Chapter I General Provisions Article 1 In order to strengthen the management of preschool education institutions and promote the healthy development of preschool education in our city, these measures are formulated in accordance with the People's Republic of China (PRC) Private Education Promotion Law, the Regulations on Kindergarten Management, the Regulations on Kindergarten Work, the Measures for the Safety Management of Kindergartens in Primary and Secondary Schools, and the Interim Measures for the Management of Kindergartens in Henan Province (for Trial Implementation).

Article 2 These Measures shall apply to all kinds of kindergartens (including rural preschool classes) held in our city with children aged 3-6 as the educational objects.

Article 3 Education administrative departments at all levels are the competent departments of preschool education, responsible for the management of preschool education in their own areas and providing professional guidance to kindergartens at all levels. Establish and improve the kindergarten evaluation system and classification management system, and evaluate, supervise, inspect and guide all kinds of kindergartens at all levels.

Chapter II Examples Article 4 The kindergarten admission system shall be implemented. The establishment of kindergartens shall be declared by the local township (street) education office or central school in accordance with the principle of territorial management, and the county-level education department shall be responsible for examination and approval, and issue the Kindergarten Park Permit (hereinafter referred to as the Park Permit).

After obtaining a school license, a private kindergarten shall apply for a school license for private education according to law, and then register with the civil affairs department to obtain a legal person license for a private non-enterprise unit.

Chinese-foreign cooperation in running schools shall be examined and approved by the Provincial Department of Education in accordance with the requirements of the Regulations of People's Republic of China (PRC) on Chinese-foreign Cooperation in Running Schools (Order No.372nd of the State Council).

No unit or individual may hold a kindergarten without obtaining the Permit for Running a Park and going through the registration formalities.

Cities (including urban areas and county towns) may not hold any form of preschool classes.

Article 5 Social organizations that run kindergartens have the status of legal persons, and citizens have political rights and full capacity for civil conduct.

Article 6 To apply for the establishment of a kindergarten, the following materials shall be submitted to the examination and approval authority:

(a) the application report and approval registration form. The contents of the bid report include the organizer, standardized name, nature, scale, form, conditions, internal management system, fund raising and management, etc. ;

(two) the relevant information to prove the conditions for running the park.

To apply for holding a private kindergarten, the following materials shall be provided:

1. Qualification certificate of sponsors and list of members of decision-making bodies;

2. Qualification certificates of directors, teachers, nurses and other staff members and health certificates issued by qualified health inspection units;

3. Legal and valid asset certification documents for the planned kindergarten;

4. Draft articles of association of the kindergarten to be established (including school purpose, management system, enrollment object and scope, composition of teaching staff, education protection plan, etc.). ) and development plan;

5. House title certificate. If the garden is rented, a legally binding lease contract or agreement shall be provided;

6 valid documents approved by the public security fire department;

7 on-site health supervision and audit opinions issued by health supervision institutions at or above the county level;

8. Other materials required by laws and regulations.

Seventh kindergartens should use standardized names, which should generally be used together with place names.

The name cannot be preceded by the name or place name of a province or a city under its jurisdiction alone, nor can it be preceded by? China? 、? China? 、? International? Words like this; What is the prefix in the name? Henan? 、? Henan province? The words must be approved by the provincial education administrative department; What is the prefix in the name? Luoyang? 、? Luoyang city? Word, must be approved by the administrative department of education in Luoyang city.

Words with religious and superstitious meanings shall not be used.

Article 8 After a kindergarten obtains a school license and registers, it shall apply to the competent price department for a fee-charging license, and a private kindergarten shall also apply to the tax department for tax registration. Inclusive private kindergartens can enjoy preferential tax policies, which shall be implemented in accordance with relevant national and local regulations.

For kindergartens that have obtained the School License and gone through the registration formalities, relevant departments such as price, finance, health and taxation. Relevant procedures shall be handled in a timely manner in accordance with regulations.

Kindergarten can enroll students only after completing the above procedures.

Article 9 Establish a system of regular review and dynamic management. The examination and approval authority shall, in accordance with the law, conduct an annual audit of the approved kindergartens, and the audit items shall be determined by the examination and approval authority, and the audit results shall be publicized to the public.

Article 10 Once a kindergarten is registered, it is not allowed to change its sponsor or move it without authorization. If it is really necessary to change, the organizer or organizer shall submit a written application, and the change can only be made with the consent of the original examination and approval authority.

Kindergarten to change the registered items, must be 30 working days in advance to the original registration authority for registration.

Article 11 If the kindergarten is closed for some reason, the organizer or individual shall submit a written application to the original examination and approval authority 30 working days in advance, and submit a scheme for the diversion of assets liquidation plan and children of faculty and staff. It cannot be closed until it is approved.

Chapter III Conservation and Education Article 12 Kindergartens should implement the principle of combining conservation with education, create a harmonious environment suitable for children's education and development, and guide the healthy development of children's personality.

Thirteenth children should go to the medical institutions designated by the municipal public health administrative department for physical examination before entering the park. Those who are confirmed to have infectious diseases by physical examination are not allowed to enter the park.

In addition to physical examination, children are prohibited from carrying out any form of inspection and testing when entering the park.

Article 14 Kindergartens should use Mandarin commonly used throughout the country.

Fifteenth kindergartens should take games as the basic form of activities, integrate education into life and activities, and prevent primary school and adult.

Sixteenth teaching staff should have good professional ethics, respect and care for children, and corporal punishment or disguised corporal punishment of children is strictly prohibited.

Seventeenth kindergartens should establish a scientific one-day living system, and reasonably arrange the time for children to eat, take a nap, play games, outdoor activities and educational activities. The interval between meals is generally 3.5 hours; Outdoor activities shall be no less than 2 hours a day, including sports activities of no less than 1 hour.

Eighteenth kindergartens should establish a scientific evaluation system of conservation education.

Kindergarten should establish a growth file for each child. Teachers and caregivers should make observation records and case analysis of children, observe children's behavior and performance in a targeted manner, analyze children's development status and development requirements in time, and adjust teaching design in time.

Chapter IV Administrative Affairs Article 19 Kindergarten principals are responsible for the work of kindergartens.

The director shall be appointed by the organizer, organization or individual, and shall be filed with the examination and approval registration authority.

Kindergarten teachers, doctors, nurses and other staff are appointed by the director, or by the organizers or individuals.

Twentieth kindergartens should be equipped with teaching staff in accordance with the relevant provisions of the state, province and our city, and kindergartens should protect the legitimate rights and interests of teaching staff according to law.

Twenty-first kindergartens should have a stable source of funds to ensure the normal operation of conservation and education.

Twenty-second kindergartens must strictly implement the provisions of the price department on the management of kindergarten fees.

Twenty-third kindergartens shall not charge extra fees on the grounds of setting up experimental classes, characteristic classes and interest classes. Do not seek other illegitimate economic interests by organizing children's activities.

Twenty-fourth kindergartens should abide by the financial management system, the fees should be earmarked, and consciously accept the audit supervision.

Children's dietary fund must establish a special account and announce it to children's parents regularly.

Twenty-fifth kindergartens should have a certain proportion of funds for the purchase of teaching AIDS and books every year.

Twenty-sixth encourage and support social organizations and individual citizens to donate property to kindergartens.

Kindergarten donations must be implemented in accordance with relevant state laws and regulations.

Twenty-seventh kindergartens should establish a contact system with parents, set up a parents' committee, and guide parents to raise children scientifically through parents' schools, parents' meetings, parents' open days and other forms.

Chapter V Safety and Hygiene Article 28 Kindergartens shall strengthen safety awareness, establish and improve safety management systems, and formulate various safety work plans.

Twenty-ninth kindergartens should strengthen the safety education of teaching staff and children, and improve the skills of teaching staff to protect children's safety and children's self-protection ability.

Thirtieth kindergartens should enhance safety awareness, set up public security agencies, establish and improve the safety management system, formulate various safety work plans, and regularly organize emergency plan drills.

Thirty-first kindergartens should regularly inspect and maintain kindergartens and facilities, and organize special personnel to conduct daily inspections and records, strengthen the management of fire sources and power sources, eliminate potential safety hazards in time, and ensure the safety of young children.

Thirty-second kindergartens should establish and improve various health care systems.

The teaching staff should have a physical examination according to the regulations. Those who do not meet the requirements should be transferred from their posts.

Thirty-third kindergartens should establish a plan to prevent food poisoning and epidemic of infectious diseases and strictly implement it, and assist local disease control institutions to carry out vaccination work for school-age children.

When food poisoning and infectious diseases occur in kindergartens, units, organizations or individuals holding kindergartens shall immediately take emergency rescue measures. At the same time, report to the relevant departments in a timely manner within the prescribed time limit, and do a good job in the aftermath in accordance with relevant regulations.

Thirty-fourth kindergarten canteen management should strictly implement the food hygiene and safety system, and all kinds of licenses must be complete. Temporarily do not have the conditions to set up a canteen, the unit that delivers food to the kindergarten must meet the corresponding hygiene and safety requirements, and ensure that the delivered food is kept for 48 hours.

Children's tableware and drinking utensils should be used by special personnel and disinfected regularly to prevent cross-infection.

Thirty-fifth kindergartens should establish a system of child handover between guardians and teachers to ensure the safe handover of children.

Chapter VI Awards and Penalties Article 36 Kindergartens that have made remarkable achievements in improving the conditions for running kindergartens, conservation education and child care management shall be commended and rewarded by the local people's government or the administrative department of education.

If the circumstances are serious enough to constitute a crime, the judicial organs shall investigate its legal responsibility according to law.

(2) publishing false enrollment brochures or advertisements to defraud money;

(six) submit false documents or take other deceptive means to conceal important facts to defraud the Park Permit;

(seven) malicious termination of the park, withdrawal of funds or embezzlement, misappropriation of funds for the park;

(eight) the appointment and dismissal of teachers in violation of state regulations;

(nine) corporal punishment or corporal punishment of children in disguised form;

(ten) the use of toxic and harmful substances to make teaching AIDS;

(eleven) occupation, destruction of kindergarten buildings and equipment;

(twelve) interfere with the normal working order of kindergartens;

(thirteen) there are buildings and facilities around the kindergarten that are dangerous, polluting or affecting the lighting of the kindergarten.

Article 38 These Measures shall be implemented as of the date of promulgation. If there is a new national policy, it shall be implemented according to the new national policy.
