In order to further promote the healthy and orderly development of Internet education information service and modern distance education, the Ministry of Education has formulated the Interim Measures for the Administration of Education Websites and Online Schools, which are hereby printed and distributed to you and shall come into force as of today.

Article 1 In order to promote the healthy and orderly development of Internet education information services and modern distance education, and standardize the behaviors of engaging in modern distance education and providing education information services through the Internet, these Interim Administrative Measures are formulated in accordance with relevant national laws and regulations.
Article 2 Modern distance education and education information service are an important part of socialist education in China, and the development of modern distance education and education information service must follow the national education policy.
Article 3 An educational website refers to an institution that establishes an information base by collecting, processing and storing educational information, or establishes an online education platform and information acquisition and search tools at the same time, and accesses the Internet or educational TV stations through Internet service providers (ISPs) to provide online users with teaching and other public information services related to education.
Article 4 Education online schools refer to educational websites that carry out academic degree education at all levels or issue various certificates through training.
Article 5 Education websites and online schools that use satellite networks to carry out education and teaching activities must go to China Education Television.
Article 6 Education websites and online schools may involve higher education, basic education, preschool education, normal education, vocational education, adult education, continuing education and other kinds of education and educational public information services.
Article 7 The education administrative department shall, according to the principle of matching face-to-face education management, be responsible for the examination and approval and management of education websites and online schools, and report to the leading group of informatization work of the Ministry of Education for the record.
Eighth whoever applies for the establishment of educational websites and online schools in People's Republic of China (PRC) must apply to the administrative department of education, and they can only be established after examination and approval. Established education websites and online schools, without the approval of the administrative department of education, should handle the application and examination and approval procedures in time. Without the approval of the administrative department of education, educational websites and online schools shall not be opened without authorization.
Article 9 To start various educational websites, the following basic conditions must be met:
(a) the necessary funds and effective proof of the source of funds.
(2) It meets other conditions stipulated by national laws, regulations and national education administrative departments.
Article 10 To set up an online education school, in addition to meeting the conditions stipulated in Article 9 of these Measures, it must also be an institution legal person recognized by the education administrative department of People's Republic of China (PRC) (hereinafter referred to as "People's Republic of China (PRC)") and qualified to engage in similar educational activities with online schools, or an institution legal person or enterprise legal person organization that cooperates with this institution and provides quality assurance.
Eleventh institutions applying for the establishment of educational websites and online schools (hereinafter referred to as the applicant) shall provide the following materials to the competent administrative department of education:
(1) A written application for starting (or confirming) an educational website and an online school. Including: types of educational websites and online schools, locations of websites and online schools, locations of counseling stations (if set), scheduled service start date, nature of applicants, mailing address, postal code, person in charge and his ID number, contact person, contact telephone number, etc.
(2) Proof of the basic conditions mentioned in Article 10 of these Measures.
(3) The profile of the applicant.
(4) If schools and enterprises jointly set up educational websites or online schools, they shall provide credit certificates or capital verification reports issued by accounting firms or audit firms.
(5) If the school and the enterprise jointly set up an education website or an online school, they shall provide the articles of association, shareholders' agreement and other documents of the applicant institution.
(6) Information security measures.
Article 12 When applying for the establishment of an online education school, it shall also provide the conditions for running the online education school, including the syllabus, teaching management means, teaching staff, enrollment targets, credit guarantee certificates, etc.
Thirteenth education administrative departments accept the applicant's application materials twice a year. If it is found that the application materials do not meet the requirements, the applicant shall be notified in writing within 10 working days to fill them up within a time limit. If the application is not completed within the time limit or the completed materials still do not meet the requirements, it shall be deemed as giving up the application. The competent education administrative department shall formally accept the application after passing the preliminary examination, make a decision on whether to approve it within 20 working days from the date of formal acceptance, and notify the applicant in writing.
Article 14 If the subject, name and location of the sponsor of an approved educational website or online school need to be changed, an application shall be submitted to the original education administrative department in charge of approval within 20 working days before the change, and the education administrative department shall conduct qualification examination on the new sponsor, and only after passing the examination can the change approval procedures be handled.
Fifteenth approved education websites and online schools should indicate the information approved by the administrative department of education on their homepages, including the approval date and document number.
Article 16 Where an approved educational website applies for listing at home and abroad in the form of an enterprise, it shall obtain the consent of the Ministry of Education in advance.
Seventeenth approved educational websites and online schools shall be announced to the public regularly by the leading group of informatization work of the Ministry of Education.
Eighteenth education websites and online schools shall abide by the relevant laws and regulations of the state, and shall not produce, publish or disseminate the following information on the Internet:
(1) divulging state secrets and endangering state security;
(2) Violating the national ethnic, religious and educational policies;
(3) propagating feudal superstitions, cults, obscene products, violating social morality, gambling, instigating crimes, etc. ;
(4) inciting violence;
(5) spreading rumors, disturbing social order and encouraging the masses to make trouble;
(6) Exposing personal privacy, attacking others and harming their legitimate rights and interests;
(seven) damage to the public interest;
(8) Computer viruses;
(nine) other harmful information prohibited by laws and regulations.
If the above harmful information is found, it shall be reported to the relevant competent department in time, and effective measures shall be taken to stop its spread.
Article 19 No educational website or online school may provide paid services for public welfare information disclosed to the public as stipulated by national laws and regulations.
Twentieth without the approval of the Ministry of Education, educational websites and online schools shall not be labeled as "China". Any educational website with the name of a government functional department shall not engage in business activities.
Article 21 In violation of Article 8, Article 18, Article 19 and Article 20 of these measures, the administrative department of education shall, according to the provisions of relevant administrative regulations, give a warning, informed criticism, cancel the qualification of educational websites and online schools and other penalties depending on the seriousness of the case. If the circumstances are serious, legal responsibility shall be investigated according to law.
Twenty-second overseas institutions to participate in the construction of online education schools in People's Republic of China (PRC), in accordance with the relevant provisions of Chinese-foreign cooperation in running schools and with reference to these measures.
