Employees make mistakes and the company loses money. Because there are relevant laws and regulations, if the laborer causes economic losses to the employer due to his own reasons, the employer may require him to compensate the economic losses according to the labor contract. Compensation for economic losses can be deducted from the employee's own salary. When the employer demands compensation from the laborer, it should consider whether the laborer has violated the rules and regulations, operating rules or labor disciplines and professional norms that should be observed from various aspects; Whether there is a causal relationship between the damage and the illegal behavior of the workers; Whether the laborer has subjective fault.

The employer shall provide proof and bear the corresponding burden of proof. However, due to the personal dependence of labor relations, enterprises, as the main beneficiaries of labor results, also have to bear certain business risks. Under normal circumstances, workers will only be liable for compensation if they intentionally or grossly cause economic losses to the employer.

Legal basis: Article 16 of the Interim Provisions on Wage Payment

If the laborer causes economic losses to the employer due to his own reasons, the employer may demand compensation for the economic losses in accordance with the provisions of the labor contract. Compensation for economic losses can be deducted from the employee's own salary. However, the monthly deduction shall not exceed 20% of the employee's monthly salary. If the deducted surplus wage is lower than the local monthly minimum wage, it shall be paid according to the minimum wage.

Article 17

The employing unit shall, in accordance with these Provisions, formulate an internal wage payment system through the staff and workers' congress, the staff and workers' congress or other forms of consultation, inform all employees of the unit, and send a copy to the local labor administrative department for the record.
