For-profit nursery institutions are registered in the market supervision and management departments at or above the county level where the nursery institutions are located. Market supervision and management departments at or above the county level are usually district and county industrial and commercial bureaus or market supervision and management bureaus with industrial and commercial administrative functions. Non-profit nursery institutions are registered in the civil affairs departments at or above the county level where the institutions are located. Civil affairs departments at or above the county level are usually district and county civil affairs bureaus. Nursery institutions need the following procedures: 1. Before applying for the registration of a child care institution, the applicant must obtain the approval of the Education Bureau, and its business premises should also be accepted by the public security fire department. The applicant's business premises have its own canteen, and a food hygiene license shall be obtained with the approval of the Health Bureau; 2. The applicant shall apply for a business license from the industrial and commercial department after handling the above-mentioned relevant approval documents or licenses.

Article 87 of the Civil Law of People's Republic of China (PRC) stipulates that a non-profit legal person is a legal person established for public welfare or other non-profit purposes and does not distribute profits to investors, promoters or members. Non-profit legal persons include institutions, social organizations, foundations and social service institutions.
