Three ways of educational legal relief
Legal analysis: 1. The way of teachers' legal relief refers to the channel or way for teachers to ask for solution or compensation when they think their rights and interests have been damaged. Generally, it can be divided into three types: judicial relief, administrative relief and social relief. 2. Judicial relief means that when teachers' basic rights granted by the Constitution and laws are infringed, the people's courts should provide effective relief for such infringement, and give necessary and appropriate compensation to the infringed teachers, so as to alleviate their living difficulties to the maximum extent and protect their legitimate rights and interests, so as to maintain judicial harmony based on the balance of interests to the maximum extent. 3. Administrative relief means that teachers think that a specific administrative act directly infringes on their legitimate rights and interests, request the competent state organs to correct illegal or improper administrative acts according to law, and investigate their administrative responsibilities to protect the legitimate rights and interests of the administrative counterpart. 4. Social relief means that the state and society ensure that every citizen enjoys the basic right to life and provide material help to poor teachers.

Legal basis: Article 35 of "People's Republic of China (PRC) Teachers Law" insults or beats teachers, and according to different situations, they shall be given administrative sanctions or administrative penalties respectively; Causing damage, shall be ordered to compensate for the losses; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law.

Article 36 Whoever retaliates against a teacher who files a complaint, accusation or report according to law shall be ordered to make corrections by his unit or higher authorities; If the circumstances are serious, administrative sanctions may be given according to the specific circumstances. State functionaries who retaliate against teachers, which constitutes a crime, shall be investigated for criminal responsibility in accordance with the relevant provisions of the Criminal Law.
