Regulations of Huzhou Municipality on Preventing and Resolving Contradictions and Disputes
Chapter I General Provisions Article 1 In order to promote the prevention and resolution of contradictions and disputes, safeguard the legitimate rights and interests of the masses, improve the modernization level of social governance and maintain social harmony and stability, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 These Regulations shall apply to the prevention and resolution of contradictions and disputes and related activities within the administrative area of this Municipality. Article 3 Contradictions and disputes mentioned in these Regulations refer to disputes and conflicts that affect harmony between natural persons, legal persons and unincorporated organizations, as well as between state organs and parties performing their duties. Article 4 The work of preventing and resolving contradictions and disputes shall be incorporated into the social governance system of party committee leadership, government responsibility, democratic consultation, social coordination, public participation, legal guarantee and scientific and technological support, and the following principles shall be observed:

(a) prevention first, focusing on source management;

(2) Abide by the law and ensure fairness and justice;

(three) give priority to mediation and respect the wishes of the parties;

(four) active service, efforts to facilitate the people and efficient. Article 5 The municipal, district and county people's governments shall incorporate the work of preventing and resolving contradictions and disputes into the overall planning for the construction of a local government ruled by law, promote the construction of social contradictions and disputes mediation centers, and make overall plans to promote related work.

The comprehensive departments of cities, districts and counties to prevent and resolve contradictions and disputes shall urge and guide relevant departments and localities to carry out their work and coordinate and solve major problems.

According to the authorization and entrustment, the Management Committee of Nantaihu New District performs the duties of the district and county people's governments within its jurisdiction.

All departments of the municipal, district and county people's governments, township people's governments and sub-district offices shall adhere to the unification of powers and responsibilities and territorial management, and jointly do a good job in preventing and resolving contradictions and disputes in accordance with legal responsibilities.

Village (neighborhood) committees shall establish and improve people's mediation organizations, smooth and guide the masses to express their demands reasonably according to law, and organize people's mediators, grid workers and legal advisers. Article 8 Trade unions, the Communist Youth League, women's federations, disabled persons' federations, federations of industry and commerce and other mass organizations shall give full play to their organizational advantages and participate in preventing and resolving contradictions and disputes.

Trade associations, chambers of commerce, consumer protection committees and other social organizations. Under the guidance of the competent department of industry, mediation organizations can be established according to the situation and characteristics of contradictions and disputes in the industry and professional fields to participate in the work of preventing and resolving contradictions and disputes.

Tenth people's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in preventing and resolving contradictions and disputes.

National public officials, deputies to the National People's Congress, CPPCC members and advanced models should actively support and participate in the prevention and resolution of contradictions and disputes. Chapter II Prevention of Contradictions and Disputes Article 13 People's governments at all levels and relevant departments should strengthen the monitoring and early warning of contradictions and disputes in the fields of expropriation, ecological environmental protection, social security, finance and insurance, internet and public safety, establish and improve the working mechanism of big data analysis and prediction and active prevention and control, and prevent and reduce the occurrence of contradictions and disputes. Fourteenth people's governments at all levels and relevant departments should strictly abide by the statutory authority and legal procedures in administrative decision-making.

Normative documents formulated by the municipal, district and county people's governments shall be submitted to the Standing Committee of the people's congress at the same level for filing and examination according to law. Fifteenth people's governments at all levels and relevant departments shall organize public participation, expert argumentation, risk assessment, legality review and collective discussion and decision before making major decisions that may lead to social stability risks.

The results of social stability risk assessment should be used as an important basis for the implementation, suspension, suspension or non-implementation of major decision-making matters.
