Provisions of Qingyuan Municipality on the Administration of Planning and Construction of Educational Facilities
Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Education Law of the People's Republic of China, the Urban and Rural Planning Law of People's Republic of China (PRC), the Land Administration Law of the People's Republic of China and other relevant laws and regulations, in order to strengthen the management of the planning and construction of educational facilities, meet the needs of social development and population growth, and promote the balanced development of education in the whole city. Article 2 These Provisions shall apply to the planning, construction and management of educational facilities within the administrative area of this Municipality.

The educational facilities mentioned in these Provisions refer to the buildings, structures and ancillary facilities used for holding kindergartens, primary schools, middle schools and other educational institutions. Article 3 The planning, construction and management of educational facilities shall follow the principles of government leading, unified planning, priority arrangement, rational layout and supporting construction. Article 4 The municipal and county people's governments shall be responsible for organizing and implementing the planning, construction and management activities of educational facilities within their respective administrative areas. Chapter II Planning of Educational Facilities Article 5 The people's governments at the city and county levels shall, according to the number and distribution of school-age children and adolescents in their respective administrative areas and in accordance with the relevant provisions of the state, formulate and adjust the school setting plan. Article 6 The administrative department of education of the people's governments of cities and counties shall, jointly with the competent department of urban and rural planning, regularly organize the preparation of special plans for educational facilities.

The special planning of educational facilities shall be compiled according to the national economic and social development planning, urban and rural planning and overall land use planning, and the layout, land use scale, construction scale and setting standards of educational facilities shall be determined according to administrative divisions, population living distribution, transportation, environment, existing educational resources, service radius and relevant standards. Article 7 Before the special plan for educational facilities is submitted for examination and approval, the organizing organ shall publish the draft of the special plan for educational facilities according to law, and solicit the opinions of experts and the public through argumentation meetings, hearings or other means. The announcement time shall not be less than 30 days. Article 8 The special plan for educational facilities shall be reported to the people's government with the power of examination and approval before promulgation and implementation. The approved special plan for educational facilities shall be incorporated into the regulatory detailed plan and shall not be modified without legal procedures. Article 9 The competent department of urban and rural planning of the people's government of the city or county and the people's government of the town shall reserve land for educational facilities and equip them with sufficient educational facilities in accordance with the law when preparing the regulatory detailed planning.

The development of new urban areas and the transformation of old cities should plan the construction of supporting educational facilities in advance. Tenth urban and rural planning examination and approval authorities shall, when organizing the review of regulatory detailed planning and town and village planning, take the complete educational facilities (including facilities and land) as the review content, and fully solicit the opinions of the education administrative department. Article 11 If the contents of educational facilities in the special planning or regulatory detailed planning of educational facilities need to be revised according to law, the opinions of the administrative department of education shall be sought and carried out in accordance with the statutory preparation and examination and approval procedures. Article 12 If the per capita area of existing primary and secondary schools and kindergartens in cities and towns is not up to the prescribed standard and cannot be solved by reducing the scale of running schools after evaluation by the administrative department of education, the people's governments at all levels shall give priority to solving the problem of insufficient school land in the process of urban construction and transformation according to the special planning or regulatory detailed planning of educational facilities. Chapter III Protection of Land for Educational Facilities Article 13 The land for educational facilities shall be applied to the real estate registration agency for real estate registration in time. Fourteenth no unit or individual may occupy or destroy the land for educational facilities.

Within the existing or reserved land for educational facilities, no residential buildings, commercial buildings and other buildings, structures and other facilities unrelated to education shall be built. Fifteenth without legal procedures, no unit or individual may change the nature of educational facilities. Sixteenth land for educational facilities where ownership disputes occur shall be handled according to law; Before the dispute is settled, neither party may change the status quo of land use. Seventeenth strictly control the requisition of school buildings and venues in schools and kindergartens. If it is really necessary to levy because of public interests, it shall obtain the consent of the administrative department of education and rebuild according to the plan. The original school and kindergarten area can not meet the basic standards of standardized schools and kindergartens, and should meet the standards when rebuilding. Article 18 If the existing public schools and kindergartens need to adjust their land use due to closure, merger, division, relocation and other reasons, the education administrative department of the jurisdiction shall, jointly with the relevant administrative departments of development and reform, planning, land and finance, put forward opinions in accordance with the principle of optimizing the allocation of educational resources and report them to the people's government with the right of approval for approval. Chapter IV Construction of Educational Facilities Article 19 The relevant departments shall solicit the opinions of the administrative departments of education on the construction scheme of educational facilities. Article 20 The construction of educational facilities shall conform to the design and construction standards and norms stipulated by the state, and meet the requirements of building quality, fire protection, lightning protection, earthquake resistance, environmental protection, energy saving, sound insulation, evacuation and sanitation. Popularize and apply advanced technologies, materials and equipment that are conducive to protecting the environment, reducing building energy consumption and improving the quality of educational facilities. Twenty-first the construction of educational facilities should be reasonably divided into functions to meet the needs of education and teaching. Configure barrier-free facilities in accordance with national norms to ensure the use and safety of disabled school-age children and adolescents. Twenty-second schools and kindergartens should have good traffic conditions, and the main roads adjacent to schools and kindergartens should be equipped with corresponding safety facilities to ensure the safe passage of students. In front of schools and kindergartens and the surrounding roads, standardized traffic signs and markings such as warning, speed limit, no singing and yield should be set up.

If the road in front of schools and kindergartens needs to be temporarily excavated or cut off due to construction, the construction unit shall inform the relevant schools and kindergartens before submitting the report for approval, and take corresponding measures to ensure the safe passage of teachers and students and the normal development of education and teaching activities.
