Nowadays, electronic signature has been widely used in many fields and can be used in most scenarios. The revision of 20 19 Electronic Signature Law has further expanded the application scope of electronic signature.
Article 3 of the electronic signature law
In civil activities, the parties may agree to use or not use electronic signatures and data messages in contracts or other documents, vouchers and other documents.
A document in the form of electronic signature or data message agreed by the parties shall not be denied its legal effect just because it is in the form of electronic signature or data message.
The provisions of the preceding paragraph shall not apply to the following documents:
(a) involving marriage, adoption, inheritance and other personal relationships;
(two) involving the cessation of water supply, heating, gas supply and other public utilities services;
(3) Other circumstances in which electronic documents are not applicable as stipulated by laws and administrative regulations.
However, electronic contract is not the visualization of paper contract, and it needs a variety of technical support to have legal effect. It is difficult for individuals and ordinary enterprises to own this technology, so the third-party electronic signature platform came into being. Common technologies are:
1. Real-name authentication technology: cooperate with authoritative CA institutions to provide users with CA certificates, access the eID authentication system of the Ministry of Public Security, and confirm the authenticity of users' identities;
2. Anti-tampering technology: the original electronic file data is solidified by using the internationally accepted hash value technology, which can easily identify whether the file has been tampered with;
3. Third-party timing technology: advanced third-party timing technology can accurately record the signing time;
In addition, excellent third-party platforms will provide more comprehensive services in terms of safety, convenience, cost saving and legal services.
