Regulations of Zhengzhou Municipality on Education Supervision
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Education Law of the People's Republic of China and other relevant laws and regulations, and in light of the actual situation of this Municipality, in order to strengthen the supervision and guidance of educational work and ensure the implementation of educational laws and regulations and the realization of educational objectives. Article 2 The term "educational supervision" as mentioned in these Regulations refers to the activities of the people's governments of cities and counties (cities, districts) to supervise, inspect, evaluate and guide the education and related work below the middle level (including below the middle level, the same below) within their respective jurisdictions according to law. Article 3 The objects of education supervision are the education and other relevant administrative departments of the people's governments at the same level, the people's governments at lower levels and their educational administrative departments, and all kinds of educational institutions under their jurisdiction. Fourth education supervision should be based on the relevant education laws, regulations and rules, adhere to the principle of seeking truth from facts, objectivity and fairness. Article 5 The people's governments of cities and counties (cities, districts) shall commend and reward the units and individuals that have made remarkable achievements in educational supervision. Chapter II Educational Supervision Institutions and Duties Article 6 The educational supervision institutions of the people's governments of cities and counties (cities, districts) shall be responsible for educational supervision within their respective jurisdictions on behalf of the people's governments at the corresponding levels, and accept the guidance of the educational supervision institutions at higher levels in business. Seventh city and county (city, district) people's government education supervision institutions are mainly responsible for:

(a) to formulate educational supervision plans and evaluation plans, and organize the implementation of educational supervision;

(two) to supervise the implementation of local education laws, regulations and rules;

(three) to supervise the relevant administrative departments of the people's governments at the same level and the people's governments at lower levels to perform their educational duties;

(four) to supervise the education management of the education administrative departments at lower levels;

(five) according to the division of labor to supervise and evaluate the development of compulsory education in the region and the work of eliminating illiteracy among young people;

(six) according to the division of labor, to supervise and evaluate the implementation of quality education in various educational institutions below the second level in the region;

(seven) to supervise the distribution, management and use of education funds and education fees of educational institutions below secondary level;

(eight) to investigate and study major issues in education, report and reflect the situation to the people's government at the corresponding level, and put forward opinions and suggestions;

(nine) to put forward suggestions on the evaluation of advanced collectives and individuals in education; To make suggestions to the relevant competent authorities on the appointment and removal of the principals of the supervised schools;

(ten) to undertake other tasks assigned by the people's government at the same level and the higher education supervision institutions. Article 8 The people's governments of cities and counties (cities, districts) shall guarantee the funds needed by educational supervision institutions to carry out educational supervision work and provide necessary working conditions. Chapter III Inspector Article 9 An inspector is a person who performs the duties of educational supervision. Inspectors shall meet the following conditions:

(a) adhere to the basic principles set by the Constitution, have good political quality, and love education;

(two) familiar with education and education supervision related laws and regulations, with a high level of theory and policy;

(three) with a bachelor's degree or above in primary and secondary schools or senior education titles, familiar with education and teaching business, with certain educational and scientific research capabilities and corresponding management experience;

(four) law-abiding, moral integrity, adhere to principles, fair;

(5) good health. Tenth inspectors are divided into full-time inspectors and part-time inspectors. Full-time inspectors shall be appointed and removed by the people's government at the corresponding level, and part-time inspectors shall be appointed by the people's government at the corresponding level. Full-time inspectors and part-time inspectors enjoy the same authority.

Part-time inspectors are employed for three years. Eleventh inspectors may exercise the following functions and powers in education supervision:

(a) to criticize and put forward rectification suggestions for the behavior of the supervised unit in violation of the relevant national education laws, regulations and rules;

(two) found that endanger the personal safety of teachers and students, infringe on the legitimate rights and interests of teachers and students, disturb the normal teaching order and other acts have the right to stop, and suggest the relevant competent departments to deal with;

(three) to reflect the situation to the people's government at the same level, the people's government at a higher level and their educational supervision institutions, and put forward opinions and suggestions;

(four) put forward supervision opinions on the supervised units, and put forward suggestions on rewards and punishments as appropriate. Twelfth inspectors by the people's government at the same level issued certificates and certificates to perform their duties.

Inspectors should receive training in education laws and regulations, education management, education supervision and education evaluation. Thirteenth inspectors perform their duties, if they have an interest in the supervised unit, which may affect the normal work of educational supervision, inspectors should voluntarily withdraw, and the supervised unit has the right to apply for withdrawal.

If the supervised unit applies for the withdrawal of the inspector, the inspector shall withdraw after being approved by the person in charge of the educational supervision institution. Chapter IV Implementation of Educational Supervision Article 14 The educational supervision institutions of the people's governments of cities and counties (cities, districts) shall, in accordance with the national educational laws, regulations, principles and policies, as well as the requirements of the educational supervision institutions at higher levels and the people's governments at the corresponding levels, formulate annual educational supervision plans in light of local conditions and organize their implementation. Fifteenth education supervision is divided into comprehensive supervision, special supervision and follow-up supervision. Sixteenth comprehensive inspection and special inspection shall be attended by more than two inspectors, and supervision shall be carried out according to the following procedures:

(a) to determine the supervision tasks and requirements, formulate work plans and programs, and issue a written notice to the supervised unit;

(two) to guide the supervised units to conduct self-examination and self-evaluation as required;

(three) to inspect and evaluate the supervised units;

(four) put forward supervision opinions to the supervised unit, inform the supervision results, and issue a notice of supervision results.
