On April 24th, 20 15, China Food and Drug Administration and State Administration for Industry and Commerce issued "Provisions on Supervision and Management of Enterprises Implementing the Responsibility of Food Safety Subjects", which came into effect on June 4th, 20 15. This regulation is mainly aimed at food producers and operators, and clarifies the main responsibility and supervision and management mechanism that enterprises should perform. Specifically, enterprises should strengthen food safety knowledge training and education, establish and improve food safety traceability, risk assessment, internal inspection and other systems; Strengthen the management of suppliers and agents, establish and implement product traceability system; Establish a complaint acceptance mechanism for substandard food, respond to consumer complaints in a timely manner, and take measures to deal with them. In addition, the regulations also require regulatory authorities at all levels to strengthen supervision and management of enterprises, take necessary supervision, inspection and punishment measures, disclose food safety information and records of illegal acts of enterprises, and expand social supervision.
What should enterprises do if they do not implement the main responsibility of food safety? The "Regulations" will impose administrative penalties such as fines, suspension of production and rectification on enterprises that fail to implement the main responsibility of food safety, and record them in market credit records. At the same time, the relevant personnel may face criminal responsibility. Therefore, enterprises should strictly implement the main responsibility of food safety to ensure food safety.
The Regulation on Supervision and Management of Enterprises Implementing the Main Responsibility of Food Safety has been officially implemented since 20151kloc-0/,which clarifies the main responsibility and supervision and management mechanism of food producers and operators. While strengthening the internal management of enterprises, it has also improved the supervision ability of supervision departments and made positive contributions to ensuring food safety.
Legal basis:
Article 122 of People's Republic of China (PRC) Food Safety Law violates the provisions of this law by engaging in food production and business activities without obtaining a food production and business license, or engaging in food additive production activities without obtaining a food additive production license, the food safety supervision and administration department of the people's government at or above the county level shall confiscate the illegal income, food additives and tools, equipment, raw materials and other items used for illegal production and business; If the value of food and food additives illegally produced and operated is less than 1 10,000 yuan, a fine of more than 50,000 yuan110,000 yuan will be imposed; If the value of goods is more than 1 10,000 yuan, a fine of more than 10 and less than 20 times shall be imposed. Knowing that it is an illegal act stipulated in the preceding paragraph, but still providing production and business premises or other conditions, the food safety supervision and administration department of the people's government at or above the county level shall order it to stop the illegal act, confiscate its illegal income and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan; Those who harm the legitimate rights and interests of consumers shall be jointly and severally liable with the producers and operators of food and food additives.
