Interim Measures of the State Education Commission on the Administration of Running Schools for Foreign Children
Article 1 These Measures are formulated in order to facilitate the education of foreign children in China, strengthen the management of schools for foreign children and promote the opening up. Article 2 Foreign institutions, foreign-funded enterprises, offices of international organizations in China established in China according to law and foreigners legally residing in China may apply for the establishment of schools for children of foreigners (hereinafter referred to as schools) in accordance with these Measures. Article 3 Schools are limited to middle schools (including ordinary middle schools) and schools below. Article 4 To apply for establishing a school, the following basic conditions shall be met:

(a) have the corresponding student size and school needs;

(2) Having teachers who meet the needs of education and teaching;

(3) Having necessary venues, facilities and other conditions for running a school;

(four) there are necessary funds for running schools and stable sources of funds. Article 5 To apply for establishing a school, the following materials shall be submitted:

(a) an application for the establishment of a school (including the purpose of running a school, enrollment plan, enrollment area, school scale, etc.);

(2) the articles of association of the school;

(three) the applicant's documents;

(4) The name list of the president and members of the board of directors and their qualification certificates;

(five) the facilities, funds, school buildings, venues, sources of funds and related documents;

(6) the source of teachers. Article 6 To establish a school, the applicant shall apply to the education administrative department of the province, autonomous region or municipality directly under the Central Government where the school is to be established, and after examination and approval, it shall be submitted to the education administrative department of the State Council for examination and approval. Seventh approved schools, from the date of approval, have the qualifications of legal persons and independently bear civil liability.

Schools may not set up branch schools. Article 8 The school enrolls children of foreigners who hold residence certificates in China. Schools shall not enroll children of China citizens in China. Article 9 The curriculum, teaching materials and teaching plan of a school shall be determined by the school itself. Article 10 The funds for running a school shall be settled by the applicant.

Schools are not allowed to engage in industrial and commercial activities and other profit-making activities in China. Eleventh People's Republic of China (PRC) municipal government encourages and supports schools to offer Chinese and China culture courses, so as to enhance and deepen students' understanding of China culture. Article 12 The employment of foreigners by schools shall be handled in accordance with the Law of People's Republic of China (PRC) on the Entry and Exit of Foreigners and the relevant regulations on foreigners working in China.

The employment of consular staff and their spouses in China by the school needs to be approved by the Ministry of Foreign Affairs.

Schools that employ China citizens must apply to the provincial education administrative department, and they can only be employed after approval. Thirteenth schools import teaching equipment and office supplies, in accordance with the relevant provisions of the state. Article 14 Schools, their staff and students shall abide by the laws and regulations of China, respect the customs and habits of the people of China, and shall not engage in activities that endanger the national security and public interests of People's Republic of China (PRC). Fifteenth school construction land shall be handled in accordance with the provisions of the state land management. School buildings and venues shall not be used for activities inconsistent with their functions. Sixteenth schools should send lists of teaching staff and students, teaching materials, etc. Record with the local education administrative department every year, and accept the supervision and inspection conducted by the local education administrative department according to law.

Any change in the school principal and members of the board of directors shall be filed with the provincial education administrative department. Seventeenth in violation of these measures, under any of the following circumstances, the provincial education administrative department may, depending on the seriousness of the case, order the school and the organizer to make rectification or close down within a time limit:

(1) establishing a school without approval;

(2) Recruiting children of citizens in China;

(three) the school resources (including funds, students and teachers) are seriously insufficient to operate normally;

(4) engaging in industrial and commercial activities and other profit-making activities;

(five) to engage in activities that violate the laws and regulations of China. Article 18 These Measures shall not apply to the management of schools for children of diplomats of diplomatic missions in China. Article 19 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government may formulate specific provisions in accordance with these Measures and in light of local conditions. Article 20 These Measures shall come into force as of the date of promulgation. Schools that have been established before this shall go through relevant procedures in accordance with the provisions of these measures.
