The establishment of institutions of higher learning with a bachelor's degree or above shall be examined and approved by the administrative department of education of the State Council. The establishment of institutions of higher learning offering special education shall be examined and approved by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and reported to the education administrative department of the State Council for the record. The establishment of other institutions of higher education shall be examined and approved by the education administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
