Countermeasures and suggestions to promote the reasonable realization of teachers' disciplinary power
Countermeasures and suggestions to promote the reasonable realization of teachers' disciplinary rights: strengthening the cultivation of teachers' morality; Create a good social environment, so that teachers have a moderate space for disciplinary power; Formulate specific operating standards.

First, strengthen the cultivation of teachers' morality

The vivid display of teachers' labor determines that teachers must always pay attention to their words and deeds in their daily teaching and management activities. Teachers' punishment for students' anomie will exert a subtle influence on students. When a teacher chooses what kind of behavior to punish, it is also a process of educating students.

In this process, students will understand the truth of "doing something and not doing something" in school life, and will also establish certain standards of behavior in their hearts. From another perspective, teachers' morality affects teachers' understanding of the purpose of punishment and their choice of punishment methods in the process of punishment, thus affecting the effect of punishment.

Second, create a good social environment, so that teachers have a moderate space for disciplinary power.

2019165438+122 October, the Ministry of Education issued the Detailed Rules for the Implementation of Educational Punishment for Primary and Secondary School Teachers (Draft for Comment), pointing out that educational punishment is a necessary means and legal authority for teachers to perform their educational and teaching duties, which has attracted favorable comments from the whole society, including teachers and parents.

"Teachers are willing to excel", and teachers and parents are exactly the same. For students who misbehave, there is an attitude of "hating iron and not producing steel". The use of disciplinary power is not out of personal hatred and anger, but to educate students and put them on the right track.

Once the Detailed Rules for the Implementation of Disciplinary Measures for Primary and Secondary School Teachers' Education becomes a formal regulation, various publicity methods should be adopted nationwide to publicize the rationality and legitimacy of teachers' use of disciplinary power, so that the whole society can support teachers' correct use of disciplinary power, create a good social environment, and give teachers a moderate space for disciplinary power.

Third, formulate specific operating standards.

"A good law should clearly and specifically tell people what they can and can't do. Only in this way can we give full play to the role of law and let it better regulate social relations and serve social life. " The Education Law and the Teachers Law do not stipulate the scope of punishment, nor the specific ways and methods of punishment.

Lack of specific operating standards, in practice, teachers can easily grasp the degree of bad punishment, thus confusing punishment with corporal punishment.

Chapter 4, Article 22 of the Detailed Rules for the Implementation of the Compulsory Education Law of People's Republic of China (PRC) stipulates that schools and teachers shall not impose corporal punishment on students, corporal punishment in disguised form or other acts that insult personal dignity. However, all these legal provisions do not properly explain what corporal punishment and disguised corporal punishment are, which can easily lead to various problems in the process of teachers' exercise of disciplinary power.

Due to the differences in teachers' personality, conduct and educational ideas, teachers think it is necessary to punish them, which is likely to be corporal punishment or corporal punishment in disguised form in the eyes of students or parents, leading to some conflicts and even legal disputes between home and school. Therefore, it is urgent to formulate specific operating standards and clarify the principles, means and procedures of punishment.
