The Education Law of the People's Republic of China is the "parent law" for making all educational laws and regulations. Education law is the second level of China's education legal system. The first level is the constitution. The basic laws based on the Constitution mainly stipulate the basic nature, status, tasks, basic legal principles and basic education system of China's education. The education law is the "mother law" of all education laws and regulations, the basic criterion for coordinating the relationship between education departments and other social departments, and the basis for designating other education laws and regulations. It can be seen that the status of education law is also quite high, and the basic problems to be solved by education law are the status of education, education policy, basic education system, citizens' rights and obligations to receive education, the relationship between education and society, and education funds.

Constitution is the fundamental law of our country, and education law is the "mother law" for making all educational laws and regulations.

In order to develop higher education, implement the strategy of rejuvenating the country through science and education, and promote the construction of socialist material civilization and spiritual civilization, this Law is formulated in accordance with the Constitution and the Education Law.

Article 1 of the Law of People's Republic of China (PRC) on National Defense Education

In order to popularize and strengthen national defense education, carry forward the spirit of patriotism, and promote national defense construction and socialist spiritual civilization construction, this Law is formulated in accordance with the National Defense Law and the Education Law.

In order to implement the strategy of rejuvenating the country through science and education, promote the healthy development of private education, and safeguard the legitimate rights and interests of private schools and educatees, this Law is formulated in accordance with the Constitution and the Education Law.
