The reform of government purchasing services is an important reform work deployed by the CPC Central Committee and the State Council. In 20021year, various regions and departments actively promoted the reform of government purchasing services, and achieved remarkable results, which played an important role in improving people's lives, promoting economic and social development, and helping COVID-19 to prevent and control the epidemic. However, in the process of reform, there are still some problems, such as nonstandard management of government purchase service contract, further strengthening of performance management, inaccurate grasp of purchase boundary, and uneven progress of government purchase service reform in public institutions. It is necessary to further intensify the reform of government purchasing services and standardize the management of government purchasing services. In 2022, the task of economic and social development is heavy and there are many challenges. The CPC Central Committee and the State Council put forward development goals and tasks, such as accurately providing basic public services, strengthening urban and rural community service functions, vigorously expanding employment channels, improving medical and health service capabilities, optimizing the supply of aged care services, and promoting education equity and quality improvement. In order to further implement the important decision-making arrangements of the CPC Central Committee and the State Council on promoting the reform of government purchasing services, strengthen the implementation of government purchasing services policies, and give full play to the positive role of government purchasing services in improving public services, innovating social governance, and enhancing the performance of government expenditures, the relevant matters concerning the key work of government purchasing services reform in 2022 are hereby notified as follows:
First, further intensify the reform of government procurement services in key areas.
Fully understand the great significance of implementing the reform of government procurement services, respect the law of reform and objective reality, coordinate the needs and financial resources of the masses, persist in doing our best and do what we can, take effective measures to further promote the reform of government procurement services in key areas, continuously improve the quality and efficiency of public services, continuously improve people's livelihood and well-being, effectively support the cultivation and development of market players, and effectively strengthen and innovate social governance.
(a) actively promote the government to buy public services in urban and rural communities. According to the relevant requirements of the State Council on the construction of urban and rural community service system during the Tenth Five-Year Plan period, we will encourage social forces to undertake market-oriented services, improve the efficiency of urban and rural community services, and promote the construction of urban and rural community public service system through government purchase in the areas of community pension, child care, disability assistance, correction, care for minors, employment, health, education, culture, sports, popular science, law and emergency.
(2) Increase the government's efforts to purchase public health services. In order to meet the needs of normalization of epidemic prevention and control in COVID-19, the government should be encouraged to purchase services to carry out epidemic prevention and control work such as nucleic acid detection, disinfection and sterilization, epidemic prevention propaganda and other public health services, so as to improve its ability to respond to public health emergencies.
(3) Promote the government to purchase basic old-age services. Actively respond to the aging of the population, encourage qualified areas to pragmatically expand the scope and scope of government purchase of old-age services, optimize the supply of urban and rural old-age services, and support social forces to provide services such as day care, food cleaning, and rehabilitation care. Priority should be given to ensuring the service needs of the disabled and unattended elderly with financial difficulties, and increasing support for grassroots and rural old-age services. It is suitable for purchasing the pension services provided by the government, and the government no longer directly organizes public pension institutions to provide them. The pension services that really need to be provided directly by the government should give full play to the role of public pension institutions.
(4) Encourage the government to purchase public employment services. Expand the supply of employment services through the government's purchase of services, and provide more targeted employment services such as career introduction and career guidance for workers; For the unemployed, college graduates, retired soldiers, migrant workers, the disabled, zero-employment family members and other groups to carry out employment assistance measures such as employment and entrepreneurship training, vocational skills training, and promote more adequate and higher-quality employment in society.
(5) Do a good job in government procurement of public education services. In the fields of non-compulsory education such as preschool education and vocational education, we will actively explore and promote the reform of government purchasing services, and support the increase of inclusive education resources and improve the quality and efficiency of education services through innovative ways such as issuing student vouchers and purchasing degrees (services). Do a good job in the government's purchase of degrees (services) in compulsory education, standardize the purchase behavior, and promote the balanced development of compulsory education. Encouraging the government to purchase high-quality online education services, promoting the development of educational informatization and resource sharing, is conducive to the development of fairer and better education.
(six) continue to promote the reform of government procurement services in other fields. We will continue to intensify the reform of government procurement services in public service areas closely related to people's livelihood, such as helping the disabled, law, young social workers, culture and sports, transportation, social assistance, and public rental housing operation management, so as to improve the quality and efficiency of public services and achieve accurate supply.
Two, strictly regulate the management of government procurement services.
Carry out purchasing work in strict accordance with the relevant provisions of the government purchasing service system, strengthen the whole process management of government purchasing services, and strive to improve the standardization, refinement and informatization level of government purchasing service management.
(1) Standardize and adjust the settings of the guidance directory. The central departments that have not yet formulated the guiding catalogue of government procurement services should carry out the catalogue compilation work in accordance with the Notice of the Ministry of Finance on Printing and Distributing the Guiding Catalogue of Government Procurement Services at the Central Level (Caizong [2020] No.57), and complete it before the end of June 2022, and report it to the Ministry of Finance (comprehensive department and departmental budget management department) for the record. All localities should standardize the compilation of the guidance catalogue for local governments to purchase services, and the first-level catalogue and the second-level catalogue compiled by the provincial financial department should be consistent with Caizong [2020] No.57 document. The three-level catalogue is determined by all localities according to local actual conditions. If it can be consistent with Caizong [2020] No.57 document, it should be consistent. All localities can set the following three categories according to the actual work needs. Provincial financial departments should complete the adjustment and compilation of the general catalogue before the end of September 2022.
(2) Strengthening the management of government procurement service contracts. The government should strictly abide by the Civil Law of People's Republic of China (PRC), the Government Procurement Law of People's Republic of China (PRC) and its implementing regulations, the Measures for the Administration of Government Procurement of Services and other relevant laws and regulations, improve the contract elements, clarify the relevant responsibilities and supervision and management requirements of the purchaser and the contractor, and prevent various risks in the performance of the contract. Shall not exceed the statutory time limit to sign a government purchase service contract. The purchaser should strengthen the performance management of the government's service purchase contract, track the performance of the service purchase contract in time, ensure the strict implementation of the contract, and effectively change the phenomenon of "emphasizing procurement over management" in some localities and departments. All regions and departments can study the rights and obligations, risk prevention and control and other matters in the performance of specific services such as pension, employment, education and health according to the characteristics of different fields.
(3) Improve the budget management of government purchasing services. Strengthen the evaluation of the government's financial affordability of purchasing services, and the government's expenditure on purchasing services should be included in the budget. For matters not arranged in the budget, no purchase service may be carried out. The implementation of people's livelihood policy management requirements, services that do not meet the relevant management requirements and fail to fulfill the relevant prescribed procedures shall not be included in the government's purchase of services. Improve the performance management chain of government procurement services and implement the whole process performance management. We should do a good job in pre-evaluation of major government-purchased services. Strengthen demand management, reasonably determine the demand for purchasing services on the basis of fully conducting demand investigation, clarify relevant service contents, service standards and technical support, and strengthen the integrity, compliance, rationality review and risk management of purchasing service demand and procurement implementation plan. Strengthen the monitoring of government purchasing services, strengthen the application of performance evaluation results, and handle the relationship between project performance evaluation and performance acceptance. Reasonable use of third-party performance evaluation, not to use third-party performance evaluation to shirk the responsibility that should be directly performed by the government.
(four) it is strictly prohibited to include the prohibited items in the scope of government procurement services. In accordance with the Measures for the Administration of Government Procurement of Services (DecreeNo. Ministry of Finance 102), etc., standardize the work of government procurement of services, accurately grasp the scope of government procurement of services, and prohibit outsourcing of matters that should be directly performed by the government, and prohibit borrowing or employing people in disguised form in the name of government procurement of services. Financial departments at all levels should play a good supervisory role and find violations of laws and regulations for rectification within a time limit.
Third, continue to promote the reform of government procurement services in public institutions.
According to the Opinions of the Ministry of Finance and the Central Committee on Doing a Good Job in the Reform of Government Purchasing Services in Institutions (Caizong [2016] No.53), we will continue to promote the government to purchase services from public welfare second-class institutions, strengthen the incentives and constraints for reform, and stimulate the internal vitality of institutions.
(1) Strengthen organizational reform. It is necessary to comprehensively sort out and clarify the service items that are currently undertaken by public welfare second-class institutions and are suitable for market-oriented provision through budget allocation, and change the corresponding budget allocation to government-purchased services. For the service items included in the reform, in principle, the service undertaker is determined through competitive selection. For those who do not have competitive conditions for the time being, they can directly entrust the original service provider through single-source procurement in the year of reform according to regulations. Services that must be undertaken by public welfare second-class institutions and are not suitable for market-oriented services are not included in the scope of government purchase service reform. Financial departments at all levels should do a good job in organizing and coordinating the reform.
(2) Standardize relevant management work. Departments at all levels to carry out the reform shall, in accordance with the relevant provisions on budget management, adjust the budget of public welfare second-class institutions to the management of the competent departments at the same level. The income obtained by public institutions through the purchase of services by the government is included in the unified accounting of the budget of public institutions, and the after-tax income is dominated by public institutions according to relevant policies and regulations. As the main body of procurement, the competent department should strengthen contract performance management and performance management.
Four, strengthen the publicity and training of government procurement services.
Effectively increase the publicity and training of government purchasing services. Further strengthen the training of relevant leading cadres at all levels and firmly establish the concept of government purchasing services. Make good use of innovative training methods such as online training and short videos, and make full use of new media such as Weibo and WeChat official account for extensive publicity, so as to ensure that the staff involved in government procurement of services accurately grasp relevant policies, background knowledge and operational norms, and create a good atmosphere for promoting work. Promote typical cases of government purchasing services and play a leading role in demonstration.
Five, timely carry out research and guidance on government procurement of services.
Strengthen the research and guidance on the reform of purchasing services by industries and local governments, timely study and properly handle new situations and problems encountered in the work, strengthen communication and coordination with relevant departments, and ensure the smooth and orderly progress of the reform of purchasing services by the government. The Ministry of Finance will timely organize research and guidance on the reform of government procurement services and the implementation of this notice.
Provincial financial departments and central competent departments shall submit to the Ministry of Finance (General Department) for procurement before June 5438+February 15, 2022 in urban and rural communities, public health, old-age care, employment, education, helping the disabled, law, youth social work, culture and sports, transportation, social assistance, and public rental housing operation and management.
