Regulations of Chongqing Municipality on the Promotion of Family Education

(Adopted at the 25th meeting of the Standing Committee of the Fourth Chongqing Municipal People's Congress on May 27th)

Chapter I General Provisions

Article 1 In order to promote the development of family education, promote the all-round healthy growth of minors, and promote family happiness and social harmony, these Regulations are formulated in accordance with the Education Law of the People's Republic of China, the Law of People's Republic of China (PRC) on the Protection of Minors and other laws and administrative regulations, combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to the implementation, guidance and service of family education within their respective administrative areas.

Article 3 Family education as mentioned in these Regulations refers to the education and influence of parents or other guardians on minor children.

Article 4 Family education follows the principles of family responsibility, school guidance, social participation and government promotion.

Article 5 Parents or other guardians are directly responsible subjects of family education and undertake family education obligations according to law.

Article 6 Promoting the healthy development of family education is the common responsibility of the government, society and every family.

State organs, people's organizations, social organizations, village (neighborhood) committees, enterprises, institutions and individuals shall provide support for family education.

Article 7 The people's governments of cities, districts and counties (autonomous counties) shall incorporate the development of family education into the national economic and social development plan, and include the funds for family education in the fiscal budget at the corresponding level.

Article 8 The Working Committee on Women and Children of the people's governments of cities, districts and counties (autonomous counties) is the deliberation and coordination body of family education within their respective administrative areas, and is responsible for organizing, coordinating, guiding and urging relevant departments to do a good job in family education. The Women's Federation (hereinafter referred to as the Women's Federation) is responsible for the daily work of the family education deliberation and coordination mechanism.

City, county (Autonomous County) women's federations and education administrative departments are responsible for guiding and promoting family education.

Civil affairs, health and family planning, public security and other departments and organizations concerned about the next generation should do a good job in family education according to their respective responsibilities.

Ninth every year in the third week of May Monday for the city's family education day.

Chapter II Family Implementation

Article 10 Parents or other guardians shall educate their minor children on social morality, family virtues, life skills, behavior habits, physical and mental health and other provisions of laws and regulations, so as to promote the all-round development of minors.

Eleventh parents or other guardians should learn family education knowledge, establish a correct concept of family education, master scientific methods of family education, and improve family education ability.

Article 12 Parents or other guardians should educate and influence the healthy growth of minors with healthy thoughts and good conduct.

Family members should jointly cultivate a positive and healthy family culture, inherit a good family style and build an equal and harmonious family education environment.

Thirteenth parents should live with minor children and perform their guardianship duties according to law.

Parents who do not live with minor children shall perform the following obligations:

Entrust other adults or institutions with guardianship to educate minor children;

(two) through various means to communicate with minor children and other guardians and schools, to understand the life, study and psychological status of minor children, and to reunite with minor children on a regular basis;

(3) Other obligations stipulated by laws and regulations.

Fourteenth parents or other guardians shall cooperate with relevant state organs, social organizations and village (neighborhood) committees to carry out family education and guidance activities according to law.

Fifteenth parents or other guardians should accept the guidance of the school's family education and participate in family education activities organized by the school's parents' committee and parents' school.

Parents or other guardians should take the initiative to communicate with the school about the study and life of minor children, and cooperate with schools and other educational institutions to educate minor children.

Article 16 If a minor's parents divorce, both parties shall continue to jointly fulfill their obligations of family education for minor children. When one party performs the obligation of family education, the other party shall cooperate.

Adoptive parents and stepparents who have formed a relationship of upbringing and education with their stepchildren shall fulfill their obligations of family education for underage foster children and stepchildren.

Seventeenth minor children should accept the education of their parents or other guardians and participate in family education activities carried out by schools and community (village) family education guidance institutions.

Article 18 If a parent or other guardian is under any of the following circumstances, a minor may report, complain or ask for help to the school, the unit where the parent or other guardian belongs, the village (neighborhood) committee, the women's federation, the civil affairs department and the minor protection organization, or report the case to the public security organ, and the relevant units and organizations shall handle it in time:

(1) Failing to perform family education duties, leaving minor children unattended or in a dangerous state;

(two) the use of violence, insult and other ways to implement family education;

(three) due to the death of parents, missing, seriously ill, severely disabled, or both parents are serving sentences, compulsory detoxification and other circumstances can not perform the duties of family education.

Other units and individuals may report to the relevant units and organizations if they find the situations listed in the preceding paragraph, or minor children think that the education of their parents or other guardians is harmful to their physical and mental health.

Chapter III School Guidance

Nineteenth primary and secondary schools and kindergartens should establish and improve the family education system and incorporate family education into the school work plan.

Twentieth primary and secondary schools and kindergartens should incorporate family education into the professional training of teaching staff and establish a family education team.

Twenty-first teacher training institutions should incorporate family education courses into the teacher training plan.

Encourage normal universities and other qualified institutions of higher learning and research institutions to offer family education majors or courses and carry out family education research.

Twenty-second primary and secondary schools and kindergartens should regularly carry out family education guidance and exchange activities.

Primary and secondary schools and kindergartens shall set up parent committees and parent schools to provide parents with family education advice and guidance.

Parents' schools in primary and secondary schools should carry out family education activities more than twice each semester. Kindergarten parent schools should carry out family education activities more than three times each semester.

Twenty-third parents or other guardians do not participate in school family education activities according to regulations, the school should contact and communicate with them in time.

If a minor violates discipline, law or other bad or improper behavior at school, the school shall promptly inform his parents or other guardians. If parents or other guardians cannot be informed, or if they still fail to perform their family education responsibilities after being informed, the school shall inform their unit or village (neighborhood) committees.

If parents or other guardians have difficulty in performing their family education duties, the school shall provide family education guidance and help in time.

Twenty-fourth primary and secondary schools, kindergartens and normal colleges shall assist local family education guidance institutions to carry out family education guidance.

Chapter IV Social Participation

Twenty-fifth for marriage and divorce registration, the marriage registration agency shall give publicity and guidance to the applicant's family education.

Twenty-sixth maternal and child health centers and other medical service institutions shall organize family education publicity and guidance.

Encourage medical service institutions and other social organizations to establish schools for pregnant women and parents of newborns, and carry out public welfare early family education and guidance.

Twenty-seventh foster care, foster care institutions or families shall fulfill the obligations of family education.

Children's social welfare institutions shall provide family education and guidance services for families adopting orphans.

Minors who are vagrants and beggars or run away from home shall be provided with temporary care and psychological counseling, emotional comfort and other services. The minor rescue and protection institution where the household registration is located shall give family education guidance to its parents or other guardians, and include the performance of family education obligations in the guardianship assessment.

Article 28 State organs, enterprises, institutions and social organizations are encouraged to incorporate family education into the construction of unit culture, and take family education as an important content in the selection of civilized workers, civilized families and civilized units, so as to create conditions and provide support for employees to implement family education.

Parents and other guardians should participate in family education activities in schools, and their units should support them.

Encourage state organs, social organizations, enterprises and institutions to provide public welfare family education guidance services for employees.

Twenty-ninth institutions and organizations that provide public services for women and children should carry out public welfare family education and guidance.

Thirtieth the establishment of operating family education service institutions or provide operating family education services, shall apply to the industrial and commercial departments for registration. The registration authority shall register it according to law.

Thirty-first to encourage social work service agencies and voluntary service organizations to carry out family education volunteer service.

Thirty-second encourage the establishment of family education funds or family education funds according to law to support the development of family education.

Encourage units and individuals to donate to family education funds, family education funds and family education social organizations. Donation expenses of donors shall be deducted before tax in accordance with relevant state regulations.

Chapter V Guarantee and Incentive

Article 33 The people's governments of cities, districts and counties (autonomous counties) shall incorporate family education guidance services into urban and rural public services and establish a family education guidance service system in urban and rural areas.

Article 34 The people's governments of cities, districts and counties (autonomous counties) shall provide family education guidance for minors and their families, and give priority to providing family education aid and guidance services for families of minors such as orphans, disabled, left behind, mobile, abandoned, homeless, single parents or parents serving sentences, and compulsory drug rehabilitation, and families in poverty-stricken areas and ethnic minority areas.

Article 35 The people's governments of cities, districts and counties (autonomous counties) shall establish a family education and training system, formulate a training plan for family educators, organize the compilation of family education and training materials, and train family education professionals.

The Municipal People's Government shall formulate an outline of family education, determine the key contents of family education according to the age stage, physical and mental development laws and characteristics, and living environment of minor children, and guide parents or other guardians to implement family education.

Thirty-sixth cities, districts and counties (autonomous counties) people's governments and relevant administrative departments may purchase public services for family education from social organizations. Under the same conditions, social work service agencies and voluntary service organizations can give priority to purchasing public services for family education.

Article 37 The people's governments of cities, districts and counties (autonomous counties) shall make use of various media and propaganda means to popularize family education knowledge and create a cultural atmosphere for family education.

Radio, television, newspapers, internet and other media should popularize family education knowledge and carry out regular and public welfare publicity in various forms such as special programs, special reports, columns and public service advertisements.

Article 38 The people's governments of cities, districts and counties (autonomous counties) shall improve policies and measures for the admission, schooling and housing of minor children of migrant workers, and ensure that minor children can attend school (study), take exams and live in their parents' workplace nearby.

Article 39 The people's governments of cities, districts and counties (autonomous counties) shall formulate family education plans and annual work plans, incorporate family education into educational supervision matters, establish a family education supervision and evaluation system, and commend and reward units and individuals who have made outstanding achievements and contributions in family education.

Fortieth township (town) people's governments and sub-district offices shall incorporate family education into the community education system and carry out family education guidance activities four times a year.

The village (neighborhood) committees shall assist the township (town) people's governments and neighborhood offices to carry out family education and accept family education for help.

Chapter VI Legal Liability

Forty-first parents or other guardians do not perform or improperly perform their duties of family education, and infringe upon the legitimate rights and interests of minors, the relevant units and organizations shall warn, criticize and educate them according to law or report to the public security organs; After receiving the report, the public security organ shall deal with it in time and give admonition, warning or administrative punishment according to the circumstances; If a crime is constituted, criminal responsibility shall be investigated according to law.

If parents or other guardians fail to perform their family education duties according to law and do not change after education, the people's court may, on the application of the relevant personnel or units, revoke their guardianship qualification and appoint another guardian.

Forty-second family education service institutions are not registered according to law, or violate the provisions of laws, regulations and rules in educational activities, and shall be dealt with by the relevant competent departments according to law.

Forty-third departments, institutions and organizations responsible for family education guidance and management are under any of the following circumstances, and their units or higher authorities shall order them to make corrections; If the circumstances are serious, the directly responsible person in charge and other responsible personnel shall be punished according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) do not perform the duties of family education, family education policies and measures are not implemented;

(two) interception, misappropriation, misappropriation or false, impersonator family education funds;

(3) Being defrauded of family education funds due to dereliction of duty;

(four) minors in accordance with the provisions of Article 19 of this Ordinance to the relevant units or organizations for help, the relevant units or organizations to exercise their functions and powers or prevarication, resulting in serious consequences;

(five) other acts of abuse of power, dereliction of duty or favoritism.

Chapter VII Supplementary Provisions

Article 44 These Regulations shall come into force on September 1 year 1 day.
