People's Republic of China (PRC) (China) Cryptography Law is a law formulated to standardize the application and management of cryptography, promote the development of cryptography, ensure network and information security, safeguard national security and social public interests, and protect the legitimate rights and interests of citizens, legal persons and other organizations. It is a comprehensive and basic law in the field of cryptography in China.

The Code Law of People's Republic of China (PRC) was adopted at the 14th meeting of the 13th NPC Standing Committee in People's Republic of China (PRC) on 20 19126, and will come into force on 20126.

Chapter I General Principles

Article 1 This Law is formulated in order to standardize the application and management of passwords, promote the development of cryptography, ensure the security of networks and information, safeguard national security and social public interests, and protect the legitimate rights and interests of citizens, legal persons and other organizations.

Article 2 The term "password" as mentioned in this Law refers to technologies, products and services that encrypt, protect and authenticate information by means of specific conversion.

Article 3 Cryptography work adheres to the overall concept of national security and follows the principles of unified leadership, graded responsibility, innovation and development, serving the overall situation, managing according to law and ensuring security.

Article 4. Insist on China's leadership in cryptography. The central leading body for password work leads the national password work in a unified way, formulates major principles and policies for national password work, coordinates major issues and important work of national password, and promotes the construction of national password rule of law.

Article 5 The national password management department is responsible for the management of password work throughout the country. The local password management departments at or above the county level shall be responsible for the password management within their respective administrative areas.

State organs and units involved in password work shall be responsible for the password work of their own organs, units or systems within the scope of their duties.

Article 6 The State implements classified management of passwords.

Passwords are divided into core passwords, common passwords and commercial passwords.

Article 7 Core passwords and common passwords are used to protect state secret information. The highest confidential level of information protected by core password is top secret, and the highest confidential level of information protected by ordinary password is confidential.

Core passwords and commonly used passwords are state secrets. The password management department shall, in accordance with this law, relevant laws, administrative regulations and relevant provisions of the state, implement strict and unified management of core passwords and general passwords.

Article 8 Commercial passwords are used to protect non-state secret information.

Citizens, legal persons and other organizations can use commercial passwords to protect network and information security according to law.

Article 9 The State encourages and supports the research and application of cryptography, protects intellectual property rights in the field of cryptography according to law, and promotes the progress and innovation of cryptography.

The state strengthens the training of cryptographers and team building, and commends and rewards organizations and individuals who have made outstanding contributions in cryptology work in accordance with relevant state regulations.

Article 10 The State shall strengthen password security education in various forms, incorporate password security education into the national education system and the civil servant education and training system, and enhance the password security awareness of citizens, legal persons and other organizations.

Eleventh people's governments at or above the county level shall incorporate cryptography into the national economic and social development plan at the corresponding level, and the required funds shall be included in the fiscal budget at the corresponding level.

Article 12 No organization or individual may steal others' encrypted information or illegally invade others' password protection system.

No organization or individual may use passwords to engage in illegal and criminal activities that endanger national security, social public interests and the legitimate rights and interests of others.
