Regulations of Jiangsu Province on the Prevention and Treatment of Personal Injury Accidents among Primary and Secondary School Students
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Education Law of the People's Republic of China, the Law of People's Republic of China (PRC) on the Protection of Minors and other laws and administrative regulations, in combination with the actual situation of this province, in order to prevent and deal with personal injury accidents of primary and secondary school students, protect their legitimate rights and interests, and maintain the normal order of education and teaching. Article 2 These Regulations apply to the prevention and treatment of personal injury accidents (hereinafter referred to as injury accidents) that occur in primary and secondary school students (hereinafter referred to as students) in school education and teaching activities, as well as in school buildings, venues, other education and teaching facilities and living facilities for which the school is responsible for management. Article 3 It is the common responsibility of local people's governments at all levels and their relevant departments, school organizers, schools, students, their parents or other guardians and the society to ensure the personal safety of students and prevent injury accidents. Article 4 Schools shall perform their duties of safety education, management and protection for students according to law.

Parents or other guardians of students should perform their guardianship duties, educate students about safety, and have the obligation to cooperate with the school to implement relevant safety management systems and safety protection measures.

Students should abide by the rules, regulations and disciplines of the school, obey the education and management of the school, and avoid and eliminate the corresponding dangers according to their own cognitive ability and civil capacity. Article 5 The handling of student injury accidents shall follow the principles of legality, fairness, reasonableness and timeliness, so that the facts are clear, the nature is accurate and the responsibilities are clear. Chapter II Prevention of Injury Accidents Article 6 Local people's governments at all levels shall strengthen their leadership in the prevention and handling of student injury accidents, establish a cooperative mechanism for school safety management with the participation of relevant departments and units such as education, public security, culture, sports, health, environmental protection, industry and commerce, quality and technical supervision, production safety supervision and construction, and urge all relevant departments to do a good job in the prevention and handling of student injury accidents. Article 7 The administrative department of education is responsible for the deployment, guidance, coordination, supervision and inspection of the prevention and treatment of student injury accidents in schools, guiding schools to establish and improve corresponding safety management systems, and supervising and inspecting the implementation of school safety management systems, relevant emergency plans and preventive measures for student injury accidents. Article 8 Public security organs shall assist schools to carry out public security, fire control and traffic safety education, guide and supervise schools to do a good job in fire safety in schools, strengthen public security, fire control and traffic management in schools and their surrounding areas, and perform the following duties:

(a) in school and after school hours, strengthen the patrol of the surrounding areas of the school, and promptly stop and investigate illegal and criminal activities that endanger the safety of students;

(two) regularly supervise and inspect the school fire safety, and urge the school to eliminate fire safety hazards;

(3) Set up school signs near the school, and set up signs and markings such as no parking, warning and speed limit in front of the school. If there are no crosswalk facilities, crosswalks should be drawn, and warning signs should be set up at the entrance and exit roads of schools in busy traffic sections to maintain traffic order.

Public security organs and transportation departments should strengthen the safety management of vehicles and boats carrying students, ban vehicles and boats that are unlicensed and do not meet safety standards, and promptly stop and investigate illegal acts such as overloading. Article 9 The administrative department of health shall supervise and inspect the hygienic status of food and drinking water and the prevention and control of diseases in schools according to law, guide and supervise schools to improve their hygienic work, and strengthen the hygienic supervision and management of producers and operators who provide services for schools and students. Article 10 The administrative departments of land resources and water resources shall, jointly with the administrative departments of education, regularly assess the mountains and streams that endanger the safety of school buildings, activity places and passages. In the school and its surrounding areas, and according to the evaluation results, notify the relevant departments or schools to take measures such as prohibiting the use or passage, rectifying within a time limit, setting up protective facilities and warning signs.

The relevant departments and units shall strictly implement the geological disaster risk assessment system in the network layout, site selection and planning and design of newly-built primary and secondary schools, and take effective measures to prevent and control geological disasters. Article 11 The departments of development and reform, planning, construction, environmental protection, culture, industry and commerce, urban management, and production safety supervision, as well as the township (town) people's government and sub-district offices where the school is located, shall strengthen the supervision and management of the construction activities and production and business activities of the school and its surrounding areas according to law, and promptly stop and investigate the following acts:

(a) the construction of flammable, explosive, toxic and harmful projects that endanger school safety;

(two) building buildings (structures) next to the school wall;

(three) production and business activities that pollute the environment and affect the safety of schools and students;

(four) within 200 meters around the campus, set up commercial cultural and entertainment venues such as songs and dances, electronic games and Internet access services that restrict minors from entering;

(five) in front of the school and on both sides of the fifty meters to set up stalls and pile up debris;

(six) setting up facilities and equipment that affect the safety or normal passage of students;

(seven) other acts that should be stopped and investigated according to law. Twelfth school organizers and schools should provide school buildings, venues and other educational, teaching and living facilities and equipment that meet the safety and hygiene standards stipulated by the state and the province.

School organizers and schools are not allowed to park off-campus motor vehicles in playgrounds and other teaching venues, nor are they allowed to divert school buildings, venues and other educational and teaching facilities and living facilities for other purposes, nor are they allowed to affect the order of school education and teaching and endanger the personal safety of students.
