Regulations of Ningbo Municipality on Preventing and Stopping Domestic Violence
Article 1 In order to prevent and stop domestic violence, protect the legitimate rights and interests of family members, establish equal, harmonious and civilized family relations, and promote social harmony and progress, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 The term "domestic violence" as mentioned in these Regulations refers to the behavior that the perpetrator causes physical and mental harm to family members by beating, binding, maiming, threatening, insulting, forcibly restricting personal freedom or other means.

The term "family members" as mentioned in these Regulations refers to spouses, children (adopted children), parents (adoptive parents), stepchildren, stepparents, brothers and sisters, grandparents, grandmothers, grandchildren, daughter-in-law (son-in-law), in-laws (in-laws) and other relatives who jointly raise, support or live together. Article 3 These Regulations shall apply to the activities of preventing and stopping domestic violence within the administrative area of this Municipality. Article 4 Any form of domestic violence is prohibited.

To prevent and stop domestic violence, we should follow the principle of giving priority to prevention and comprehensive management, and combine education with punishment. Article 5 It is the common responsibility of the whole society to prevent and stop domestic violence.

Any organization or individual has the right to report domestic violence, and has the right to dissuade, stop or report ongoing domestic violence to public security organs. Article 6 People's governments at all levels shall strengthen their leadership in the work of preventing and stopping domestic violence, incorporate the work of preventing and stopping domestic violence into the work plan of legal publicity and education, and organize relevant departments to carry out comprehensive management of domestic violence. Article 7 The municipal, county (city) and district people's governments shall set up committees to prevent and stop domestic violence, which shall be responsible for organizing, coordinating, guiding and supervising the relevant organs and organizations in the region to carry out the work of preventing and stopping domestic violence. Specific responsibilities are:

(a) to carry out publicity and training to prevent and stop domestic violence, and to supervise and inspect the implementation of laws and regulations to prevent and stop domestic violence;

(two) to establish a network and cooperation mechanism to prevent and stop domestic violence, set up a team of volunteers to prevent and stop domestic violence, and guide the neighborhood (village) committees to establish domestic violence complaint stations (points);

(three) to coordinate and urge the relevant organs and organizations to prevent and stop domestic violence to accept, mediate, investigate and deal with domestic violence cases in a timely manner according to law, and provide help and relief services for victims of domestic violence;

(four) summarize and popularize the advanced experience of preventing and stopping domestic violence, and commend and reward organizations and individuals who have made remarkable achievements in preventing and stopping domestic violence;

(five) to carry out other work related to the prevention and suppression of domestic violence.

The Committee for the Prevention and Suppression of Domestic Violence has set up an office to be responsible for the daily work of the Committee. Article 8 State organs, social organizations, enterprises and institutions shall incorporate the work of preventing and stopping domestic violence into the work scope of legal publicity and education, comprehensive management of social security and spiritual civilization construction in their own regions, industries and units, and cooperate with each other according to their respective responsibilities to jointly prevent and stop domestic violence. Article 9 Grassroots mass autonomous organizations such as residents' committees and villagers' committees shall, within the scope of their duties, do a good job in preventing and stopping domestic violence, carry out activities to create civilized families, publicize the knowledge of preventing domestic violence and self-protection, and mediate family disputes within their jurisdiction in a timely manner. Article 10 The news media should play the role of publicity and education and the guidance of news public opinion, strengthen the supervision of public opinion on domestic violence, advocate the establishment of equal, harmonious and civilized family relations, and create a social atmosphere for preventing and stopping domestic violence. Article 11 Victims of domestic violence can directly or entrust others to complain or seek help from neighborhood (village) committees, units where domestic violence victims work, township (street) comprehensive management institutions, judicial offices and other grass-roots units and autonomous organizations, as well as mass organizations and institutions such as women's federations, trade unions, the Communist Youth League, aging committees and disabled persons' federations at all levels, or they can report to the public security organs.

Relevant organs and organizations shall promptly accept complaints, help or reports from victims of domestic violence, and shall not refuse or shirk. Article 12 The relevant organizations that accept domestic violence complaints or seek help shall provide timely mediation and guidance to the parties involved in domestic violence, truthfully record the illegal facts of the perpetrators of domestic violence and the victims' victimization, and make and keep witness materials after soliciting the opinions of the victims. The ongoing domestic violence should be discouraged and stopped in time; If the circumstances are serious and the dissuasion is ineffective, it shall report the case to the public security organ in time.

At the request of the victims of domestic violence, the relevant organizations shall truthfully provide proof of domestic violence. Thirteenth public security organs should report domestic violence into the scope of 1 10 alarm service. After receiving a report of domestic violence, the police should be dispatched in time to stop it, make a record of receiving the police, and issue a report receipt to the informant.

After investigation and evidence collection, the public security organ shall, according to different situations, deal with domestic violence cases in a timely manner according to law as follows:

(a) if the circumstances are minor, mediation can be used to criticize and educate the perpetrators of domestic violence, inform them of their legal responsibilities and prevent the situation from expanding.

(two) in violation of the provisions of public security management, according to the "People's Republic of China (PRC) public security management punishment law" to be dealt with.

(three) suspected of committing a crime, should be placed on file for investigation, criminal responsibility shall be investigated according to law; If it is a case of criminal private prosecution, the victim or his legal representative or close relatives shall be informed that they can bring a lawsuit to the people's court.
