Chapter I General Provisions Article 1 In order to strengthen the planning and construction of primary and secondary schools and kindergartens, and promote the healthy development of education, these Measures are formulated in accordance with the Compulsory Education Law of People's Republic of China (PRC), the Urban and Rural Planning Law of People's Republic of China (PRC) and other laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the planning and construction of kindergartens, primary schools, junior high schools, ordinary senior high schools and special education schools within the administrative region of this province. Article 3 The planning and construction of primary and secondary schools and kindergartens shall follow the principles of overall urban and rural planning, scientific planning, rational layout and convenient enrollment, and ensure that the planning and construction of primary and secondary schools and kindergartens are compatible with the development of urban and rural population. Article 4 The people's governments at or above the county level shall strengthen the planning and construction of primary and secondary schools and kindergartens within their administrative areas, incorporate the special layout planning of primary and secondary schools and kindergartens into the national economic and social development plan, and link it with the national land and space planning, incorporate the construction funds into the fiscal budget of the government at the corresponding level, rationally allocate educational resources and promote the balanced development of education. Article 5 The education and natural resources departments of the people's governments at or above the county level shall be responsible for the specific work of the planning and construction of primary and secondary schools and kindergartens, and strengthen supervision and inspection; Housing and urban construction, development and reform, public security, finance and other departments should do a good job in the planning and construction of primary and secondary schools and kindergartens in accordance with their respective responsibilities. Article 6 The educational supervision institutions of the people's governments at or above the county level shall incorporate the implementation of special planning and construction of primary and secondary schools and kindergartens into the scope of educational supervision; The education supervision institutions of the provincial people's government shall organize and carry out special supervision on the implementation of special plans for primary and secondary schools and kindergartens at least once every two years.

The results of special supervision shall be announced to the public. Chapter II Planning and Layout Article 7 The people's governments at or above the county level shall scientifically determine the layout, school-running nature, service radius, quantity and scale of primary and secondary schools and kindergartens according to the relevant provisions of the state and this province and the number and distribution of school-age children within their administrative areas. Eighth districts of the city and county (city, district) people's government shall organize education, health, public security, statistics and other departments. Scientifically calculate the number of students (parks) per thousand population in this administrative area as the basis for the preparation of special plans for the layout of primary and secondary schools and kindergartens. Article 9 The education administrative departments of the people's governments of cities and counties (cities, districts) divided into districts shall, jointly with the departments of development and reform and natural resources, organize the preparation of special plans for the layout of primary and secondary schools and kindergartens.

The preparation of special plans for the layout of primary and secondary schools and kindergartens should comprehensively consider the population size, distribution, transportation, environment and urbanization process in this administrative region. Article 10 When organizing the preparation of special plans for the layout of primary and secondary schools and kindergartens, we should listen to the opinions of experts and the public and adopt reasonable and legal opinions or suggestions by holding symposiums, expert consultation meetings, demonstration meetings and hearings.

The administrative department of education shall publicize the basis and main contents of the special plan for not less than 30 days. Article 11 Special plans for the layout of primary and secondary schools and kindergartens in counties (cities, districts) shall be approved by the people's government at the corresponding level and submitted to the provincial people's government for the record.

The special plan for the layout of primary and secondary schools and kindergartens in cities with districts shall be reported to the Standing Committee of the People's Congress at the same level and the provincial people's government for the record after being approved by the people's government at the same level. Article 12 After the special layout planning of primary and secondary schools and kindergartens is approved, the municipal and county (city, district) people's governments shall make an announcement to the public within 20 days, and the contents of the announcement shall include the planning approval documents and the nature, quantity, scale and location of primary and secondary schools and kindergartens. The people's governments of cities and counties (cities, districts) with districts shall report to the people's government at the next higher level and the Standing Committee of the people's congress at the same level on the implementation of the special plan for the layout of primary and secondary schools and kindergartens in their respective administrative areas in the previous year before the end of each year. Article 14 The competent department of natural resources of the people's government at or above the county level shall incorporate the contents of the special planning for the layout of primary and secondary schools and kindergartens into the detailed planning of land space, which shall implement the construction land for primary and secondary schools and kindergartens in the land layout. The detailed planning of land and space involves primary and secondary schools and kindergartens, and the opinions of the administrative department of education shall be sought in writing before being submitted to the people's government at the same level for examination and approval. Fifteenth any unit or individual shall not arbitrarily change the special layout planning of primary and secondary schools and kindergartens. If it is really necessary to change due to public interests, it shall be handled in accordance with the provisions of Article 11 of these Measures. Sixteenth primary and secondary schools and kindergartens should be merged and restored in strict accordance with the procedural norms.

If it is really necessary to merge primary and secondary schools and kindergartens due to the reduction of students, the county (city, district) people's government shall make overall consideration of factors such as traffic safety for students going to and from school, study and living security for boarders, formulate a merger plan, and report it to the education administrative department of the provincial people's government for approval.

The merger plan shall solicit opinions from experts, parents of students, teachers and students of schools, township (town) people's governments, neighborhood offices, village (neighborhood) committees and other relevant parties through holding symposiums, expert consultation meetings, demonstration meetings, hearings and publicity.

When primary and secondary schools and kindergartens are merged, they should be built first. After the merger, the original campus building will give priority to the needs of local education.

If it is really necessary to restore the merged primary and secondary schools, kindergartens or teaching points, the county (city, district) people's government shall make plans and restore them according to procedures.
