In order to promote the development of private education and implement the policy of "five insurances and one fund" (namely, endowment insurance, medical insurance, unemployment insurance, work injury insurance, maternity insurance and housing provident fund) for teachers in private schools in our city, according to the Law of People's Republic of China (PRC) on the Promotion of Private Education (hereinafter referred to as the "Civil Measures"), the Interim Measures for Personnel Agency in Zhejiang Province and the Decision on Giving Priority to Education and Accelerating the Construction of a Strong City through Education (Wen Weifa

I. Scope and objectives

(1) range. All kinds of full-time private schools (including kindergartens) approved by the education administrative department of the government at or above the county level.

(2) objects. A person who is represented by the education and personnel branch of the talent service institution of the government at or above the county level (hereinafter referred to as the education and personnel branch) and has one of the following conditions:

1. Teachers who flow from public schools to private schools. Teachers who are handled according to the requirements of the flow procedures in accordance with the Opinions of the Municipal Education Bureau and the Municipal Personnel Bureau on Regulating the Flow of Teachers (Wen Jiao Zheng (2002) 15);

2. Graduates employed by private schools. Graduates who have been employed by the local personnel and education administrative departments, have a college degree or above in teaching kindergartens and primary schools, and have a bachelor degree or above in teaching middle schools;

3. Teachers introduced by private schools. Approved by the local personnel and education administrative departments, teachers with corresponding teacher qualifications and intermediate titles or above.

II. Procedures and financial guarantee

(1) signing a personnel agency contract. Teachers in private schools provide academic certificates, professional titles and teacher qualification certificates to private schools; Private schools provide educational talent branches with entrustment application, entrusted agent roster, entrusted agent registration form, teacher employment contract, graduate employment agreement, academic certificate, professional title certificate, teacher qualification certificate and other related materials; After the audit, the Education Talents Branch will sign a personnel agency contract with private schools and teachers.

(2) handle "five insurances and one gold". The Education Talent Branch issued the Contact Letter of Wenzhou Private School Personnel Agency Teachers Implementing the Policy of "Five Risks and One Fund" according to the standards of public school teachers to qualified teachers who have signed the personnel agency contract, and social insurance agencies and housing provident fund management centers and other departments handled the procedures of implementing "five risks and one fund" for private school teachers with this contact letter.

(three) the proportion of payment and the guarantee of funds. The payment method and proportion of "five insurances and one gold" for teachers in private schools shall be implemented in accordance with the relevant regulations of the local government in that year. In addition to the expenses borne by private schools and individual teachers according to the proportion standard of public schools, local governments will give certain financial subsidies in the form of awards instead of subsidies depending on their own financial resources and types of running schools. Teachers' personal contributions are deducted from teachers' salaries by the school.

(four) to handle the formalities of increase or decrease and change in time. Private school teachers who terminate the employment contract and personnel agency shall terminate or transfer the social security relationship and provident fund relationship in time.

Three, salary management and "five insurance and one gold" treatment

(1) Salary management. The personnel department and the administrative department of education should establish the same salary system as that of teachers in public schools, which can be used as a reference for the pension of employees in public institutions. The approval and management of salary policies such as graduation and file salary adjustment shall be handled according to the relevant procedures of personnel agency.

(2) "Five insurances and one gold" treatment. Teachers in private schools who meet the requirements of this implementation opinion shall enjoy equal pension insurance, medical insurance, unemployment insurance benefits, work injury insurance, maternity insurance and housing accumulation fund for teachers in public schools. When a teacher reaches the legal retirement age, the private school shall report to the local personnel agency department for retirement examination and approval procedures according to the relevant procedures of personnel agency and verify the standard of retirement fee, and the social insurance agency shall issue retirement fee on the basis of the retirement examination and approval form approved by the personnel agency department. Local allowances that are not included in the overall social security plan are guaranteed by private schools.

Fourth, organizational requirements

Private schools should attach great importance to this work, arrange special personnel to be responsible for the implementation of this work, guarantee the salaries and welfare benefits of teaching and administrative staff according to law, handle endowment insurance, medical insurance, unemployment insurance, work injury insurance and maternity insurance for qualified teachers who implement personnel agency in strict accordance with the requirements of public school teachers' policies, and establish a housing provident fund system so that teachers in private schools can enjoy the "five insurances and one gold" policy for public school teachers equally.
