Article 45 of the Provisional Regulations on Assignment and Transfer of Urban State-owned Land Use Rights:
"Meet the following conditions, with the approval of the land management department and the real estate management department of the people's government of the city or county, the allocated land use right and the ownership of buildings and other attachments on the ground can be transferred, leased or mortgaged:
(1) Land users are companies, enterprises, other economic organizations and individuals;
(2) Having a state-owned land use certificate;
(three) there are legal property rights certificates of buildings and other attachments on the ground;
(4) Signing a contract for the assignment of land use rights in accordance with the provisions of Chapter II of these Regulations, paying the assignment fee of land use rights to the local municipal or county people's governments or using the proceeds from assignment, lease or mortgage to offset the land use rights.
Maximum service life of land
The residence is 70 years, counting from the time when the land use right of the plot is obtained. The starting time of the land use life of the housing reform property right is the first house that pays the land transfer fee after participating in the housing reform. The service life of affordable housing is 50 years.
According to the relevant person from the municipal land department, the land use period is calculated from the date when the developer obtains the land use certificate of the plot, that is, the time when the state first transfers the plot.
According to the Property Law, which came into effect on June 65438+ 10/2007, "the right to use residential construction land will be automatically renewed when it expires."
