Measures of Shanxi Province on the Implementation of People's Republic of China (PRC) Vocational Education Law
Chapter I General Provisions Article 1 In order to implement the strategy of rejuvenating Shanxi through science and education, develop vocational education, improve the quality of workers, and promote economic construction and social progress, these measures are formulated in accordance with the provisions of the Vocational Education Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to all kinds of vocational school education and various forms of vocational training within the administrative area of this province. Article 3 Vocational education must implement the national education policy, educate the educated in ideological and political education and professional ethics, impart professional knowledge, cultivate professional skills, provide vocational guidance, and train all kinds of technical talents and skilled workers for local economic construction and social development. Article 4 People's governments at all levels shall exercise unified leadership, overall coordination, supervision and evaluation of vocational education within their respective administrative areas, incorporate the development of vocational education into the local national economic and social development plan, adjust the structure and layout, optimize the allocation of resources, and improve the quality of vocational education and the efficiency of running schools. Article 5 The administrative department of education shall be in charge of vocational education within its administrative area, and make overall planning, macro-management and operational guidance for vocational education; To supervise and inspect the implementation of the education policy and relevant laws and regulations; Evaluate vocational schools and their educational work.

The labor administrative department is responsible for the management of technical training and vocational skill appraisal of technical schools, labor and employment training institutions and enterprise employees.

Planning, finance, personnel and other administrative departments in accordance with the division of responsibilities, responsible for talent demand forecasting, funding sources, graduate employment and employment guidance.

Other relevant administrative departments and industry organizations shall organize, coordinate and give professional guidance to the vocational education of their own systems and industries. Article 6 People's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in developing vocational education. Chapter II Vocational Education System Article 7 According to the needs of the province's economic and social development, focusing on junior high school and post-junior high school, we should divert education at different stages, establish and improve the vocational education system, and form a vocational education system in which vocational school education and vocational training develop in parallel, junior, secondary and higher vocational school education are connected with each other, and communicate with other education for coordinated development. Article 8 Primary vocational school education is a vocational education in junior high school based on primary education, which mainly cultivates people with primary professional knowledge and practical skills. Article 9 Secondary vocational school education is high school vocational education based on junior secondary general education, including general secondary specialized schools, technical schools, vocational secondary specialized schools and vocational high schools, and mainly trains intermediate professional and technical personnel, managers and operators. Article 10 Higher vocational school education is a vocational education in the higher education stage based on senior secondary education, which mainly trains applied and skilled senior professional and technical personnel and managers. Article 11 Vocational training includes pre-job training, apprenticeship training, on-the-job training, job-transfer training and other vocational training, which can be divided into primary, intermediate and advanced vocational training according to the actual situation. Vocational training is implemented by corresponding vocational training institutions and vocational schools respectively. Twelfth ordinary junior middle schools, senior middle schools and ordinary colleges and universities can implement vocational education at the same level according to the overall planning of the education administrative department. Ordinary middle schools can offer vocational education courses or increase the teaching content of vocational education. Chapter III Implementation of Vocational Education Article 13 The people's governments at or above the county level shall establish vocational schools and vocational training institutions that play a key and exemplary role; Vigorously support the development of vocational education in poor mountainous areas, organize unemployed people to receive various forms of vocational education, and help disabled people receive vocational education; Give guidance and support to vocational schools and vocational training institutions organized by rural areas, enterprises and institutions, social organizations and individual citizens according to law. Article 14 People's governments at the county level shall, according to the needs of the overall development of local rural economy, science and technology and education, take various forms to carry out practical technical training, focus on running comprehensive vocational education centers with secondary vocational schools as the focus, and promote the development of rural vocational education. Fifteenth government departments and industry organizations shall establish or jointly establish vocational schools and vocational training institutions. Organize, coordinate and guide enterprises and institutions in their own departments and industries to set up vocational schools and vocational training institutions.

Encourage social organizations, other social organizations and individual citizens to establish vocational schools and vocational training institutions in accordance with the relevant provisions of the state. Article 16 An enterprise shall independently or jointly establish vocational schools and vocational training institutions, and may also entrust other vocational schools and vocational training institutions to provide vocational education for its employees and persons to be hired.

Industries, enterprises and institutions are responsible for arranging the funds, teachers, professional settings, facilities and equipment, practice bases, enrollment and employment of vocational high schools, technical schools and staff training institutions organized by their own units and systems. Seventeenth vocational schools and vocational training institutions must meet the conditions prescribed by the state.

The establishment of a vocational school shall go through the examination and approval procedures in accordance with the following provisions:

(a) primary vocational schools, declared by the competent department of the school or the school-running unit, audited by the education administrative department at the county level and approved by the people's government at the same level;

(two) vocational high schools, declared by the school authorities or school units, audited by the local and municipal education administrative departments, and reported to the regional administrative office or the municipal people's government with districts for approval;

(3) Vocational secondary specialized schools shall be declared by the school authorities, audited by the municipal education administrative department and submitted to the provincial education administrative department for examination and approval;

(4) Ordinary secondary specialized schools shall be declared by the regional administrative office or the municipal people's government divided into districts or the relevant administrative departments of the province, audited by the provincial education administrative department and submitted to the provincial people's government for examination and approval;

(5) Technical schools shall be declared by the regional administrative office or the municipal people's government divided into districts or the relevant administrative departments of the province, audited by the provincial labor administrative department and submitted to the provincial people's government for examination and approval;

(six) higher vocational schools that meet the relevant provisions of the state;

The establishment of vocational training institutions shall be examined and approved by the education administrative department and the labor administrative department respectively according to the division of management responsibilities.

The examination and approval of vocational schools and vocational training institutions run by social forces shall be handled in accordance with the relevant provisions of the Regulations on the Administration of Running Schools by Social Forces in Shanxi Province.
