Last semester of my senior year, I ushered in my graduation internship. This internship is scheduled for six weeks after the start of school. Its main purpose is to let us combine what we have learned in school with practice, and further deepen our understanding and mastery of legal knowledge through our understanding of judicial practice.
I am an intern in XX County People's Court this time. The people's court of Xx county is a grass-roots court, which consists of four civil courts, two criminal courts, 1 administrative court, six courts (namely, XX village court, XX town court, XX town court, and XX town court), as well as filing court, high court, trial supervision court and executive board. I was assigned to the people's court, mainly responsible for hearing contract disputes, and then stayed in the executive board for a while. My work here is mainly to organize files, attend court trials, practice writing judgments, and go to the client's residence several times with other staff.
Second, an overview of the internship process
When we went to practice, the teacher told us that the key to learning anything in practice is not teachers and judges, but ourselves. Only by observing and exploring with a pair of knowledgeable eyes can we learn something. Moreover, the teacher repeatedly stressed the importance of internship, especially asking us to take it seriously.
On the first day of internship, after confirming the internship position, I reported to the People's First Court. The people's court is in session, so I sit in the gallery and listen. This is a relatively simple contract dispute case, and the trial procedure goes very fast. After the parties refused to mediate, the court heard the final statements of the parties, and the judge announced that the collegial panel would decide on a date after the meeting and the trial was over. In the afternoon, I was arranged to file a case in court.
From the next day, I rushed to the court at about 8 o'clock every day 15 to clean up the health in the courtyard first. Our court basically opens every morning. When there is no court session and no specific work, I will attend other courts. Eat after work at noon 1 1: 40. There were very few court sessions in the afternoon, because the morning trial was not over and only one session continued in the afternoon. In addition, most of the work is to organize files (mainly sorting, binding and registration). The president also arranged for me to practice writing judgments, and asked me to write a judgment every three days after the trial, and then submit it to the president for revision. Staying in the executive board for a few days is not only to accompany senior executives out to investigate and collect evidence or serve subpoenas and execution orders, but also to sort out files.
Third, the main situation and experience of internship
During my internship, I mainly did the following work:
1, organize files. During the internship, help judges and clerks to sort out multiple files. There are many typical cases in these concluded cases, involving the determination of facts, the admissibility of evidence, the division of responsibilities and so on. In this process, I read the file and consulted the clerk, and got a detailed understanding of the process of contract dispute cases from filing to closing and the classification of various filing documents.
2. Listen to this case. With the rapid development of market economy, people's awareness of legal rights has been continuously enhanced, and there are fewer dispute resolution institutions in non-litigation procedures such as arbitration, resulting in relatively more cases in people's courts, which are on the rise year by year. This is a good thing for me, there are enough cases to participate in. Mock trial, I have participated in criminal cases in school before. Criminal cases pay great attention to procedures and the trial is serious. But here, after attending the civil trial, I feel that the trial is more casual and the atmosphere is more relaxed, omitting some procedural issues. Through auditing cases, I have a detailed understanding of the characteristics and procedures of civil trial, and realize that the key to civil trial lies in resolving the contradictions between the parties and promoting social harmony. Different from criminal cases, which mainly reflect the coercive power of the state to punish crimes, the ideal result of civil cases should be to achieve a win-win situation for both parties without losing legal dignity, which requires judges to have higher personal qualities. This quality requires not only profound knowledge of law, but also high personality charm of judges.
3. Write legal documents. During my six-week internship, I helped the dean draft seven civil judgments, and there were many mistakes in the writing process. The basic format of the judgment is the head, facts, reasons, judgment and tail. Write the basic information of the parties first, then the original statement, the plaintiff's claim, facts and reasons, and then write the "defense of the defendant", which contains the reasons and facts of the defendant's defense. Then, it is the part of "finding out through trial", which writes the reasons for the court to accept and reject the evidence and the facts identified. After that, the court thought that the reasons for the judgment and the law on which it was based were stated, and finally the judgment result was written. After I finished writing the first judgment, I gave it to the president, who made many amendments to the judgment I wrote.
He said: "What you wrote earlier is ok, but there are many problems in the part of' found out through trial', such as imprecise wording, nonstandard language, too simple statement, imprecise logic and insufficient persuasion." Indeed, when I wrote the part of "trying to find out", I wrote it in too general terms. The president said that this part should analyze all the relevant facts of the case and write the reasons for accepting and rejecting the evidence, because the judgment should be read by the plaintiff and the defendant, who may not understand the law. As a writer of legal documents, you should let both parties read it, and make a logical analysis of the facts found in the judgment to reach the same judgment as the judgment, so as to make the judgment convincing.
My judgment only analyzes some controversial facts between the plaintiff and the defendant, and I can't take it for granted that my judgment is made from my "found through trial" and "the court thinks". I studied the course of legal document writing in my second year of high school, but at that time I thought it was just an examination course and I didn't study hard. Now I regret that I didn't study this course well at school, so I can't finish the work given to me by the judge during my internship. After returning to school, I will try my best to supplement my knowledge of official document writing, hoping to finish it well when I encounter similar situations next time.
4. Follow the person subjected to execution to the place where the subject matter is executed. Generally, it is difficult to execute cases in the execution stage, and some of them are that the person subjected to execution really has no money and can't pay compensation, that is, there is no property to execute; There is another kind of person who has money but still can't carry it out smoothly. Most of these executed persons transfer or hide their property in advance because they are familiar with the law. There was once a case in which the applicant knew that the executed person had deposited the money in the bank, but the executed person did not find the respondent's account after inquiring, and must have deposited the money in someone else's account. For this kind of cases, if all departments coordinate and cooperate, the execution efficiency will be greatly improved.
During my internship, I took advantage of this rare opportunity to work hard, be strict with myself, humbly ask the judge for advice, study laws and regulations, and use my spare time to seriously study some related knowledge outside the textbooks, master some basic legal skills, further consolidate my knowledge and lay the foundation for real legal practice in the future.
"I feel very shallow on paper and don't know how to do it." During my short internship, I deeply felt the superficiality of my knowledge and the lack of professional knowledge. At first, I was at a loss about some work, which made me feel very sad. When I was at school, I always thought I was doing well. Once you come into contact with reality, you find that you know very little and need to learn a lot. At this time, I really realized the true meaning of "endless learning".
The above may be my personal feelings, but there is one thing that students who participate in the internship should know: our legal education is far from the requirements of practice. Law is a practical discipline, which needs the guidance of theory, but its development and significance can only be realized in practice, and its main purpose is to serve social practice. Therefore, our law education should be more closely integrated with practice. When adopting the mode of combining theory with practice, we should attach importance to practice and increase the proportion of practice.
During my internship, I found it very important to popularize the law and improve citizens' legal awareness. In order to promote the construction of the rule of law, our country has carried out legal education activities for many years, which has made great achievements, and people's legal concept and legal consciousness have been greatly improved. In several cases in which I participated in the audit, the parties did not ask a lawyer, but defended themselves. The laws they used and the reasons for defense were in place.
Although China has made great achievements in popularizing law, it is undeniable that the depth and breadth of popularizing law are still insufficient. For example, sometimes, people know the legal provisions, but fail to understand them correctly, so that they violate the law without knowing it; Some parties usually do not pay attention to protecting their legitimate rights and interests by law, which eventually leads to deepening contradictions and going to court, thus avoiding cases resolved through judicial channels occupying judicial resources. There are still some parties in society who don't trust the law and question the fairness and justice of the law. Therefore, China should and must strengthen the implementation and popularization of the legal system, and gradually establish people's faith in the law. Only in this way can the construction of the rule of law make great progress.
This month's internship made me deeply realize that besides having good professional quality, it is also important to maintain good relations with colleagues at work.
