The establishment period of private middle schools shall not exceed 3 years, and no students shall be enrolled during the establishment period.

(6) Private secondary schools run by public schools shall have independent legal personality, separate education and teaching facilities and venues from public schools, implement independent financial and accounting systems, enroll students independently, issue certificates independently, and shall not use financial funds.
Article 9 To apply for establishing a private middle school, the following materials shall be submitted to the administrative department of education:
(a) to apply for the establishment of ordinary high schools and secondary vocational education schools.
1. The bid report shall include the sponsor, training objectives, school scale, school level, school form, school conditions, internal management system, fund raising and management, etc.
2. Name and address of the sponsor, copy of ID card, resume or name and address of the sponsor, business license of enterprise as a legal person (organization code certificate) and brief introduction.
3. The name and address of the school to be held, the resumes and professional qualification certificates of the proposed principal and financial officer.
4. Articles of association of the school (if it is a joint-stock school, the composition of shareholders and the proportion of shares shall be listed), and the list of members to be appointed to the board of directors, the board of directors or other decision-making bodies of the first school.
5. The proof of the source and ownership of the assets of the school to be held, the capital verification report and relevant supporting documents issued by a qualified accounting firm, and the self-owned school site and ownership certificate.
6. To donate school property, a donation agreement must be submitted, indicating the name of the donor, the amount, use and management of the donated property, and relevant supporting documents.
7. A valid certificate that the sponsor deposited a risk deposit of 500,000 yuan into a bank account designated by the district/county education administrative department in accordance with the relevant provisions of the municipal government (the principal and interest of the deposit are owned by the sponsor and supervised by the district/county education administrative department).

Article 10 The name of a newly-built private middle school shall conform to the relevant provisions of the administrative department of education, and the name of a secondary vocational school shall be clearly defined as "XX Vocational (Technical) School"; The name of an ordinary high school should be clearly defined as "XX Middle School".
The school name suffix of the private middle school to be established is "(to be established)".
The names of private middle schools shall not be prefixed with the words "China", "China", "country", "international", "Chongqing capital", "capital" and "southwest", and shall not be named by Chinese and foreign abbreviations, personal names, domain names outside the city where the school is located, or names of revoked educational institutions. The names of public schools participating in the establishment of private schools should be obviously different from those of public schools and should not be confused with those of public schools.
Eleventh in any of the following circumstances, the administrative department of education shall not accept the application for establishment or formal establishment, and explain the reasons to the applicant:
(a) social organizations or individuals that run private schools do not meet the conditions prescribed by laws and administrative regulations;
(2) The applicant has no guarantee for running a school sustainably;
(three) the conditions for running a school do not meet the requirements of the set standards;
(four) the articles of association of the school do not meet the requirements of the relevant provisions, and are still not amended after being told;
(five) the composition of the school board of directors, the Council or other forms of decision-making bodies does not meet the statutory requirements, or the school principals, teachers and accountants do not have the statutory qualifications and still do not correct after being told.
If the application for establishment accepted by the district and county education administrative department meets the reporting conditions, it shall be reported to the municipal education administrative department for examination and approval; For those who do not meet the application conditions, the district and county education administrative departments shall directly reply to the applicant within the prescribed time limit and explain the reasons.
Twelfth municipal education administrative departments in the examination and approval of schools, the relevant administrative licensing procedures in accordance with the law. And organize an expert Committee to comment, and the expert Committee gives opinions.
Thirteenth to apply for the establishment of private secondary schools, the municipal education administrative department shall make a written reply whether or not to agree within 30 days from the date of accepting the application.
To apply for the formal establishment of a private middle school, the municipal education administrative department shall make a written reply on whether or not to agree within 3 months from the date of accepting the application.
Article 14 The municipal education administrative department entrusts the district and county education administrative departments to issue school licenses to the approved private middle schools, and implement territorial management, and publish the names and articles of association of the approved private middle schools in the relevant media of this Municipality within 20 days from the date of approval.
If a private middle school loses its license to run a school, it shall declare it invalid in the newspapers and periodicals that publish the announcement of its establishment in time, and apply to the district and county education administrative departments for completing the relevant procedures.
Private middle schools must organize enrollment and carry out education and teaching activities in accordance with the school name, school location, school type and school level approved by the school license.
Private middle schools implement "one school, one certificate" and run schools with bright certificates. Except that national and municipal key private secondary vocational schools can set up branch schools with the approval of the municipal education administrative department, other private secondary schools may not run schools outside the school-running place approved by the school-running license; No branches may be established; It is not allowed to rent or rent, lend or buy or sell school licenses in disguised form.
Fifteenth private middle schools run risks to ensure that the metal sponsor owns it, which is specially used to deal with the emergency and remaining problems such as student refund and teacher remuneration when the school terminates running or runs a school crisis.
Sixteenth private secondary schools to apply for change and termination, shall meet the following conditions:
(a) division, merger, change of name
The sponsor shall have proper and sufficient reasons for applying for the division or merger of the school and changing its name and category.
(2) Change of sponsors
1. The original sponsor must have justified reasons when applying to change the sponsor;
2. There are no remaining problems after the completion of the school financial liquidation;
3. The school board makes a decision and both parties have an agreement;
4. New sponsors apply for hosting schools;
5. Proof that the new sponsor has the ability to run a school and the financial guarantee.
(3) Termination
1. The sponsor applies to terminate the school, or it should be cancelled due to legal reasons, or it cannot continue to run the school because of insolvency;
2. Proper placement of existing students and faculty;
3. Properly dispose of debts, school buildings and teaching facilities.
Seventeenth private secondary schools to apply for change and termination, should be entrusted by the municipal education administrative department of the district and county education administrative departments to submit the following materials:
(a) division, merger, change of name
1. Report on major issues such as the sponsor's application for division and merger of the school, change of name and category;
2. Change plan and feasibility demonstration materials;
3. Related separation and merger agreements.
(2) Change of sponsors
1. Application report of the original organizer;
2. Financial and accounting reports audited by accounting firms;
3. Original resolution of the board of directors;
4. Report undertaken by the new organizer;
5. Original agreement on the transfer of the right to host 1 copy;
6. The qualification certificate of the new promoter (including a copy of the promoter's license, operating conditions, funds held and their sources);
7. The list of members of the board of directors to be appointed after the school changes and the resume of the legal representative;
8. Resumes and professional qualification certificates of the proposed principal and financial controller after the school change, and the list of teachers to be hired;
9. The articles of association of the school to be changed.
(3) Termination
1. Organizer's application report;
2. Resettlement plan for existing students and faculty;
3. The school financial liquidation report audited by an accounting firm;
4 opinions on the disposal of creditor's rights and debts, school buildings and teaching equipment and facilities.
Eighteenth organizers apply for division, merger, change of name, change of organizers, by the district and county education administrative departments to assist in the investigation and demonstration, by the municipal education administrative department for examination and approval.
If the sponsor applies to terminate the school, the district and county education administrative departments shall organize experts to conduct field visits and put forward audit opinions, and report them to the municipal education administrative department for examination and approval.
If a private middle school applies for alteration and termination, the municipal education administrative department shall give a written reply within 3 months from the date of acceptance.
Nineteenth private secondary schools in any of the following circumstances, it shall apply for termination. (1) The articles of association of the school are terminated; (two) the school license has been revoked; (three) unable to continue running a school because of insolvency.
According to the relevant laws and regulations, when a private middle school terminates, it shall properly arrange the students in school and handle the related creditor's rights and debts. The remaining property after paying off debts shall be disposed of in accordance with the provisions of relevant laws and administrative regulations; If the assets are insolvent, it shall be handled in accordance with the relevant provisions of the Private Education Promotion Law and its implementing regulations.
Twentieth private secondary schools that are allowed to terminate shall be issued by the administrative department of education with a certificate of cancellation. At the same time, the terminated private middle school must return the school license and school seal, and go through the cancellation of registration with the relevant departments. When the school is approved to be established, if the sponsor has a risk deposit in a financial institution, the district/county education administrative organ shall review the actual balance and issue relevant certificates, and the original depositor shall be responsible for liquidation and withdrawal procedures.
Article 21 The establishment, alteration and termination of private secondary schools shall be announced by the administrative department of education. The announcement shall be published in the public media within the administrative area under the jurisdiction of the government at the same level.
The contents of the announcement of school establishment include: school name, address, legal representative, school nature, school type, examination and approval authority, approval time and license number.
The contents of the school change announcement include: change items, school name, address and license number.
The contents of the school termination announcement include: school name, address, legal representative, license number, examination and approval authority, and closure time.
