In March, 20 12, these seven victims filed a claim lawsuit of 440 million won against the South Korean municipal government, Gwangju municipal government and Gwangju district government, claiming that the government and local governments failed to fulfill their management responsibilities, which caused them to be sexually assaulted by teachers and suffered both physical and mental injuries.
The Seoul High Court later heard the case and rejected the victim's claim on the grounds that it was impossible to prove that the government agency was responsible for the crime of sexual violence suffered by the victim. In the final judgment of 165438 made by the Grand Court1October 8, the judge again rejected the claims of seven victims on the grounds that the case had passed (the five-year validity period of the state compensation claim had passed).
Film evaluation
A "melting pot" makes people sad. Based on a true story, it describes the tragic picture of sexual assault and violence in a school for the deaf. Where there is oppression, there is resistance. As a vulnerable group, these victims who are at the bottom of society and suffer setbacks are unable to resist and no one pays attention until a teacher with conscience and a sense of justice appears.
This brought them hope of life. When the society is ruled by law day by day, people's resistance to violence has shifted to the track of rule by law, and law has increasingly become a "life-saving straw" for vulnerable groups. However, in this human rights struggle, the film vividly shows the problem of privileged capital in the transition period, the human nature and institutional dilemma faced by the law.
