Private schools should adhere to the socialist direction of running schools, fully implement the national education policy, run schools according to law, and ensure the quality of education and teaching. Article 4 The people's governments at or above the county level shall adhere to the policy of active encouragement, strong support, correct guidance and management according to law, and incorporate private education into the national economic and social development plan.
The people's governments at or above the county level shall organize and coordinate relevant departments to solve major problems in the development of private education in a timely manner and promote the healthy, orderly and sustainable development of private education. Article 5 The education department of the people's government at or above the county level is the competent department of private education within its administrative area, and shall strengthen the service, management and supervision of private schools according to law.
The competent departments of human resources and social security of the people's governments at or above the county level shall, within the scope of their duties, strengthen the service, management and supervision of private schools that implement vocational qualification training and vocational skills training.
Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective duties, be responsible for the relevant private education work. Article 6 People's governments at or above the county level shall organize the establishment and improvement of risk prevention mechanisms and emergency response mechanisms for private schools. Chapter II Establishment of Private Schools Article 7 The establishment of private schools shall meet the needs of local economic and social development and education development, and meet the conditions stipulated in the Education Law and other laws and regulations.
The examination and approval authority shall announce the conditions for the establishment of private schools, the procedures and time limit for examination and approval, and the relevant materials that need to be submitted. The examination and approval authority shall issue a school license to a formally established private school, and announce the formally established private school and its articles of association to the public.
When a private school obtains a school license, it shall register as a legal person in accordance with relevant laws and administrative regulations, which shall be handled by the registration administration organ according to law. Article 8 The establishment of private schools shall be examined and approved in accordance with the following authorities:
(a) the implementation of undergraduate education in colleges and universities and higher vocational schools in the normal and medical colleges, in accordance with the relevant provisions of the state, reported to the the State Council municipal education authorities for approval;
(two) higher vocational schools that implement special education other than normal education and medicine shall be examined and approved by the provincial people's government and reported to the education authorities in the State Council for the record;
(3) Ordinary senior middle schools and secondary vocational and technical schools that implement senior secondary education shall be examined and approved by the competent education department of the people's government at the prefecture level and reported to the competent education department of the provincial people's government for the record;
(four) the implementation of compulsory education, preschool education, cultural education and non academic education schools, approved by the education department of the people's governments at or above the county level;
(5) Schools that focus on vocational qualification training and vocational skills training shall be examined and approved by the competent departments of human resources and social security of the people's governments at or above the county level in accordance with the limits of authority prescribed by the state, and copied to the competent education departments at the same level for the record; Technical schools shall be examined and approved by the competent departments of human resources and social security of provincial and prefecture-level people's governments in accordance with their respective authorities.
Applications for the establishment of multi-level schools shall be accepted by the examination and approval authorities responsible for the examination and approval of high-level schools, and the opinions of other examination and approval authorities at all levels shall be solicited. Chapter III Teachers and Educated Persons Article 9 Teachers and educated persons in private schools have the same legal status as those in public schools. Article 10 A private school shall employ a full-time principal who meets the post requirements, and both parties shall sign an employment contract according to law for a period of not less than three years.
The headmaster shall perform the functions and powers of education, teaching and administration according to the school charter and employment contract. Eleventh private schools shall, in accordance with the relevant provisions of the state, establish a team of teachers that is suitable for their school-running level, scale and professional setting, and train backbone teachers and academic leaders according to the actual needs of teaching and scientific research.
The relevant departments of the people's governments at or above the county level shall do a good job in the management of the collection, collation, storage, utilization and transfer of teachers' personnel files in private schools. In the process of personnel file management of teachers in private schools, the safety of archival materials shall be ensured, and the contents of archives shall not be disclosed without authorization, and the archival materials shall not be altered, extracted, destroyed or forged without authorization. Twelfth private schools independently employ qualified teachers and staff. Private schools should sign employment contracts in accordance with the law to clarify the rights and obligations of both parties. Personnel disputes shall be handled with reference to the relevant provisions of personnel disputes in public schools.
When recruiting other staff, private schools shall conclude labor contracts according to law. If there is any dispute, it shall be handled in accordance with the laws and regulations on handling labor disputes. Thirteenth private schools enjoy the same enrollment rights as similar public schools at the same level, and can independently determine the enrollment scope, standards and methods.
The enrollment of academic qualifications in private colleges and universities shall conform to the relevant provisions of the state and be included in the enrollment plan of higher education in this province; The competent department of development, reform and education of the provincial people's government shall approve the enrollment plan according to its school conditions.
Private schools may not organize students by paying or paying student organization fees in disguised form.
