Regulations of Changsha Municipality on the Administration of Housing Provident Fund
Chapter I General Provisions Article 1 In order to strengthen the management of housing provident fund, safeguard the legitimate rights and interests of owners of housing provident fund, promote urban housing construction and improve the living standards of residents, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Management of Housing Provident Fund and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the deposit, withdrawal, use, management and supervision of housing provident fund within the administrative area of this Municipality. Article 3 The term "housing accumulation fund" as mentioned in these Regulations refers to the long-term housing savings paid monthly by individual employees and their units according to a certain proportion of employees' wages.

The housing accumulation fund paid by individual employees and the housing accumulation fund paid for employees by the unit where the employees work belong to individual employees. Fourth housing provident fund management follows the principle of relative separation of decision-making, operation and supervision. Article 5 The Municipal People's Government shall strengthen its leadership over the management of housing provident fund.

Changsha Housing Provident Fund Management Committee, Changsha Housing Provident Fund Management Center, Changsha Housing Provident Fund Supervision Committee (hereinafter referred to as CMC, Management Center and Board of Supervisors) and departments of finance, auditing, supervision, construction, real estate, labor and social security, the People's Bank of China and banking supervision shall do a good job in the management and supervision of housing provident fund according to their respective duties. Chapter II Institutions and Their Duties Article 6 The Administrative Committee is the decision-making body for housing provident fund management within the administrative area of this Municipality.

The term of office of the CMC is 5 years.

Management Committee members, the Municipal People's government and finance, real estate, the People's Bank of China and other relevant departments responsible person and relevant experts accounted for one-third, trade union representatives and employee representatives accounted for one-third, unit representatives accounted for one-third. The total number of members is 2 1, less than 29.

The director of the CMC is elected from among the CMC members. Article 7 The CMC shall hold regular meetings, not less than twice a year. When necessary, an interim meeting may be held upon the proposal of the director of the CMC, more than 1/5 members or the management center.

The decision of the CMC must be passed by more than 2/3 of all members of the CMC. Article 8 Responsibilities of the CMC:

(a) according to the provisions of the state, formulate the specific deposit ratio of housing provident fund, and approve the application of the unit to reduce the deposit ratio or delay the payment of housing provident fund;

(two) to determine the maximum loan amount of housing provident fund;

(three) to examine and approve the report on the collection, use plan and implementation of housing provident fund;

(four) to consider the housing provident fund value-added income distribution plan;

(five) other duties as prescribed by laws, regulations and policies.

The CMC shall listen to the opinions of units and employees extensively through forums, hearings or media before making major issues such as the proportion of housing provident fund deposit. The proposed housing provident fund deposit ratio shall be audited by the Municipal People's Government, approved by the provincial people's government, and implemented after being announced to the public. Article 9 In accordance with the principle of streamlining and high efficiency, a management center shall be established within the administrative area of this Municipality. The management center is a non-profit independent institution directly under the Municipal People's Government.

Branches established by the management center according to needs shall perform their duties within the scope authorized by the management center.

The management center and its branches shall implement unified rules and regulations and conduct unified accounting. Tenth management center is responsible for the daily management and operation of housing provident fund within the administrative area of this Municipality, and its duties are:

(a) the preparation and implementation of housing provident fund collection and use plan;

(two) responsible for recording the deposit, withdrawal and use of employee housing provident fund;

(three) responsible for the accounting, preservation and collection of housing provident fund;

(four) to approve the extraction and use of housing provident fund;

(five) the preparation of housing provident fund collection and use plan implementation report;

(six) to formulate the housing provident fund value-added income distribution plan;

(seven) to check the registration and deposit of the unit housing provident fund;

(eight) to accept complaints and reports of violations of housing provident fund management regulations;

(nine) to undertake other matters decided by the CMC. Eleventh the board of supervisors is responsible to the Municipal People's government and the depositor, and supervises the work of the management committee and management center.

JISC implements a tenure system with a term of five years.

The Board of Supervisors consists of representatives of municipal supervision, finance, auditing, banking supervision and other departments and units, representatives of employees and other specially invited social figures. The total number of JISC members is greater than 13 and less than 17. Chairman JISC is elected from JISC members. JISC and members of the Central Military Commission shall not concurrently serve each other.

JISC shall submit a supervision and inspection report to the Municipal People's Government, announce the results of supervision and inspection to the public, and decide on other major issues, which shall be approved by more than two thirds of all members of JISC. Article 12 The duties of JISC are as follows:

(a) to organize the supervision and inspection of the decision-making and operation of the housing provident fund;

(two) to supervise and inspect the housing provident fund financial business undertaken by the entrusted bank;

(three) announced the supervision of housing provident fund;

(four) to urge the relevant departments to deal with complaints and reports in violation of the provisions on the management of housing provident fund in a timely manner;

(five) to coordinate the supervision of other housing provident fund supervision departments on the management of housing provident fund.
