Provisions of Jilin Province on Promoting the Development of Private Education
Article 1 In order to promote the development of private education and safeguard the legitimate rights and interests of private schools and educatees, these Provisions are formulated in accordance with the People's Republic of China (PRC) Private Education Promotion Law and the People's Republic of China (PRC) Private Education Promotion Law Implementation Regulations and other laws and regulations, combined with the actual situation of this province. Article 2 These Provisions shall apply to the establishment, management, support and guarantee of private schools within the administrative area of this province.

The term "private schools" as mentioned in these Provisions refers to schools and other educational institutions organized by social organizations or individuals other than state institutions using non-state financial funds for the society. Article 3 Private education is a public welfare undertaking and an integral part of socialist education. People's governments at all levels should incorporate private education into the national economic and social development plan, and implement the policy of active encouragement, strong support, correct guidance and management according to law. Article 4 The administrative department of education of the people's governments at or above the county level shall be in charge of the work of private education within their respective administrative areas and perform the following duties according to their respective authorities:

(a) approved the establishment of private schools;

(2) Issuing licenses for running private schools;

(three) to conduct regular inspections of private education;

(four) the organization of recognition and reward for private education;

(five) release information about private schools;

(six) the organization of private education policy research and system construction;

(seven) other work as prescribed by laws, regulations and rules. The education administrative department of the fifth provincial people's government is responsible for the management of private higher education schools (including postgraduate pre-examination training and higher education self-study examination). Article 6 Private technical schools and training institutions that organize and implement vocational qualification training and vocational skills training shall be examined and approved by the administrative department of human resources and social security of the people's government at or above the county level, and the examination and approval results shall be copied to the education administrative department at the same level for the record. Seventh other relevant departments of the people's governments at or above the county level shall be responsible for the management of private education according to their respective responsibilities. Article 8 Private schools offering academic education shall meet the setting standards of similar public schools at the same level, among which schools offering compulsory education, ordinary high schools and institutions of higher learning must have independent property rights. Article 9 The standards for setting up private schools and kindergartens that offer non-academic education shall be formulated by the education administrative department of the Municipal People's Government in light of local conditions. If a school building is leased, a lease contract shall be signed with the consent of the organization or individual who has the right to dispose of the leased assets. Tenth standards for the establishment of private schools to carry out vocational skills training shall be formulated by the administrative department of human resources and social security of the provincial people's government. Eleventh the implementation of academic education of private schools must run schools in the place approved by the school license, and shall not set up branch schools.

Private schools that implement non-academic education shall not set up school projects beyond the scope approved by the school license. The establishment of branches and the change of school location must be reported to the original examination and approval authority for approval. Fourteenth private schools that investors do not require reasonable returns shall enjoy the same preferential tax policies as similar public schools at the same level according to law. Private schools that require investors to obtain reasonable returns enjoy preferential tax policies in accordance with the provisions of the financial and tax departments. Fifteenth private schools enjoy the same enrollment rights as similar public schools at the same level, and can independently determine the enrollment scope, standards and methods. Among them, the enrollment plan and enrollment work of private schools that implement academic education shall be implemented in accordance with the relevant provisions of the state and the province. Sixteenth private school teachers' professional title evaluation and appointment, with reference to the same level of similar public schools' professional title evaluation and appointment methods. The personnel files of staff in private schools that implement academic education refer to the management of personnel files in public schools. Seventeenth private school staff in business training, job appointment, calculate length, recognition and reward, scientific research projects and subject declaration, social activities, etc. , enjoy the same rights as the staff of similar public schools at the same level according to law. Article 18 Educatees in private schools enjoy the same rights as those in similar public schools at the same level in terms of further education, transfer, employment and participation in advanced selection. Nineteenth private school junior high school graduates and secondary vocational school graduates with household registration in this province can participate in the high school entrance examination and college entrance examination at their school locations. Twentieth private schools should improve the internal management system and operation mechanism of the school, and improve the management system and corporate governance structure of the school board of directors, the board of directors or other forms of decision-making bodies. Twenty-first private schools should provide a safe education and teaching environment for the educated in strict accordance with the relevant provisions of the state and the province, and ensure the personal and property safety of the educated. Twenty-second private schools should sign labor contracts with the employees, and clarify the rights and obligations of both parties. Disputes shall be handled in accordance with the provisions of the state and the province on personnel and labor disputes.
