Regulations of Chongqing Municipality on Vocational Education
Chapter I General Provisions Article 1 In order to develop vocational education, improve the quality of workers, promote employment, and safeguard the legitimate rights and interests of vocational education organizers, teachers and educatees, these Regulations are formulated in accordance with the provisions of the Vocational Education Law of People's Republic of China (PRC), the Labor Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to all kinds of vocational school education, various forms of vocational training education and related supervision and management in this Municipality.

The special training of state organs for their staff shall be carried out in accordance with relevant laws and administrative regulations. Article 3 Vocational education in this Municipality adheres to the principle of service-oriented and employment-oriented, and promotes the close integration of vocational education with production practice, technology popularization and social services. Article 4 Vocational education in this Municipality shall implement a diversified school-running system featuring government-led, industry-guided, school-enterprise cooperation and social participation. Article 5 The people's governments at or above the county level shall strengthen their leadership over vocational education, incorporate vocational education into the national economic and social development plan, increase investment, integrate resources, provide classified guidance, encourage social forces to organize vocational education, and promote its development. Article 6 People's governments at or above the county level shall set up vocational schools to play an exemplary role.

The people's governments at or above the county level shall strengthen vocational education for rural laborers, immigrants from reservoir areas, migrant workers, newly-added laborers in cities and towns, laid-off workers and the disabled. Article 7 The municipal education administrative department shall be responsible for the overall planning, rational distribution, comprehensive coordination and macro-management of vocational education.

Education administrative departments at all levels, labor and social security administrative departments and other relevant departments shall be responsible for the relevant work of vocational education according to their respective responsibilities. Eighth people's governments at or above the county level shall strengthen the supervision of vocational education, supervise, inspect and guide the vocational education within their respective administrative areas, and announce the results of supervision to the public.

Establish and improve the coordination mechanism of vocational education industry and promote the cooperation between vocational education and industries and enterprises. Article 9 Vocational schools and vocational training institutions are encouraged to carry out foreign exchanges and cooperation on the principle of equality and mutual benefit, popularize the advanced experience of vocational education and develop vocational education in this Municipality. Tenth people's governments at or above the county level or the relevant competent departments shall commend or reward units, individuals and outstanding skilled personnel who have made outstanding achievements in vocational education. Chapter II Vocational Schools and Training Institutions Article 11 Vocational schools are divided into primary, secondary and higher vocational schools, and the specific grading standards shall be implemented in accordance with the relevant provisions of the state and this Municipality. Article 12 The establishment of a vocational school shall meet the following conditions:

(1) Having an organizational structure and articles of association;

(2) Having qualified teachers suitable for the scale of running a school;

(3) Having teaching infrastructure that meets the prescribed standards and equipment that meets the teaching needs;

(4) Having funds commensurate with the scale of running a school and a stable source of funds;

(5) Other conditions stipulated by laws and regulations. Article 13 The establishment of higher vocational schools shall be examined and approved by the Municipal People's Government and reported to the national education administrative department for the record.

The establishment of secondary vocational schools shall be examined and approved by the municipal education administrative department, and the establishment of technical schools shall be examined and approved by the municipal labor and social security administrative department.

The establishment of primary vocational schools shall be examined and approved by the administrative department of education of counties (autonomous counties) and reported to the municipal administrative department of education for the record. Article 14 An application for the establishment of a vocational school shall meet the conditions stipulated in Article 12 of these Regulations, and an application shall be submitted to the relevant examination and approval authorities.

The examination and approval authority shall make a written decision on approval or disapproval within three months from the date of acceptance and serve it on the applicant. Approved, issued a school license, and announced to the public; If it is not approved, it shall explain the reasons in writing. The application for the establishment of higher vocational schools can be extended for three months.

It is forbidden to rent, lend, forge or transfer the school license. Article 15 During the existence of a vocational school, the legal person property of the school shall be managed and used by the school for running the school; Accepted social donations shall be stored in special accounts and used according to the purposes specified by the donors. If there is no specific purpose, these funds will be used to build school buildings, purchase teaching equipment and help students complete their studies. The returns made by investors in private vocational schools according to law are protected by law. Sixteenth vocational schools to change the sponsor, name, address, category, should apply for change, after the approval of the original examination and approval authority, the relevant change procedures. The sponsor of the change of vocational school shall conduct asset evaluation and financial audit according to law, and reach an agreement on the relevant matters after the change; If there is no agreement, the organizer after the change shall bear the corresponding responsibilities.

If a vocational school terminates its operation, it shall carry out liquidation according to law, properly arrange students and faculty, and report to the original examination and approval authority for the record. The original examination and approval authority shall withdraw the license and seal for running a school, and promptly announce the termination of running a school to the public. Seventeenth higher vocational schools, key secondary vocational schools to set up teaching branches, should be approved by the municipal education administrative department; The establishment of teaching branches in key technical schools shall be approved by the municipal labor and social security administrative department.

The establishment of teaching branches in this city by vocational education schools outside the city shall be approved by the relevant examination and approval departments in accordance with the provisions of the preceding paragraph.

Elementary and other secondary vocational schools may not set up teaching branches.
