Chapter I General Provisions
Article 1 In order to further implement the national policy of "actively encouraging, vigorously supporting, correctly guiding and managing according to law", implement the spirit of the document "Several Opinions on Strengthening the Standardized Management of Private Schools and Guiding the Healthy Development of Private Education" (1999No. 102). Approved by the municipal government, in order to further strengthen the standardized management of private schools and promote the healthy development of private education in our city. Combined with the actual situation in our city, these measures are formulated.
Article 2 The term "private non-academic education and training institutions" as mentioned in these Measures refers to private schools that are not qualified to issue academic certificates and are organized by social organizations other than state institutions or individual citizens with non-state financial funds.
These Provisions shall not apply to the application for the establishment of private education and training institutions that implement vocational qualification training and technical level training, as well as non-academic education and training for employees of various departments and units.
Article 3 The establishment of private non-academic education and training institutions shall meet the needs of the economic construction and social development of this Municipality, the regional education development plan and the actual needs, and the requirements of the document "Tianjin Private Non-academic Training Institutions Setting Standard" (Tianjin Education Commission [2008] No.2).
Article 4 Non-academic education and training institutions shall adhere to the Party's basic line, fully implement the Party's educational policy, abide by national laws and regulations, ensure the quality of education and train qualified personnel. Accept the management, supervision, inspection, evaluation and audit of the government.
Chapter II Application for Establishment
Article 5 To apply for the establishment of a private non-academic education and training institution, the applicant shall, in accordance with the requirements of the Standards for the Establishment of Private Non-academic Training Institutions in Tianjin, apply to the district or county education administrative department where the school is to be established. Any application involving health, sports, security and other training institutions. It shall be approved by the relevant administrative departments and examined and approved by the district and county education administrative departments.
Article 6 To apply for running a school, the following materials shall be submitted:
(1) An application report for running a school. Sponsor, principal, school name, school address, source of funds, amount and management mode, school content, training objectives, school scale, school level, school form, school conditions (facilities, equipment, etc.). ) and internal management system. If the organizer is a unit, it shall be stamped with the official seal of the unit, and if the organizer is an individual citizen, it shall be signed by himself.
(2) the qualification certificate of the promoters. The organizer of the unit shall submit the original and photocopy of the legal person certificate and business license of the unit. Individual sponsors shall submit the original and photocopy of relevant civil capacity certificates, household registration books and ID cards.
(3) The original and photocopy of the qualification certificate, professional title certificate or academic certificate, household registration book and ID card of the principal of the training institution to be employed.
(4) proof of the school site. A copy of the corresponding house land title certificate (with official seal) shall be submitted for the own school site; A copy of the lessor's real estate title certificate (official seal of the property right unit is required), a lease agreement (the lease agreement shall specify the total area of the school building and the lease term) and a certificate of fire safety and hygiene.
(5) Articles of association of private non-academic education and training institutions. It shall include the following contents:
1. Name and address of the institution;
2 school purpose, content, scale, level, form, etc. ;
3. The amount, source and nature of the assets, and the proof of purchasing teaching equipment and facilities;
4. The formation mode, personnel composition, term of office and rules of procedure of the Council (board of directors) or other forms of decision-making bodies;
5. The legal representative of the school;
6. Whether investors demand reasonable returns;
7. Conditions for the school to terminate itself;
8. Procedures for amending the Articles of Association;
(VI) The resolutions of the first board of directors or other decision-making bodies of the school (the time, place, participants and contents of the resolutions shall be clearly stated, including the resolutions of adopting the articles of association of the school, electing the chairman (chairman) and appointing the president, and the signatures of all members), and the original and photocopy of the identity cards and household registration books of the chairman (chairman) and directors (directors).
(seven) the accounting certificate and a copy of the accountant to be appointed.
(eight) the original and photocopy of the professional teacher qualification certificate (professional qualification certificate, professional technical title or technical grade certificate).
(nine) teaching objectives, curriculum, hours, teaching arrangements, the use of teaching materials, assessment methods, etc. It should be clearly stated in the major offered.
Article 7 Private non-academic education and training institutions shall sign legal and fair employment contracts when hiring teachers and managers. If it is a public official, it must be approved by the subordinate unit.
Eighth private non academic education and training institutions shall, in accordance with the relevant laws and policies of the state, guarantee their wages and benefits, and handle relevant social security and medical insurance.
Chapter III Supervision and Administration
Article 9 Private non-academic education and training institutions shall, in accordance with the articles of association approved by the examination and approval authorities, establish and improve various rules and regulations, standardize internal management, ensure the quality of education and teaching, and carry out school-running activities according to law.
Article 10 After receiving the license for running a private school, a private non-academic education and training institution shall register as a legal person with the competent legal person registration authority, apply for a certificate of legal person code from the technical supervision bureau of the county where it is located, open an account in a bank, and register with the local tax bureau of the county. The style, bank and account number of the engraved seal shall be reported to the examination and approval authority for the record.
Eleventh private non academic education and training institutions to carry out education and teaching activities, the name must be consistent with the name approved by the examination and approval authority.
Twelfth private non academic education and training institutions to publish enrollment brochures and enrollment advertisements, must go to the examination and approval authorities for the record. Comply with the requirements of laws and regulations, the content is true and accurate, and it is consistent with the enrollment brochures and advertisements filed by the examination and approval authorities.
Thirteenth private non academic education and training institutions shall not entrust or contract the enrollment and the education and teaching tasks undertaken by them to other units, intermediaries and individuals.
Fourteenth private non academic education and training institutions fees and standards, should be reported to the price management department for the record and publicity. When paying fees, the relevant regulations on fees and refunds shall be publicized to students, and a refund agreement shall be signed with the students, and the refund shall be handled according to the agreement.
Fifteenth private non academic education and training institutions shall establish a student registration system and student academic files.
Sixteenth private non academic education and training institutions in the area approved by the examination and approval authority to add teaching places, should re apply for examination and approval, registration procedures. Private non-academic education and training institutions that add teaching places in the areas approved by the examination and approval authorities shall report to the examination and approval authorities for the record.
Seventeenth private non academic education and training institutions shall, after the end of each year, report the basic situation of running schools to the examination and approval authority. The contents include:
(1) annual financial audit report. Including: whether the school-running funds are in place, whether there is transfer, evasion and misappropriation, financial revenue and expenditure and management, tax payment, bill use, reasonable return amount, whether the retained development funds reach 25% of the annual net asset growth, etc. ;
(2) A written report on running a school according to law signed by the principal;
(three) the annual registration form of private schools;
(four) the original and photocopy of the real estate or house lease certificate, and the certification documents of the health, fire protection and public security departments;
(five) a copy of the sponsor's qualification certificate (legal person certificate, private school license and the identity certificate of the principal and chairman (director)).
Eighteenth district and county education administrative departments shall organize relevant personnel to inspect, supervise and evaluate private non-academic education and training institutions regularly or irregularly, and strengthen the management and supervision of private non-academic education and training institutions. Strengthen cooperation with finance, taxation, price, auditing, civil affairs, industry and commerce, labor and social security departments, and cooperate with relevant departments to carry out management work according to law.
Chapter IV Alteration and Termination
Nineteenth private non academic education and training institutions to change the name, level and category shall be submitted to the examination and approval authority for approval; The sponsor of the change shall report to the examination and approval authority for approval.
The promoters of the change shall carry out financial liquidation.
Twentieth private non-academic education and training institutions shall carry out merger, property inspection and financial liquidation, and the merged non-academic education and training institutions shall properly resettle the original students. The merger must be reported to the examination and approval authority for approval.
Article 21 If a private non-academic education and training institution is unable to carry out normal education and teaching activities for some reason, and the sponsor or the board of directors (council) requests to suspend business according to the provisions of the school's articles of association, it shall conduct financial audit and liquidation according to law, and the examination and approval authority may dissolve or suspend business after properly arranging the students in school.
Article 22 When a private non-academic education and training institution terminates, the examination and approval authority shall withdraw the school license, destroy the seal and cancel the registration.
Chapter V Supplementary Provisions
Article 23 These Measures shall be implemented as of May 1st and shall be valid for five years.
