policies as public schools. The administrative department of education should actively cooperate with and coordinate with relevant departments to formulate preferential tax policies for private schools, business education and training institutions and for-profit private schools. Private schools implement relevant price policies for tuition fees charged by educatees and various items and standards for collecting agency fees.

(fifteen) to support the construction of high-level private schools with characteristics. Support and subsidize private schools to improve their management level, strengthen the construction of teachers, establish a mechanism for private schools and public schools to share high-quality educational resources, deepen education and teaching reform, innovate talent training models, and promote private schools to continuously improve their running level and talent training quality.

Fourth, guide the healthy development of private education.

(sixteen) improve the internal governance structure of private schools. Standardize the composition of the board of directors (councils) of private schools, limit the proportion of representatives of school sponsors, and implement the system of avoiding relatives for school principals and key management positions. Improve the rules of procedure and operating procedures of the board of directors. When the board of directors holds a meeting to discuss major issues of the school, it shall keep minutes of the meeting and ask all directors to sign it and file it for future reference. Improve the selection and training mechanism of principals and leading bodies, implement the tenure system of principals, and ensure that principals and school management institutions exercise education and teaching rights and administrative management rights according to law. It is necessary to strengthen the party building work in private schools, realize the full coverage of party organizations in private schools, give full play to the political core role of party organizations in private schools, improve the supervision Commissioner system in private schools, and establish the staff congress system in private schools. Private colleges and universities should be equipped with a sufficient number of counselors and class teachers according to relevant regulations and actual work needs. Establish and improve the campus safety management and security system, equip with security forces, improve the public security prevention and control system, and maintain campus safety and stability.

(seventeen) improve the assets and financial management system of private schools. The property rights of a school legal person shall be implemented according to law, and no organization or individual may occupy the property of a school legal person during the existence of the school. Private schools should register the assets invested by the sponsors, accumulated assets in running schools and assets formed by government subsidies, and deposit public funds such as tuition income and government subsidies into the special bank account of the school. The competent department should supervise the special bank account of school public funds to ensure that the school funds are not used for other purposes. Improve financial management and accounting systems, strengthen financial supervision and asset supervision, and implement financial disclosure. Private schools shall, at the end of each fiscal year, issue financial and accounting reports in accordance with regulations, and entrust accounting firms to conduct audits according to law. The audit results shall be reported to the examination and approval authorities for the record and announced to the public.

(eighteen) the establishment of private schools risk prevention mechanism. All localities should strengthen the construction of management information system of private schools, improve the risk assessment and early warning mechanism of running schools, and formulate work plans. The school authorities should pay attention to the operation of the organizers of private schools, strengthen the supervision of the organizers' illegal intervention in school management, withdrawal of investment, misappropriation of school funds and other illegal acts, timely understand and quickly warn of major events that may affect the school, and urge the school to avoid risks and operate smoothly.

(nineteen) the establishment of private school exit mechanism. When private schools terminate their schooling, they should put forward liquidation and resettlement plans in strict accordance with the procedures stipulated by laws and regulations, ensure orderly withdrawal, protect the rights and interests of teachers and students, prevent the loss of state-owned assets and maintain social stability. If the sponsor of a private school withdraws from the organization, transfers the rights and interests of the sponsor or undergoes major changes in its internal governance structure, it shall make an announcement in advance, and report the changes to the school examination and approval authority for approval or filing according to the prescribed procedures.

Five, improve the management and service system of private education

(twenty-one) to strengthen the supervision of private schools. The administrative department of education and relevant departments should strengthen coordination and cooperation, carry out the annual inspection of private schools, announce the inspection results to the public, and take the inspection results as an important basis for government funding and other support policies, and constantly improve the government support policy system. Improve the supervision and evaluation system of private schools, strengthen the responsibility of supervisors, play the role of intermediaries, and improve the scientific level of supervision and evaluation of private schools. Inspection, supervision and evaluation are important means to standardize private education.

(twenty-two) to improve the management and service level of private education. All localities should gradually establish a private education service and management information platform that meets the needs of the public, facilitates the needs of school operators, and is conducive to improving the level of government management services, promote the informatization construction of private education, and strengthen the statistics and release of information on private funds participating in education and social training. Guide the healthy development of private education intermediaries and strengthen the construction of private education research institutions. Actively publicize the advanced models, reform achievements and development achievements of private education, actively coordinate relevant departments to formulate policies and measures to further promote the development of private education, and create a good environment for the whole society to support the development of private education.

For students, it is necessary to ensure that public school students enjoy the same rights as public school students in terms of further studies, national student loans, national scholarships, subsidies for living difficulties, and employment. The second is to give strong support. In terms of policies, it is necessary to comprehensively clean up all discriminatory policies against private schools, focusing on solving problems such as enterprise attributes and property ownership that restrict the development of private schools. In terms of funds, in the major projects of education planning and education, private education should be included in the field of vision. The tasks entrusted by the government to private schools should be purchased and the corresponding expenses should be allocated. It is necessary to set up special funds for private education and reward private schools with high quality and good social reputation.
