Provisions of the Ministry of Education on prohibiting primary and secondary school teachers from making up lessons
Legal analysis: Although the Ministry of Education and other ministries and commissions have begun to introduce a number of norms from the aspects of reducing students' burden, quality education, professional ethics construction, and standardizing fees, the problem of making up lessons has not been effectively managed. According to the relevant laws and regulations, it is forbidden for primary and secondary schools and in-service teachers to make up lessons with compensation. It is stipulated that the main body of paid remedial classes is limited to primary and secondary schools and in-service primary and secondary school teachers. In-service primary and secondary school teachers are prohibited from making up lessons with compensation because of their specific professional requirements. Retired teachers no longer continue to perform their educational and teaching duties in schools, and their behavior is not within the scope of adjustment. There are three situations in which primary and secondary schools constitute paid remedial classes: (1) organizing and requiring students to participate in paid remedial classes; (2) Jointly holding paid remedial classes with off-campus training institutions; (three) to provide education and teaching for off-campus training institutions to make up lessons.

Legal basis: Article 33 of the Law of People's Republic of China (PRC) on the Protection of Minors, schools should cooperate with the parents or other guardians of underage students to reasonably arrange their study time and ensure their time for rest, entertainment and physical exercise. Schools shall not occupy national statutory holidays, rest days and winter and summer vacations, and organize underage students in compulsory education to make up lessons collectively to increase their learning burden. Kindergartens and off-campus training institutions shall not conduct primary school curriculum education for preschool minors.
