According to the deployment of the 13th legislative plan of the National People's Congress Standing Committee (NPCSC), in order to improve the academic degree law system in China, promote the development of postgraduate education and improve the quality of academic degree work, the Ministry of Education, on the basis of in-depth investigation, studied and formulated the Academic Degree Law of People's Republic of China (PRC) (Draft for Comment). The draft clarifies the conditions and procedures for awarding several types of degrees and stipulates how to deal with academic misconduct. ? The provisions on the revocation of academic degrees in the draft are as follows: academic degree evaluation committee may decide not to grant academic degrees if an applicant commits academic misconduct, forgery, etc. during his study in the degree-granting unit, as well as during his degree application, peer review and defense. A person who has obtained a degree has one of the following circumstances in the process of obtaining a degree. After deliberation and decision by academic degree evaluation committee, the degree-granting unit revokes the degree, withdraws or declares the degree certificate invalid:

(1) There are serious academic misconduct such as plagiarism, forgery, plagiarism and tampering with data in the dissertations or practical achievements, and the quality is not up to standard;

(2) Obtaining the admission qualification or graduation certificate by any improper means such as impersonation or malpractice for personal gain;

(3) There are other illegal acts that should not be awarded degrees during the study period.

At the same time, the "Draft" clearly stipulates that if the educated person refuses to accept the resolution or decision not to accept his degree application, and the degree winner disagrees with the resolution or decision to revoke his degree, he may complain to the degree-granting unit. Citizens, legal persons and other relevant organizations who have objections to the resolutions and decisions on conferring academic degrees may raise objections to the degree-conferring units. Each degree authorization point shall review and make a review decision within 90 days from the date of receiving the complaint or objection. If there is any objection to the review conclusion, it may apply for administrative reconsideration or bring an administrative lawsuit according to law. Feedback will be closed on April 15.
