According to the severity of road traffic safety violations, the scores of a score are 12, 6, 3, 2 and 1 respectively (Annex 2).
Article 56. Motor vehicle drivers' road traffic safety violations shall be punished and scored at the same time.
If a motor vehicle driver scores more than two times for an illegal act, the accumulation shall be calculated separately.
Article 57 If a motor vehicle driver refuses to accept the punishment for road traffic safety violations, and the original punishment decision is changed or revoked according to law after applying for administrative reconsideration or bringing an administrative lawsuit, the corresponding score shall be changed or revoked.
Article 58 If a motor vehicle driver scores 12 in a scoring cycle, the traffic administrative department of the public security organ shall detain his motor vehicle driver's license. The driver shall, within fifteen days, go to the traffic administrative department of the public security organ where the motor vehicle driver's license is issued or where the illegal act occurs to participate in the seven-day study of road traffic safety laws, regulations and related knowledge. After the motor vehicle driver takes part in the study, the vehicle management office shall take an examination of the road traffic safety laws, regulations and related knowledge within 20 days. Those who pass the examination shall be sorted out and returned to the motor vehicle driver's license; Those who fail the exam will continue to take part in the study and exam. Those who refuse to take part in the study or examination shall be notified by the traffic administrative department of the public security organ to temporarily suspend the motor vehicle driver's license.
If the motor vehicle driver reaches 12 twice or reaches 24 points in a scoring cycle, the vehicle management office shall also take the road driving skills test within 10 days after passing the road traffic safety laws, regulations and related knowledge test. Those who take the road driving skills test shall take the highest driving test specified in the motor vehicle driving license.
Article 59 If a motor vehicle driver scores less than 12 in a scoring cycle and has paid a fine, the score will be cleared; Although the score has not reached 12, there are still unpaid fines, and the score will be transferred to the next scoring cycle.
Section 2 Verification
Article 60 Drivers of motor vehicles shall, in accordance with the provisions of laws and administrative regulations, be regularly inspected by the traffic administrative department of the public security organ.
When a motor vehicle driver receives a motor vehicle driver's license in accordance with the provisions of Article 48 and Article 49, he shall be inspected by the traffic administrative department of the public security organ.
Drivers holding driver's licenses for large buses, tractors, city buses, medium-sized buses and large trucks shall go to the traffic management department of the public security organ for verification within 30 days after the end of each scoring cycle. However, if there is no scoring record in a scoring cycle, it will be exempted from verification in this scoring cycle.
If a driver who holds a driver's license other than that specified in the third paragraph of this article is equally responsible for the death caused by a traffic accident and his motor vehicle driver's license has not been revoked, he shall go to the traffic management department of the public security organ for verification within 30 days after the end of this scoring cycle.
Motor vehicle drivers who are engaged in operations in different places can directly participate in the inspection of the operating place after registering at the vehicle management office of the operating place for one year.
Sixty-first motor vehicle driver's license examination includes:
Road traffic safety violations and the handling of traffic accidents;
(2) physical condition;
(3) Score of road traffic safety violations and after taking the study exam 12.
Drivers who hold driver's licenses for large buses, tractors, city buses, medium-sized buses and large trucks and score points within a scoring cycle, and drivers who hold other drivers' licenses for quasi-driving, who have died due to traffic accidents, drivers whose motor vehicle driver's licenses have not been revoked shall attend at least three hours of knowledge study on road traffic safety laws and regulations, traffic safety and civilized driving, and emergency response. And accept the warning education of traffic accident cases.
Failing to deal with traffic violations or traffic accidents according to law, failing to meet the requirements of driver's license, and failing to participate in study, education and examination as required, the examination will not be given.
Sixty-second motor vehicle drivers over the age of 60 should have a physical examination once a year, and submit the physical condition certificate issued by medical institutions at or above the county level within 30 days after the end of the scoring period.
Motor vehicle drivers who hold a driver's license for small automatic passenger cars for the disabled shall have a physical examination every three years, and submit a physical condition certificate issued by a specialized medical institution designated by the Provincial Health Department within 30 days after the end of the scoring cycle.
Motor vehicle drivers shall declare their physical condition when they participate in the inspection in accordance with the third and fourth paragraphs of Article 60 of these Provisions.
Article 63 The driver of a motor vehicle is unable to prove, verify and submit the physical condition when the driver's license expires due to military service, going abroad (border) and other reasons. You can apply for an extension to the vehicle management office where the motor vehicle driver's license is issued. When applying, an application form shall be filled in, and the identity certificate of the motor vehicle driver, motor vehicle driver's license and reasons for extension shall be submitted.
The longest extension period shall not exceed three years. Motor vehicle drivers are not allowed to drive motor vehicles within an extended period of time.
Section III Supervision and Administration
Article 64 The internship period is 12 months after the motor vehicle driver applies for the motor vehicle driver's license for the first time and increases the number of quasi-driving models.
Get a new driver's license for large buses, tractors, city buses, medium-sized buses and large trucks. Within 30 days after the end of the internship period, the driver shall take the knowledge test on road traffic safety laws and regulations, traffic safety and civilized driving, and emergency response. And receive not less than half an hour of warning education on traffic accident cases.
When driving a motor vehicle during the internship period, a uniform internship sign shall be pasted or hung at the rear of the vehicle body (Annex 3).
Sixty-fifth motor vehicle drivers are not allowed to drive buses, operating buses, police cars, fire engines, ambulances, engineering rescue vehicles or motor vehicles carrying explosives, flammable and explosive chemicals, toxic and radioactive dangerous goods during the internship period; Driving a motor vehicle is not allowed to tow a trailer.
Driving a motor vehicle on the expressway during the internship period shall be accompanied by a driver who has held the corresponding driver's license for more than three years. Among them, driving a small automatic passenger car for the disabled can be accompanied by a driver who holds a driver's license for the small automatic passenger car or above.
During the internship period after the new quasi-driving model is added, driving the original quasi-driving motor vehicle is not subject to the above restrictions.
Article 66 When driving a motor vehicle, a motor vehicle driver who holds a small automatic passenger car for the disabled who is allowed to drive shall set a motor vehicle sign for the disabled on the vehicle body in accordance with regulations (Annex 4).
Motor vehicle drivers with hearing impairment should wear hearing AIDS when driving motor vehicles.
Article 67 If a motor vehicle driver is under any of the following circumstances, his motor vehicle driver's license shall be cancelled by dmv:
(1) is dead;
(2) applying for cancellation;
(three) the guardian loses his capacity for civil conduct and applies for revocation;
(four) the physical condition is not suitable for driving a motor vehicle;
(5) Organic heart disease, epilepsy, Meniere's disease, vertigo, hysteria, paralysis agitans, psychosis, dementia, nervous system diseases affecting limb movements and other diseases that hinder safe driving;
(6) driving a motor vehicle after being found taking or injecting drugs and taking measures such as community detoxification, compulsory isolation detoxification and community rehabilitation, or taking psychotropic drugs for a long time;
(seven) the motor vehicle driving license has not been renewed for more than one year;
(8) Being over 60 years old and failing to submit the physical condition certificate within one year after the end of a scoring cycle; Or holding a small automatic passenger car for the disabled, and failing to submit the physical condition certificate within one year after the end of three scoring cycles;
(nine) motor vehicle driver's license is 60 years old, only equipped with trolleybuses and trams, or 70 years old, only equipped with low-speed trucks, tricycles and wheeled bicycles;
(ten) the motor vehicle driver's license is revoked or revoked according to law.
If the motor vehicle driver's license has not been recovered under any of the circumstances from Item (4) to Item (10) of the first paragraph, the motor vehicle driver's license shall be declared invalid.
Under any of the circumstances in Item (7) and Item (8) of the first paragraph, if the motor vehicle driver's license has not been cancelled for more than two years, the motor vehicle driver may resume his driving qualification after passing the road traffic safety laws, regulations and related knowledge examination.
Article 68 If a driver holding a driver's license for a large bus, tractor, city bus, medium-sized bus or large truck is under any of the following circumstances, the vehicle management office will cancel his driving qualification with the highest driver's license and notify the motor vehicle driver to handle the business of demotion and replacement within 30 days:
(a) a traffic accident that causes death and bears the same or more responsibilities does not constitute a crime;
(2) There is a record of 12 in a scoring cycle;
(three) did not participate in the verification for three consecutive scoring cycles.
If the motor vehicle driver fails to handle the business of demotion and replacement within the specified time, the vehicle management office will announce the cancellation of the driving qualification of the quasi-driving type.
Article 69 A motor vehicle driver who has scored 12 points during the internship period will be disqualified from driving as a trainee. If the cancelled driving qualification does not belong to the highest permitted driving type, the driving qualification of the highest permitted driving type shall also be cancelled in accordance with the provisions of the first paragraph of Article 68.
Drivers who have obtained driver's licenses for buses, tractors, city buses, medium-sized buses and large trucks, who have scored more than 6 points during the one-year internship period but have not reached 12 points, will be extended for one year. During the extended internship period, those who score more than 6 points but fail to reach 12 points will be disqualified from driving.
Article 70 If the telephone number, address and other information of the driver of a motor vehicle changes, and the employer information of the driver who holds the driver's license of a large bus, tractor, city bus, medium bus or large truck changes, it shall be filed in dmv, where the driver's license is issued, within 30 days after the information changes.
Article 71 A road transport enterprise shall regularly report to the traffic administrative department of the local public security organ for the employment of motor vehicle drivers, urge the timely handling of road traffic safety violations and traffic accidents, and participate in the examination and verification of motor vehicle driving licenses.
The traffic administrative department of the public security organ shall inform the traffic administrative department and transportation enterprises within its jurisdiction of the illegal acts, scoring and traffic accidents of motor vehicle drivers every month.
Section 4 Management of School Bus Drivers
Seventy-second school bus drivers should obtain school bus driving qualifications according to law.
To obtain the school bus driving qualification, the following conditions shall be met:
(a) to obtain the corresponding driving license, with more than three years of driving experience, at the age of 25 years old and under 60 years old;
(2) No score of 12 was recorded in the last three consecutive scoring cycles;
(3) There is no record of traffic accident liability that causes death or serious injury;
(4) No record of drunk driving or drunk driving of motor vehicles, and no record of serious traffic violations such as overcrowding and speeding of passenger vehicles in the last year;
(5) Having no criminal record;
(six) physical and mental health, no infectious diseases, no history of epilepsy, mental illness and other diseases that may endanger driving safety, no record of alcoholism and drug abuse.
Article 73 When applying for school bus driving qualification, a motor vehicle driver shall apply to the traffic management department of the public security organ at the county level or at the municipal level with districts, fill in the application form and submit the following documents and vouchers:
The identity certificate of the applicant;
(2) Motor vehicle driving license;
(3) A certificate issued by the public security organ at the county level where the household registration is located that there is no crime and drug abuse record;
(4) Physical condition certificate issued by medical institutions at or above the county level.
Article 74 The traffic administrative department of the public security organ shall complete the examination and approval within five days from the date of receiving the application materials. To meet the requirements, the motor vehicle driver's license shall be endorsed to allow driving school buses and corresponding models, and the education administrative department shall be notified; Do not meet the conditions, it shall explain the reasons in writing.
Seventy-fifth school bus drivers should go to the traffic management department of the public security organ for verification within 30 days after the end of each scoring cycle. When issuing the certificate, the medical institution at or above the county level shall submit the physical condition certificate, participate in the study of road traffic safety laws and regulations, traffic safety and civilized driving, emergency handling and other knowledge for not less than three hours, and accept the warning education of traffic accident cases.
Article 76 The traffic administrative department of the public security organ shall establish an information exchange mechanism with the administrative department of education and schools to inform the school bus drivers of traffic violations, traffic accidents and inspections. Every month.
Article 77 If a school bus driver is under any of the following circumstances, the traffic administrative department of the public security organ shall cancel his school bus driving qualification, notify the motor vehicle driver to renew his motor vehicle driving license, and notify the education administrative department and the school:
(a) apply for cancellation;
(2) At least 60 years old;
(3) Being responsible for traffic accidents that cause death or serious injury;
(four) drunk driving or drunk driving motor vehicles, passenger vehicles, speeding and other serious traffic violations;
(5) Having scored 12 or having a criminal record;
(six) suffering from infectious diseases, epilepsy, mental illness and other diseases that may endanger driving safety, and having a record of drinking and taking drugs.
If the motor vehicle driver's license endorsed by the school bus driver's license has not been recovered, the school bus driver's qualification will be declared invalid.
