What are the basic requirements of the principle of combining punishment with education?
When handling public security cases, public security organs should implement the principle of combining education with punishment, and must pay attention to overcoming two kinds of one-sidedness: one is to emphasize punishment unilaterally, punish for punishment's sake, and "replace education with punishment". This one-sided performance is that handling public security cases means investigating and punishing those who violate public security management. At the same time, since those who violate the administration of public security have been punished, there is no need to continue education and end punishment. Whether people who violate the administration of public security realize the illegality and social harm of their actions, whether they have learned a lesson from it, whether they will commit it again in the future, and whether it will serve as a warning and education for the surrounding people is another matter. Especially the fine, even if the task is completed, no matter whether the violation of public security management continues or not, some violators think that it is legal to pay the fine, "spending money to buy it legally." This one-sidedness has led to the phenomenon of "substituting punishment for education" and "hosting by punishment" in practice, and the offenders of public security management still go their own way, which not only infringes on the interests of the country and the people, but also affects the social security order and has a bad influence among the people. The purpose of public security administration punishment is to correct the acts violating public security administration and educate citizens, legal persons and other organizations to consciously abide by the law, thus maintaining social order. As long as this goal is achieved, not all minor violations of public security management will be punished by public security management. Therefore, as stipulated in Article 9 of this Law, "fighting caused by civil disputes, damage to other people's property and other minor violations of public security management can be handled by the public security organs" and as stipulated in Article 19, "especially minor violations of the law", or "actively eliminating or mitigating the illegal consequences to gain the understanding of the infringed person", or "being coerced and deceived by others", or "voluntarily surrendering to the public security organs and truthfully confessing themselves.
