Works of China citizens, legal persons or unincorporated entities, whether published or not, shall enjoy copyright in accordance with this Law. Foreign works first published in China shall enjoy copyright in accordance with this Law.

The copyright of works published by foreigners in China shall be protected by this law according to the agreement signed between the country to which they belong and China or the international treaties to which they are both parties.
