Article 2 These Regulations shall apply to the continuing education of professional and technical personnel within the administrative area of this province.
The continuing education of professional and technical personnel as mentioned in these Regulations (hereinafter referred to as continuing education) refers to education and training aimed at supplementing, updating and expanding knowledge, enhancing innovation ability, improving professional quality and professional technical level, and promoting the development of enterprises, institutions and other social organizations.
Article 3 Continuing education should be guided by social needs, with new theories, technologies and methods of professional technology as the main contents, and adhere to the principles of integrating theory with practice, teaching according to needs and paying attention to actual results.
Continuing education should gradually establish the operating mechanism of government supervision, industry guidance, unit autonomy and individual consciousness.
Article 4 Professional and technical personnel have the right to receive continuing education and perform corresponding obligations according to law.
Article 5 Local people's governments at or above the county level shall incorporate continuing education into their local national economic and social development plans, formulate continuing education plans and policies, improve continuing education conditions, promote the informatization construction of continuing education, support the development of continuing education in key areas and industries, and support professional and technical personnel in poverty-stricken areas and remote rural areas to receive continuing education.
Article 6 The education administrative department of the local people's government at or above the county level shall give macro guidance to continuing education.
The personnel administrative department of the local people's government at or above the county level shall be specifically responsible for the comprehensive coordination, supervision and inspection of the continuing education of professional and technical personnel within their respective administrative areas.
The relevant competent departments and industry organizations shall be responsible for the organization and management of continuing education for professional and technical personnel in their own departments and industries according to the requirements of the province's continuing education planning and policies.
Where laws and administrative regulations provide otherwise for the management of continuing education, such provisions shall prevail.
Article 7 The personnel administrative department of the province shall, jointly with the relevant competent departments and industry organizations, study the objectives and measures of continuing education, compile a discipline guide for continuing education, guide the organization and implementation of continuing education and training in the whole province, and build a public service system for continuing education and a long-distance continuing education network covering the whole province.
The personnel administrative department of the local people's government at or above the county level shall collect, provide and publish continuing education information, coordinate and guide the educational activities of continuing education and training institutions.
Article 8 The personnel administrative department shall, jointly with the relevant competent departments, set up a continuing education expert guidance group composed of experts and scholars in education, human resources development and related industries to engage in research, consultation and evaluation on policies, planning, subject guidance, project implementation, curriculum setting, education and training of continuing education.
Ninth relying on all kinds of institutions of higher learning, scientific research institutions, social organizations set up training institutions and other qualified training institutions, the establishment of continuing education base, improve the implementation of continuing education network.
Encourage and support all kinds of continuing education and training institutions to carry out continuing education activities according to law.
Tenth television, radio, internet, newspapers and other related media, libraries, science and technology museums and other social and public cultural institutions actively participate in the production and dissemination of continuing education content, the government can give financial subsidies.
Eleventh enterprises, institutions and other social organizations shall perform the following duties in continuing education activities:
(a) the implementation of laws and regulations on continuing education;
(two) to formulate the continuing education plan of the unit and organize its implementation;
(three) to ensure the time for professional and technical personnel to participate in continuing education and other rights and interests enjoyed according to law, and to provide necessary funds and other conditions;
(four) registration, assessment of professional and technical personnel to receive continuing education, report the relevant statistical data;
(five) accept the guidance and supervision of the personnel administrative department and the relevant competent departments and industry organizations.
Enterprises, institutions and other social organizations have the right to choose their own training institutions for professional and technical personnel to receive continuing education, and have the right to decide their own training contents that suit their own needs.
Twelfth professional and technical personnel to receive full-time or amateur continuing education, the average annual cumulative time, senior and intermediate professional and technical personnel not less than 72 hours, junior professional and technical personnel not less than 40 hours. Unless otherwise stipulated by the state, such provisions shall prevail.
Where the professional and technical personnel post appointment system is implemented, the implementation cycle of continuing education is consistent with the post appointment cycle. The study time in a cycle can be used centrally or dispersed.
Encourage and support professional and technical personnel to carry out self-study in their spare time.
Thirteenth enterprises, institutions and other social organizations according to the continuing education plan of the unit, can arrange their professional and technical personnel to participate in continuing education through the following forms:
(a) Attending refresher courses, training courses or seminars;
(two) to study in teaching, scientific research and production units;
(3) Attending academic conferences and lectures at home and abroad;
(4) Going abroad for further study, inspection and training;
(five) study organized by the unit and self-study with assessment;
(6) receiving modern distance education;
(seven) other forms of continuing education.
Article 14 Enterprises, institutions and other social organizations shall, on the basis of the certificates issued by continuing education and training institutions, record the learning situation, examination results or assessment results of professional and technical personnel participating in continuing education on the continuing education registration certificate supervised by the provincial personnel administrative department, and take it as one of the conditions for professional and technical personnel to evaluate and promote their professional and technical qualifications (positions).
The registration certificate of continuing education is kept by professional and technical personnel, and can be used as a certificate of recognition of learning achievements for talent flow, post appointment and participation in academic activities.
Fifteenth professional and technical personnel to participate in continuing education full-time or amateur, should be approved by the unit; The wages and benefits during the study period are treated equally with the on-the-job personnel, unless otherwise agreed between the professional and technical personnel and the unit.
Sixteenth professional and technical personnel receiving continuing education should abide by the relevant laws and regulations of continuing education, obey the arrangement of the unit, and complete the learning task.
Seventeenth engaged in continuing education and training activities, should meet the following conditions:
(1) Having a suitable organizational structure and management system;
(2) Having teachers and managers suitable for the training tasks;
(3) Having places, facilities and equipment suitable for the training;
(4) Having funds suitable for its training activities;
(5) Other conditions stipulated by laws and administrative regulations.
Eighteenth continuing education and training institutions engaged in continuing education activities, should truthfully publicize its training scope, fees and standards, training teachers, training places and facilities.
Training advertisements of continuing education and training institutions shall be true and lawful, and shall not contain false contents, and shall not deceive or mislead.
Continuing education and training institutions shall conscientiously implement the continuing education teaching plan, ensure the teaching quality of continuing education, and truthfully issue certificates to professional and technical personnel who receive continuing education.
Nineteenth personnel administrative departments shall, jointly with the relevant competent departments, regularly evaluate the educational activities of continuing education and training institutions in the region, and announce the evaluation results to the public.
Twentieth financial departments at all levels should arrange a certain amount of funds in the financial budget for the development of continuing education every year, focusing on ensuring the cost of continuing education for talents in short supply in the region, high-level talents and professional and technical personnel in poverty-stricken areas and remote rural areas.
Financial arrangements at all levels of continuing education funds should be earmarked, and accept the supervision of the financial and auditing departments. The use and management measures shall be formulated by the provincial finance department in conjunction with the provincial personnel administrative department.
Twenty-first enterprises, institutions and other social organizations of continuing education funds in the staff education funds. The expenses for continuing education in developing new technologies and new products can be arranged in the management expenses and project funds.
Twenty-second professional and technical personnel to participate in continuing education arranged by the unit, the cost is mainly borne by the unit. Unless otherwise agreed between the professional and technical personnel and the unit.
Twenty-third encourage domestic and foreign enterprises, institutions and other social organizations and individuals to provide funding and donations to continuing education. The grants and donations provided should be used for continuing education.
Twenty-fourth encourage and support the use of financial and credit means to support the development of continuing education.
Twenty-fifth units and individuals that have made remarkable achievements in continuing education shall be commended and rewarded by local people's governments at or above the county level and relevant departments.
Twenty-sixth professional and technical personnel's right to receive continuing education is violated, they have the right to lodge a complaint with the superior competent department or the personnel administrative department of the unit where they work. The department that accepts the complaint shall make a decision within 30 days from the date of receiving the complaint and reply to the complainant.
Article 27 Where an enterprise, institution or other social organization violates the provisions of Article 11 of these regulations, fails to formulate and organize the implementation of a continuing education plan, provides necessary funds and conditions, and guarantees the time for professional and technical personnel to receive continuing education and other rights and interests enjoyed according to law, the personnel administrative department or the relevant competent business department shall order it to make corrections.
Article 28 Where a continuing education and training institution publishes false training advertisements in violation of the provisions of the second paragraph of Article 18 of these regulations, the advertising supervision organ or the relevant administrative department shall order it to make corrections within a time limit, and if it has collected fees from the trainees, it shall refund the fees collected and give a warning; If the circumstances are serious, it shall be ordered to stop continuing education and training activities.
In violation of the provisions of the third paragraph of article eighteenth of this Ordinance, the continuing education and training institutions do not implement the continuing education and teaching plan, and the teaching quality is unqualified, and the supporting documents are invalid. The personnel administrative department shall order it to make rectification within a time limit. If it fails to make rectification within the time limit or fails to meet the specified requirements after rectification, the personnel administrative department shall announce it to the public.
Twenty-ninth price departments shall supervise and inspect the charging behavior of continuing education and training institutions according to law, and impose administrative penalties on illegal charging behavior in accordance with the provisions of relevant laws and regulations.
Thirtieth personnel engaged in continuing education who do not conscientiously perform their duties or practise fraud shall be ordered by their units or higher authorities to make corrections, and may be given administrative sanctions according to the seriousness of the case.
Article 31 These Regulations shall come into force as of August 6, 2005.
