Article 1 In order to strengthen the management of kindergarten fees, standardize the behavior of kindergarten fees, and protect the legitimate rights and interests of educated people and kindergartens, these Measures are formulated in accordance with the relevant requirements of the Price Law of People's Republic of China (PRC), the Education Law of the People's Republic of China, the Law on the Promotion of Private Education in People's Republic of China (PRC), the Regulations on the Implementation of the Law on the Promotion of Private Education in People's Republic of China (PRC), the Regulations on the Management of Kindergartens and the State Council's Opinions on the Current Development of Preschool Education.
Article 2 These Measures shall apply to all public and private full-time, boarding and half-day kindergartens and preschool classes attached to primary schools (hereinafter referred to as kindergartens) approved by the education administrative department of the People's Republic of China according to law.
Article 3 Preschool education belongs to non-compulsory education. Kindergartens can charge nursery education fees (hereinafter referred to as "education fees") to children entering the kindergarten, and can charge accommodation fees to children living in kindergartens.
Article 4 The income from teaching fees and accommodation fees of public kindergartens shall be included in the management of administrative fees, while the income from teaching fees and accommodation fees of private kindergartens shall be included in the management of operating service fees.
Article 5 The provincial education administrative department shall put forward opinions according to the local urban and rural economic development level, the cost of running the park and the people's affordability when formulating or adjusting the standard of teaching fees for public kindergartens. After being audited by the provincial price department and the financial department, the three departments shall jointly report to the provincial people's government for examination and approval. To formulate or adjust the accommodation fee standard of public kindergartens, the local education administrative department shall put forward opinions and report them to the local price department in conjunction with the financial department for approval.
Article 6 When proposing to formulate or adjust the teaching fee standards for public kindergartens, the following materials shall be submitted:
(1) Specific items for formulating or adjusting charging standards;
(two) the current charging standards and the scope of the application for the formulation of charging standards or the proposed adjustment of charging standards, as well as the increase or decrease of annual fees and adjusted fees;
(three) the basis and reasons for applying for the establishment or adjustment of charging standards;
(four) the impact of applying for the formulation or adjustment of fees on the burden of parents of young children and the income and expenditure of kindergartens;
(five) other materials required by the competent price department and the financial department.
The above materials should be true and effective.
Article 7 The standard of teaching fees for public kindergartens shall be determined according to a certain proportion of the annual average cost of nursing education. Protection education expenses include the following items: staff salaries, allowances, subsidies and benefits, social security expenses, official expenses, operational expenses, repair expenses and other normal expenses for managing the park. It does not include abnormal expenses such as disaster losses, accidents and operating expenses.
Article 8 The accommodation fee standard for public kindergartens shall be determined according to the actual cost and shall not be for profit.
Article 9 The charging standards for teaching and accommodation in private kindergartens shall be reasonably determined by kindergartens according to the Law on the Promotion of Private Education and its implementing regulations, based on the cost of conservation education and accommodation, and shall be implemented after being reported to the local price department and the education administrative department for the record. Private kindergartens that enjoy government financial subsidies (including government purchase of services, rent reduction and tax exemption, replacement by awards, stationing of public teachers, arrangement of special awards, preferential allocation of land, etc.). ) The relevant departments of the local people's government can determine the maximum charging standard by contract, and private kindergartens can formulate specific charging standards within the scope of the maximum standard and report them to the local price, education and finance departments for the record before implementation.
Tenth private kindergartens shall submit the following materials when reporting to the relevant departments for the record of teaching fees and accommodation fees:
(a) the relevant information of the kindergarten, including the name, address, legal representative, legal registration certificate and the license issued by the administrative department of education;
(2) The specific cost items for setting the charging standard include wages, allowances, subsidies and welfare, social security expenses, official expenses, business expenses, repair expenses, depreciation expenses of fixed assets and other normal expenses for running the park. Does not include disaster losses, accidents, operating expenses and other abnormal garden expenses;
(three) the number of kindergarten staff, the number of children in the park, the per capita cost of conservation and education, the purchase and construction of fixed assets, etc. ;
(four) other materials required by the departments of price, education and finance.
Article 11 The fees collected and managed by kindergartens for the convenience of children's education and life in the park shall follow the principle of "parents voluntarily, truthfully collect, settle accounts in time and publish regularly", and shall not be collected together with the education fees.
Kindergarten service charges and charging items shall be put forward by the provincial education administrative department according to the local actual situation, audited by the provincial price department and the financial department, and implemented after the three departments jointly report to the provincial people's government for approval.
Kindergartens are not allowed to charge books.
Twelfth kindergartens shall not charge parents of young children other than teaching fees, accommodation fees and service fees and agency fees approved by the provincial people's government. Kindergartens are not allowed to charge parents for special education such as experimental classes, special classes, interest classes, after-school training classes, parent-child classes, etc., and are not allowed to charge parents for sponsorship fees, donated tuition fees, school building construction fees, education cost compensation fees and other fees linked to enrollment in any name.
Thirteenth social organizations and individuals voluntarily donate tuition fees to kindergartens, which will be used for social donation of education funds in accordance with the National Law on Donation to Public Welfare and relevant financial management measures.
Fourteenth kindergartens charge monthly or semester fees for children entering the park, and may not charge in advance across semesters.
Fifteenth children withdraw from the kindergarten for some reason, the kindergarten should be in accordance with the actual cost of education to the parents of children to refund a certain fee in advance. The specific refund measures shall be formulated by the provincial education, price and finance departments.
Sixteenth children with financial difficulties, orphans and disabled children, should be appropriate to reduce the collection of education fees. Specific relief measures shall be formulated by the provincial education, price and finance departments.
Seventeenth kindergartens should publicize the charging items, charging standards and other related contents to the society by setting up publicity columns, publicity columns, publicity walls and other forms.
Kindergarten enrollment brochures shall specify the nature of kindergartens, conditions for running kindergartens, charging items and charging standards.
Article 18 When a public kindergarten collects education fees and accommodation fees, it shall apply to the competent pricing department for a fee permit, conduct an annual examination of the fee permit in accordance with the regulations, and use the financial bills printed (supervised) by the Ministry of Finance or the provincial financial department in accordance with the financial affiliation. Private kindergartens charge education fees and accommodation fees, and use tax invoices uniformly printed by tax authorities according to regulations.
Nineteenth kindergartens accept the supervision and inspection of prices, education and finance departments, and truthfully provide accounting books, financial reports, accounting and other materials necessary for supervision and inspection.
Twentieth kindergartens to obtain legal fees should be mainly used for child care, educational activities and improve the conditions of running the park, any unit or department shall not be withheld or transferred. No organization or individual may charge any fees to kindergartens in violation of laws and regulations.
Twenty-first price, education and finance departments at all levels should strengthen the management, supervision and inspection of kindergarten fees, urge kindergartens to establish and improve the fee management system, and consciously implement the kindergarten education fee policy formulated by the state. In violation of national laws, regulations, policies and the provisions of these measures, according to the relevant provisions of the "People's Republic of China (PRC) Price Law", "Provisions on Administrative Punishment of Price Violations" and the administrative fees management system, severely punished.
Twenty-second provinces, autonomous regions and municipalities directly under the central government, the price, education and finance departments should formulate specific implementation rules according to these measures.
Article 23 These Measures shall be interpreted by the National Development and Reform Commission in conjunction with the Ministry of Education and the Ministry of Finance.
Twenty-fourth these Measures shall come into force 30 days after the date of promulgation.
