The local people's governments at the county level shall be responsible for the examination and approval of the establishment and cancellation of ferries, establish and improve the responsibility system for ferry safety management, and designate the responsible departments for ferry and ferry safety management. Township people's governments shall, in accordance with the "Regulations of People's Republic of China (PRC) on the Safety Management of Inland River Traffic" and the relevant provisions of the State Council, perform the safety management duties of township ferries.
The departments designated by the people's governments at the county level shall be responsible for the safety management of ferries and ferry services within the scope of their duties.
Maritime administrative agencies at all levels shall, in accordance with their respective responsibilities, supervise and manage the water traffic safety of ferries in inland waters under their jurisdiction. Fourth local people's governments at or above the county level shall strengthen the organization and leadership of the safety management of inland river ferries.
The ferry safety management adheres to the principle of safety first, prevention first, personal responsibility and serving people's livelihood. Chapter II Ferry Article 5 When examining and approving the establishment and cancellation of a ferry, the people's government at the county level shall give full consideration to safety factors, and make clear the main contents of the ferry water area, ferry route, ferry time and ferry location. Before the examination and approval, the opinions of the maritime administrative agency where the ferry is located shall be sought, and the opinions of the highway administrative agency shall also be sought if the responsibilities of highway management are involved.
Ferry waters involving two or more administrative regions at the county level shall be handled by the people's government concerned with the ferry, and the opinions of the corresponding maritime administrative agency shall be solicited.
It is strictly forbidden to illegally set up ferries. Article 6 A ferry crossing shall meet the following safety conditions:
(1) The site should be located in a place with gentle water flow, sufficient water depth, stable slope and wide field of vision, suitable for ships to dock, and the distance from the production and stacking places of dangerous goods should comply with the relevant regulations on the management of dangerous goods;
(2) Having safety facilities for loading and unloading goods and getting on and off passengers;
(three) equipped with necessary life-saving equipment and specialized management personnel.
In principle, ferries are not set up for newly built or rebuilt national and provincial roads. County roads and township roads shall solicit the opinions of highway management agencies when setting up ferries or canceling ferries.
Where there are bridges and tunnels for people and cars to pass through in densely navigable areas, it is necessary to avoid setting ferries near the bridges and tunnels, except that there are ferries on both sides of urban rivers for citizens to travel and commute. Article 7 A ferry shall, according to the type, quantity, water regime and transition requirements of the ferry objects, reasonably set up docks and approach roads, and be equipped with necessary indicating signs, ship-shore communication, ship navigation aid, fire control, safety and life-saving facilities. The width, longitudinal slope and wharf of the ferry approach bridge shall meet the corresponding technical standards.
The ferry mainly for ferrying passengers should be equipped with ramps for passengers to get on and off safely, and the ferry with large passenger capacity and corresponding land conditions should be equipped with passenger shelters and other facilities.
Ferry, mainly car ferry, should install and use weighing equipment such as weighbridges, and truthfully record the weighing situation. Conditional ferry, should set up electronic monitoring facilities.
Vehicles or heavy vehicles that have been approved to transport super-long, super-wide and super-high articles shall take effective protective measures before the transition, but vehicles that exceed the ferry's load limit, height limit, width limit and length limit shall not cross the ferry. When transporting dangerous goods vehicles, the ferry should set up a special passage for dangerous goods vehicles. Article 8 The installation and use of cable ferries shall not affect the navigation of other ships. Article 9 The ferry operator shall set up a bulletin board in a prominent position on the ferry, indicating the name of the ferry, the ferry area, the ferry route, the ferry code, the safety precautions for the ferry, the safety responsible unit and person, the supervision telephone number and other contents.
In the cascade reach, downstream of the reservoir area and ferry waters with large water level changes, the ferry shall indicate the warning water level line and the suspended water level line. Article 10 Ferry operators shall strengthen the safety management of ferry safety facilities and ferry transportation, establish a safety management system for ferries and ferries in accordance with relevant state regulations, and implement the responsibility system for safety management. Eleventh in the statutory or traditional festivals, major gatherings, fairs, busy farming, students after school holidays and other peak ferry, the people's government at the county level shall strengthen organization and coordination. Ferry operators shall, according to the needs of passenger flow, vehicle flow and ferry safety management, arrange corresponding specialized personnel to maintain ferry order and safety at the scene. Article 12 Ferry operators shall reasonably dispatch and use ferries according to the ship conditions, meteorological conditions and navigation conditions, and shall not direct ferries to operate illegally or sail at risk. Article 13 The department designated by the people's government at the county level shall strengthen the safety education and training for ferry operators, and be responsible for the training and assessment of ferry staff and the issuance of qualified certificates.
Ferry operators shall regularly conduct safety education and training for ferry staff, ferry crew and ferry workers. Article 14 The ferry operator shall urge the ferry to make statistics and truthfully record the number of passengers on the ferry and the transition personnel such as vehicle drivers per voyage, and conduct regular or irregular verification.
